Memorial Auditorium Building
January 29, 1948
The Board of Aldermen of the City of Wichita Falls, Texas, met in
called session on the above date at 1 30 o'clock P.M. in the Council Room
in the Memorial Auditorium Building, with the following members present:
W. B. Hamilton Mayor
K. C. Spell 0
E. J. Wininger Aldermen
Melvin B. Evans
J. M. Baber
Henry Nabors, Assistant City Manager
T. A. Hicks, City Attorney
Geo. T. Henderson, City Clerk
A quorum being present, Mayor Hamilton stated this meeting had been
called for the purpose of holding a Public Hearing on the proposed Ordinance
No. 1452, as advertised.
Moved by Alderman Evans that the Council proceed with the Public
Hearing on Ordinance No. 1452.
Motion seconded by Alderman Spell and carried.
A large delegation of citizens of the City was present for the Public
Hearing, at which time both proponents and opponents were given an opportunity
to express their views, thereupon the following motion was had:
Moved by Alderman Evans that the Public Hearing on Ordinance No.
1452 be closed.
Motion seconded by Alderman Wininger and carried.
ORDINANCE NO. 1452
AN ORDINANCE TO REGULATE AND RESTRICT THE USE OF LAND AND THE LOCATION
OF BUILDINGS DESIGNED FOR SPECIFIED USES: TO REGULATE AND RESTRICT THE LOCATION
OF TRADES AND INDUSTRIES; TO REGULATE AND LIMIT THE HEIGHT AND BULK OF BUILD-
INGS HEREAFTER ERECTED OR ALTERED; TO REGULATE AND DETERMINE THE AREA OF YARDS,
COURTS AND OTHER OPEN SPACES, IN CONNECTION 1ITH BUILDINGS AND/OR SURROUNDING
BUILDINGS HEREAFTER ERECTED OR ALTERED; TO REGULATE AND LIMIT THE DENSITY OF
POPULATION; TO DIVIDE THE CITY INTO DISTRICTS AND ESTABLISH BY REFERENCE TO A
MAP, THE BOUNDARIES OF SAID DISTRICTS FOR SAID PURPOSES; TO PROVIDE FOR A BOARD
OF ADJUSTMENTS AND DEFINING ITS POWERS AND DUTIES; TO PROVIDE FOR ITS ENFORCE-
MENT AND PRESCRIBING THE FOLLOWING PENALTIYS: ANY PERSON, FIRM OR CORPORATION
WHO VIOLATES, DISOBEYS, OMITS, NEGLECTS, OR REFUSES TO COMPLY WITH, OR WHO RE-
SISTS THE ENFORCEMEVTS OF ANY OF THE PROVISIONS OF THIS ORDINANCE, SHALL, UPON
CONVICTION, BE FINED NOT LESS THAN TEN DOLLARS ($10) OR MORE THAN ONE HUNDRED
DOLLARS ($100) FOR EACH OFFENSE. EACH DAY THAT A VIOLATION IS PERMITTED TO EXIST
SHALL CONSTITUTE A SEPARATE OFFENSE; TO PROVIDE FOR THE AMENDMENTS TO THIS
ORDINANCE; TO PROVIDE FOR PL71OLITS A14D CERTIFICATES OF OCCUPANCY; TO PROVIDE FOR
ITS INTrRPRETATION AND THAT OF OTHER ORDINANCES OR LAWS OR COVENANTS, ETC.,
RELATING TO THE SAME OR SIMILAR UBJECTS; TO PROVIDE THAT IF ANY CLAUSE, SENTENCE,
SECTION, PARAGRAPH OR PART OF THIS ORDINANCE SHALL BE HELD INVALIDP SUCH INVALIDITY
SHALL NOT INVALIDATE THE RaIAINDER; TO PROVIDE FOR THE REPEAL OF ALL OTHER
ORDINANCES OR PARTS OF SUCH ORDINANCES IN C014FLICT j,ITH THIS ORDINANCE.

Moved by Alderman Evans that Ordinance No. 1452 be approved and passed
as read on its third and final reading.
After some discussion, the motion was withdrawn by Alderman Evans.
Moved by Alderman Evans that the Board of Aldermen approve and authorize
payment to the Wichita General Hospital the sum of $3725.54 for charity patients
for the month of December, upon like payment by Wichita County.
Motion seconded by Alderman Wininger and carried.
ORDINAICE NO. 14
AN ORDINANCE AM'rENDING SECTION/-901 OF ORDINANCE NO. 1392 PASSED AND
APPROVED BY THE BOARD OF ALDERMEN ON THE 23RD DAY 07 0CTOBER A. D. 1944 PRO-
VIDING FOR ONLY ONE REGULAR MONTHLY MEETING OF THE BOARD OF ALDERMEN TO BE
HELD ON THE SECOND MONDAY OF EACH CALENDAR MONTH AND AMENDING THE SAME AND
PROVIDING FOR TWO MONTHLY MEETINGS BY THE BOARD OF ALDERMEN TO BE HELD ON THE
SECOND AND FOURTH MONDAYS OF EACH CALENDAR MONTH.
Moved by Alderman Baber that Ordinance No. 1453 be approved and
passed as read on its third and final reading, and declaring an emergency.
Motion seconded by Alderman Wininger and Carried by the following
vote:
Yeas: Aldermen Spell, Wininger, Evans and Baber.
Nays: None.
ORDINANCE NO. 1454
AN ORDINANCE CHANGING THE NAME OF TWENTY-SIXTH STREET, BETWEEN
HOLLIDAY AND CARRIGAN, TO VICTORY STREET, IN THE CITY OF WICHITA FALLS, TEXAS.
Moved by Alderman Evans that Ordinance No. 1454 be approved and
passed as read on its third and final reading.
Motion seconded by Alderman Wininger and carried by the following
vote:
Yeas: Aldermen Spell, Wininger, Evans and Baber.
Nays: None.
ORDINANCE N0. 145�
AId ORDINANCE AMaJDING SECTION 4-707 OF ORDINANCE NO. 1377, PASSED
AND APPROVED THE 29TH DAY OF DECEMBilt, A.D. 1943, PROVIDING FOR THE CLOSING
HOURS OF ALL PUBLIC DANCE HALLS AT TWELVE OIMOCK P.M., CHANGING SUCH HOUR
TO ONE O'CLOCK A.M. SO THAT ALL PUBLIC DANCE HALLS SHALL CLOSE AT ONE O'CLOCK A.M.
Moved by Alderman Evans that Ordinance No. 1455 be approved and
passed as read on its second reading.
Motion seconded by Alderman Wininger and lost by the following vote:
Yeas: Alderman Evans.
Nays: Alderman Spell, Wininger and Baber.

Moved by Alderman Wininger that the Board of Aldermen approve for
payment to Mrs 011ie Goodman the sum of $4000.00, as settlement in full
for the said Mrs 011ie Goodman's claim for alleged damages, and to authorize
and direct the City Clerk to draw a warrant for the same when and at such
time as the claimant executes the proper release to the City.
Motion seconded by Alderman Spell and carried.
Moved by Alderman Evans that the Board of Aldermen approve for
payment to Dr. W. L. Powers the sum of $50.00 for professional services
rendered in connection irith the physical examination of Mrs 011ie Goodman,
and to direct the City Clerk to draw a warrant for the same.
Motion seconded by Alderman Spell and carried.
Moved by Alderman Evans that the Board of Aldermen approve for
payment to Lola Woodward the sum of $12.00 for preparing a deposition
in connection with the Mrs 011ie Goodman case.
Motion seconded by Alderman Spell and carried.
Moved by Alderman Spell that the meeting be adjourned.
Motion seconded by Alderman Wininger and carried.
The Board of Aldermen then adjourned.
