Min 12/08/1947 440 i Wichita Falls, Texas Memorial Auditorium Building December 8, 1947 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session on the above date at 7-30 o'clock Y.M. in the Council Room in the Memorial Auditorium, with the following members present: W. B. Hamilton, Mayor C. A. Spragins K. C. Spell E. J. Wininger Aldermen Melvin B. Evans J. M. Baber A. Jay Eastham G. D. Fairtraee, City Manager T. A. Hicks, City Attorney Geo. T. Henderson, City Clerk The Minutes of the regular meeting held November 10, 1947, were read and approved as read; likewise the Minutes of the called meetings held November 20th and December lst, 1947, respectively, were read and approved as read. Moved by Alderman Spragins that the Board of Aldermen approve and authorize J. H. York and A. A. Carter, operating a taxicab service in the City under the assumed name of Four Threes Taxi Company, to change assLLned name to Checker Cab Company, ef�fective Januany 1, 1948. Motion seconded by Alderman Wininger and carried. Moved by Alderman Wininger that the Board of Aldermen approve for payment the sum of $21.30 to E. S. McCreary for personal and property damages sustained by his son, Bobby Gene McCreary, as alleged by the said E. S. McCreary in his claim for damages as set forth in his letter addressed to the Council November 24, 1947, and further to direct the City Clerk to draw a warrant for the same, payable out of the Water Fund, when and at such time as the said E. S. McCreary executes the proper Release to the City. Motion seconded by Alderman Eastham and carried. Moved by Alderman Evans that a permit be granted to George A. Bruce, dba Ozark Cafe, for the purpose of erecting a sign between the curb and side- walk at 202 Scott Avenue, for a period of one year, providing the same is erected under the direction of the City Engineer.. Motion seconded by Alderman Eastham and carried. Moved by Alderman Eastham that the Board of Aldermen authorize the leasing of a 203.8 acre tract of land located in the vicinity of the Water Department Second Reservoir in League 1, Denton County School Land, Wichita County, for a period of one year, ending January 1, 1949, for a consideration of $815.20, payable in advance; and further to authorize the City Manager to execute a Lease Contract for the same for and on behalf of the City of Wic'',-dta Falls. Motion seconded by Alderrawi Wininger and carried. 441 Moved by Alderman Spragins that tha Board of Aldermen authorize the City Manager, G. D. Fairtrace, to enter into contract,for and on behalf of the City, with the Economy Form Corporation, for the purpose of renting certain ♦ - forms necessary for the construction of certain improvements by the Water Department, adjacent to the Ninth Street Water Reservoir, for a consideration- of approximately $3720.00. Motion seconded by Alderman Wininger and carried. Moved by Alderman Evans that the Board of Aldermen grant and authorize the execution of a right-of-way easement to the Wichita Falls & Southern Railway Company for the purpose of construction and operation of a single line railway track on, over and across Bluff Street in Wichita Falls, said right-of-way to begin at a point on the East line of Block 30 of Sibley Taylor Addition to Wichita Falls, 41 feet southeast of the south rail of the main line of railroad of the Wichita Valley Railway Company, continuing along said east line of said Block 30 a distance of 16 feet, and extending on, over and across Bluff Street from said points to similar points in the west line of Block 31, Sibley-Taylor Addition; and further to authorize and empower the city manager to execute the said right-of-way easement for and on behalf of the City of Wichita Falls, providing the said Wichita Falls & Southern Ry. Co. paves that portion of:Bluff -Street;becupied by:said,t`rack'=and 'twb (2) feet each side thereof. Motion seconded by Alderman Wininger and carried. ORDINANCE NO. 1451 AN ORDINANCE CLOSING AND ABANDONING A PORTION OF VIRGINIA STREET, WALKER AVENUE, FOUNTAIN AVENUE A14D S 1ARTZ AVr;NUE FROM KENTU CKY AVENUE TO VIRGINIA STREET AND THE ALLEYS IN BLOCKS 5 & 8 OF THE SOUTH PARK ADDITION BETtIEEN KENTUCKY AVENUE AND VIRGII4IA STH&,T IN THIS CITY OF 1,JICHITA FALI.S, TEXAS, RESERVING TO THE CITY ALL NECESSARY EAS MEINTS FOR UTILITIES, :IF ANY ARE NO4J IN SAID STREii;TS Oit ALLEYS, AND ADEQUATE DRAINAGE, AND PROVIDING THAT THE CITY SHALL UNDrh NO CIRCUPISTANCES, HE LIABLE FOR DAMAGES IN THE EVENT BUILDINGS ARE CONSTRUCTED OVER EXISTING ShWER LINES BY VIRTUE, OF THE MAINTENANCE AND OPERATION OF SAID SEWER, AND DRAINAGE DITCHES AND DECLARING AN EMERGENCY. Moved by Alderman Evans. , that Ordinance No. 1451 be approved and passed as read on its first reading. Motion seconded by Alderman Eastham and carried by the following vote: Yeas: Aldermen Spragins, Spell, Wininger, Evans, Baber and Eastham. Nays: None Moved by Alderman Wininger that the rule requiring that Ordinances be read on three separate days be and is hereby suspended, and declaring an emergency. Motion seconded by Idderman Eastham and carried by the following vote: Yeas: Aldermen Spragins, Spell, Wininger, Evans, Baber and Eastham. Nays: None. 442 Moved by Alderman- Baber that Ordinance No. 1451 be approved and passed as read on its second reading. Motion seconded by Alderman Wininger and carried by the following vote: Yeas: Aldermen Spragins, Spell, Wininger, Evans, Baber and Eastham. Nays: None Moved by Alderman Eastham that Ordinance No. 1451 be approved and passed as read on its third and final reading, and declaring an emergency. Motion seconded by Alderman Evans and carried by the following vote: Yeas: Aldermen Spragins, Spell, Wininger, Evans, Baber and Easthem. Nays: Drone. Moved by Alderman Spragins that previous action of the Council at a regular meeting held October 13, 1947, wherein the Board of Aldermen authorized the execution of a corititact or agreement by and between the City of Wichita Falls and the Texas Electric Service Company for electric service for overhead street lighting and traffic signals, more particularly described as Rate Schedule Y-2, for a period of two years, be and is hereby amended to read for a period of ten years; and further to authorize Mayor W. B. Hamilton, or City Manager G. D. Fairtrace, to execute the said amended contract or agreement for and on behalf of the City of Wichita Falls. Motion seconded by Alderman Evans and carried. Mayor Hamilton recommended that the dates for regular council meetings be increased to two monthly meetings, whereupon the following motion was had: Moved by Alderman Spragins that the city attorney be authorized and directed to prepare an ordinance providing .for two regular council meetings each month, being on the second and fourth Monday nights of each month, and submit the same to the Council for further consideration. Motion seconded by Alderman Wininger and carried. Moved by Alderman Baber that the meeting be adjourned. Motion seconded by Alderman Wininger and carried. The Board of Aldermen then adjourned.
