Min 09/25/1947 412 II Wichita Fads, Texas Memorial Auditorium September 25, 1947 The Board of Aldermen of the City of Wichita Falls, Texas, met in called session on the above date at 11:00 o'clock, A. M., in the Council Room in the Memorial Auditorium, with the following members present: C.A. Spragi.ns K. C. Spell Melvin B. Evans Aldermen J. M. Baber A. Jay Eastham G: D. Fairtrace, City Manager T. A. Hicks, City Attorney Geo.T. Henderson, City Clerk The City Manager announced this meeting was called for the purpose of considering various matters of importance to the City. Moved by Alderman Spragins that Alderman Eastham be elected Mayor pro tem for this meeting. Motion seconded by Alderman Spell and carried. RESOLUTION NO. 10 A RESOLUTION AUTHORIZING AND DIRECTING THE CITY ATTORNEY OF WICHITA FALLS, TEXAS, TO INSTITUTE CONDEMATION PROCEEDINGS TO ACQUIRE THE FEE TITLE TO THE LANDS BELONGING TO THE HEREINAFTER DESIGNATED PARTIES TO BE USED BY THE CITY FOR STREET PURPOSES. THAT WHEREAS, the City of Wichita Falls desires to begin street improvements on what is designated as Galveston Street cut-off Highway be- tween U. S. Highway 287 and State Highway 79, located in Wichita Falls, Wichita County, Texas, which makes it necessary for the city to acquire from the owners the hereinafter described property, and WHEREAS, the City of Wichita Falls and the hereinafter described owners have been unable to agree upon the value of the respective property owned by said parties hereinafter described for the damages occasioned by the acquisition of such land and property by the city to be used for street purposes. NOW, THEWORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS. SECTION 1. That the City Attorney be, and he is hereby directed to immediately institute condemnation proceedings to acquire the fee simple title to the hereinafter described property belonging to the parties herein named, to-wit: Sandy Jones and Mattie Jones, being the owners of Lot 10, Block 22, J.A. Kemp Addition. Charles Ellison and wife, Maybelle Ellison owners of part of Lot 11, Block 22, J. A. Kemp Addition. C. W. Crockett and wife, Nettie Crockett, owners of part of Lot 12, Block 22, J. A. Kemp Addition. Austin Bolden and wife, Mary Jo Bolden, owners of a part of lots 13 and 14, Block 22, J. A. Kemp Addition. 413 James Branch and Susie Hollands, a widow, owners of part of Lots 1 and 2, Block 31, and a part of Lot 14, Block 31, J. A. Kemp Addition, all of said property being located in the City of Wichita Falls, Wichita County, Texas. That the city acquire the fee simple title to the said land and pro- perty for the reason that said land and property is to be used for street pur- poses by the City of Wichita Falls, Texas. Moved by Alderman Spragins that the above and foregoing Resolution be adopted and passed as read. Motion seconded by Alderman Baber and carried by the following vote: Yeas: Aldermen Spragins, Spell, Evans and Baber. Nays; None. ORDINANCE NO. 1440 AN ORDINANCE REPEALING ORDINANCE NO. 416 PASSED AND APPROVED BY THE BOARD OF ALDERMEN ON AUGUST 1, 1922, ENTITLED "AN ORDINANCE PROHIBITING ANY CIRCUS OR PART OF A CIRCUS TO BE HELD OR CONDUCTED WITHIN THE CITY OF WICHITA FALLS AT ANY TIME BETWEEN THE 1ST DAY OF SEPTEMBER AND THE LOTH DAY OF OCTOBER ANYWHERE WITHIN THE CORPORATE-LIMITS OF THE CITY OF WICHITA FALLS, TEXAS." Moved by Alderman Spell that Ordinance No. 1440 be approved and passed as read on its third and final reading. Motion seconded by Alderman Evans and carried by the following vote: Yeas: Aldermen Spragins, Spell, Evans and Baber. Nays: None. ORDINANCE NO. 1441 J AN ORDINANCE PROVIDING FOR A CUSTO➢IAN FOR THE MEMORIAL AUDITORIUM, GROUNDS, AND BUILDING BELONGING TO THE CITY OF WICHITA FALLS, TEXAS, FIXING A SCHEDULE OF RENTS TO BE CHARGED FOR THE USE OF SUCH AUDITORIUM, AND GROUNDS, AND AUTHORIZING SUCH CUSTODIAN TO RENT THE AUDITORIUM AND/OR GROUNDS AND COLLECT SUCH CHARGES AS MAY BE PROVIDED BY THIS ORDINANCE, HEREBY REPEALING ALL OTHER ORDINANCES IN CONFLICT HERE- WITH AND DECLARING AN EMERGENCY. Moved by Alderman Baber that Ordinance No. 1441 be approved and passed as read on its third and final reading, and declaring an emergency. Motion seconded by Alderman Spell and carried by the following vote: Yeas: Aldermen Spragins, Spell, Evans and Baber. Nays: None. 414 ORDINANCE NO. 1442 AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO INTRUDE OR TRESPASS UPON THE PREMISES OF ANOTHER IN THE CITY OF WICHITA FALLS, TEXAS, WITHOUT THE CONSENT OF THE OWNER OR OCCUPANT OF SUCH PREMISES, PRESCRIBING A PENALTY, AND DECLARING AN EMERGENCY. Moved by Alderman Spell that Ordinance No. 1442 be approved and passed as read on its third and final reading, and declaring an emergency. Motion seconded by Alderman Evans and carried by the following vote: ,Yeas: Aldermen Spragins, Spell, Evans and Baber. Nays: None. Moved by Alderman Evans that the Board of Aldermen approve for payment the sum of $1526.11 to the City National Bank by virtue of a certain water main contract in the Marlborough Addition previously entered into by and between the ;City of Wichita-Falls and Kemp, Harrell and Peckham aubsequeritly assigned to the City National Bank, and further to direct the City Clerk to draw a warrant for the same. Motion seconded by Alderman Spragins and carried. Moved by Alderman Baber that the Board of Aldermen approve for payment the sum of $2836,73 to the Wichita General Hospital for charity patients for the month of August and to direct the City Clerk to draw a warrant for the same upon like payment by Wichita County. Motion seconded by Alderman Spell and carried. ORDINANCE NO. 1443 AN ORDINANCE PROVIDING ADDITIONAL APPROPRIATION FOR SUPPORT OF THE CITY GOVERNMENT FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1947. Moved by Alderman Spragins that Ordinance No. 1443 be approved and passed as read on its first reading. Motion seconded by Alderman Baber and carried by the following vote: Yeas: Aldermen Spragins, Spell, Evans and Baber. Nays: None. Moved by Alderman Spragins that the Board of Aldermen designate October 25th as official date to celebrate the completion of Lake Kickapoo Water Supply System. Motion seconded by Alderman Spell and carried. Ray Arnhold, local Architect, appeared before the Board of Aldermen requesting the Council to grant permission to Hardin College to continue the use of certain buildings recently acquired at Sheppard Field, which contained electrical wiring in direct conflict with the present electrical code. The matter was discussed by the Aldermen, whereupon the following motion was had: 415 Moved by Alderman Spell that the City Attorney be authorized and directed to prepare an Ordinance amending that portion of the Electrical Code which prevents the wiring of buildings with Romax wiring and which would permit the use of B. X. metal flexible tubing, and submit same to the Council for further consideration. Motion seconded by Alderman Spragins and carried. Moved by Alderman Spell that the Board of Aldermen grant permission to Hardin College to continue the use of certain frame buildings recently r acquired at Sheppard Field which have been wired with Romax wire, and to further grant permission to said Hardin College to install additional Romax wiring in the same buildings for the purpose of installing electric light switches. Motion seconded by Alderman Spragins and carried. Moved by Alderman Spell that the meeting be adjourned. Motion seconded by Alderman Evans and carried. The Board of Aldermen then adjourned.
