Memorial Auditorium
June 9, 1947
The Board of Aldermen of the City of Wichita Falls, Texas, met in
regular session on the above date at 8:00 o'clock P. M. in the Council Room
in the Memorial Auditorium, with the following members present :

The minutes of the regular meeting held May 12, 1947, were read and
approved as read, likewise the minutes of the called meeting held May 13, 1947,
were read and approved as read.
The application of the Veterans' Car Service for taxicab permit again
came up for consideration. After some discussion, the folloua ng motion was
had:
Moved by Alderman Evans that the application of the Veterans' Car
Service for Certificate of Necessity and Convenience to operate 15 taxicabs
upon the streets of the City be denied, for the reason that there appears to
be no necessity for additional taxicabs.
vote: Motion seconded by Alderman Eastham and carried by the following
Yeas: Aldermen Spragins, Evans, Baber and Eastham.
Nays: Aldermen Spell and Wininger.
Moved by Alderman Spell that the Board of Aldermen approve and
authorize the sale of the Lamar Street U. S. 0. Building to the local Y.M.C.A.
for a consideration of $56,000,00, and authorize Mayor W. B. Hamilton to
execute a deed for the same for and on behalf of the City of Wichita Falls.
Motion seconded by Alderman Evans and carried by the followd ng vote:
Yeas: Aldermen Spragins, Spell, Evans, Baber and Eastham.
Nays: Alderman Wininger.
Mrs Bristol. , President of the Humane Society, appeared before the
Council, stating the City dog pound was in a deplorable condition and that the
service of the dog catcher was entirely unsatisfactory. The City Manager
reported that the City dog catcher had tendered his resignation as of this
date.
Mayor Hamilton stated he thought the Humane Society could work with
the Council, thereby perfecting a more satisfactory plan for the dog pound.

Mrs I. F. Gates, 1410 Travis, appeared before the Council complaining
of an apparent excess water bill due to leaky pipes, whereupon the follovAng
motion was had:
Moved by Alderman Spell that the Board of Aldermen authorize and
direct the Chief Clerk of the Water Office to reduce Mrs I. F. Gates' water and
garbage bill from $72.33 to $10.00 for the period from March lst, 1947,, -to June
2nd, 1947.
Motion seconded by Alderman Evans and carried.
Attorney Luecke appeared before the Council re-uesting passage of two
Ordinances respectively restricting the sale of any alcoholic beverage at retail
to a distance of 100 feet from any public dance hall, and likewise to restrict
the operation of public dance halls to a distance of 100 feet from places where
alcoholic beverages are sold. After some discussion the following motion was
had:

PERSON ENGAGED IN THE BUSINESS OF SELLING BEER, OR ANY KIND OF ALCOHOLIC BEVERAGE,
AT RETAIL, TO SELL, SERVE OR DELIVER, OR TO EMPLOY ANY PERSON EITHER DIRECTLY OR
INDIRECTLY, TO SELL, SERVE OR DELIVER, ANY BERR, OR ALCOHOLIC BEVERAGE, TO ANY
PERSON IN AN AUTOMOBILE, OR OTHER VEHICLE .FOR CONSUMPTION IN SAID AUTOMOBILE, OR
OTHER VEHICLE, WHILE LOCATED WITHIN ONE HUNDRED (100) feet of the BUILDING WHERE
SOLD, PROHIBITING THE SALE, GIFT, POSSESSION FOR THE PURPOSE OF SALE, OR OFFER
FOR SAIE, OF ANY BEER OR ALCOHOLIC BEVERAGE IN ANY PLACE WITHIN THE CORPORATE
LIMITS OF 7HE CITY OF WICHITA FALLS AND WITHIN ONE HUNDRED (100) FEET OF ANY
PUBLIC DANCE HALL, MEASURED BY THE MOST DIRECT AND PRACTICAL PEDESTRIAN ROUTE
FROM THE NEAREST ENTRANCE OF SUCH PUBLIC DANCE HALL TO THE NEAREST ENTRANCE OF
SUCH PLACE WHERE BEER OR ALCOHOLIC BEVERAGE IS, OR MAY BE, SOLD, POSSESSED FOR
THE PURPOSE OF SALE, OFFERED FOR SALE, OR GIVEN AWAY; PROHIBITING THE ISSUANCE OF
ANY LICENSE TO ANY PERSON FOR THE SALE OF BEER OR ALCOHOLIC BEVERAGE AT SUCH PIACE,
AND DECLARING THE SAME, IF ISSUED, TO BE NULL AND VOID; DEFINING THE TERMS "PUBLIC
DANCE HALL," "BEER," "ALCOHOLIC BEVERAGE," AND "PERSON;" PRESCRIBING A PENALTY;
PROVIDING A SAVING CLAUSE; AND DECLARING AN EMERGENCY.
Moved by Alderman Spell that Ordinance No. 1435 be approved and passed
as read on its first reading.
There being no second, Alderman Spell withdrew the motioh.
Judge Tipps reported that the highest offer the County had received
for the Old Nurses" Home on Broad Street was $10,900.00 unfurnished and $11,900.00
furnished, and that the County had rejected all bids.
Moved by Alderman Baber that all bids submitted to the County for the
purchase of the Old Nurses' Home on Broad Street be rejected by the City.
Motion seconded by Alderman Evans and carried.
Moved by AldermanEvans that the City advertise for bids for the sale
of the Old Nurses' Home at 806 Broad Street, said bids to be opened Monday,
June 23, 1947, the City reserving the right to reject any and all bids; and
that the Mayor be authorized to appoint two members of the Council to serve
with County officials in conjunction with the sale of this property.
Motion seconded by Alderman Eastham and carried.
Mayor W. B. Hamilton appointed Aldermen Baber and Eastham as a committee
of two to .serve in the above mentioned capacity.

Moved by Alderman Eastham that the Board of Aldermen grant permission for
temporary removal only, of one parking meter at the Wichita Cycle Company's place
of business at 813 Ohio Street, for a loading and unloading zone only, it being
distinctly understood that such permission is granted subject to an ordinance now
in the process of preparation to govern loading and unloading zones, etc. in the
City, and that the said parking meter may be reinstalled at the discretion of the
Board of Aldermen or the City Manager.
Motion seconded by Alderman Evans and carried.
Moved by Alderman Wininger that the Board of Aldermen grant permission
to the Northsworthy Music Company to construct a front awning 8 ft. 2 inches
above the sidewalk at its place of business at 614-9th St.
Motion seconded by Alderman Spell and carried.
Moved by Alderman Evans that permission be granted to Wichita Poster
Advertising Company to erect two advertising structures, each 25 ft. in length,
at the rear of 1001 Ohio Street, and substitute 30 ft. pressure creosote
treated poles with 12 in. bottom and 171 in. tops in lieu of steel uprights,
providing the same be constructed under the direction of the city engineer.
Motion seconded by Alderman Eastham and carried.
Moved by Alderman Eastham that since there is approximately $340.00
rent due John Murphee accumulated from October 7, 1940, by virtue of a certain
contract entered into by and between the City and W. F. George dated August
282 1940; for use of the Produce Market at 12th & Lamar Street, and since Mr.
Murphee has notified the city to remove its small building on this property,
and since the building is so constructed as not to be advantageous for removal,
the Board of Aldermen hereby authorize the City Manager to execute a bill of
sale to the said John Murphee as 'settlement in full for all past due rent and
further to authorize the MayQr ' W. B. fiamilton, , to execute a bill of
sale for and on behalf of the city of Wic hit a Falls.
Motion seconded by Alderman Spell and carried.
Moved by Alderman Spell that the Board of Aldermen approve a contract
by and between the City and the United Gas Corporation for heating for Sheppard
Field Veterans Housing project (100 units 4.0-4.9 rooms per unit) and authorize
and direct the City Manager, G. D. Fairtrace, to execute the said contract for
and on behalf of the City of Wichita Falls.
Motion seconded by Alderman Evans and carried.
Moved by AldermanEvans that the Board of Aldermen accept and authorize
the execution of a contract by and between the City of Wichita Falls , Texas, and
the National Housing Agency Federal Public Housing Authority Project No. Texas-
V-41860, and further to authorize the City Manager, G. D. Fairtrace, to execute
the said contract for and on behalf of the City of .Wichita Falls, Texas.
Motion seconded by Alderman Eastham and carried.
Moved by Alderman Eastham that the Board of Aldermen grant an extension
to the Gifford Hill Pipe Company and American Pipe and Construction Company from
June 27, 1947, to September 1, 1947, for the completion of the water conduit
being constructed from Lake Kickapoo to the City Water Plant.

Moved by Alderman Spragins that permits be granted for the installation
of cooling systems over awnings to the following named firms at their respective
places of business for the period from May 1, 1947, to October 1, 1947, providing
such installments are made under the direction and supervision of the City Engineer:

Moved by Alderman Spragins that a permit be granted to Barq's Bottling
Company to install a swinging sign between the curb and sidewalk at 1706 - 5th St.
for a period of one year, providing the same is installed under the direction
of the city engineer.

Moved by Alderman Wininger that a permit be ranted to John N. Fidel

construct a basement stairway on the Ninth Street side of the Radio Building
located at 9th & Indiana Street, providing the same is constructed under the direc-

Moved by AldermanWininger that the Board of Aldermen approve and direct
the City Tax Assesor and Collector to accept the city's prorata part of $400.00
for all local tax bodies as delinquent taxes in full covering Block 13, Kemp &
Newby Subdivision, for 1946 and prior years.

Moved by Alderman Spell that the Board of Aldermen approve and ratify
the action of the City Manager ,and City Cleat for payment of the sum of $3730.66
to the Wichita General Hospital for charity patients for the month of April.
Motion seconded by Alderman Eastham and carried.
Moved by Alderman Wininger that the Board of Aldermen approve and
authorize the payment of the sum of $2895.95 to the Wichita General Hospital for
charity patients for the month of May, and direct the City Clerk to draw a warrant
for the same upon like payment of Wichita County.
Motion seconded by Alderman Eastham and carried.
Moved by Alderman Spragins that Mayor W. B. Hamilton be authorized to
appoint two members of the Council to confer with the proper officials of Wichita
County for the purpose of setting up a definite amount each month for payments
by city and county to the General Hospital for charity patients.
Motion seconded by Alderman Spell and carried. ✓
Mayor Hamilton appointed AldermerSpragins and Spell as a committee of
two to serve in the above mentioned capacity.

Moved by Alderman Spell that the Board of Aldermen direct the City Clerk
to transfer the sum of $3832.88 from the City of Wichita Falls Water Main Extension
Fund cash to the City of Wichita Falls Water Improvement No. 2 Fund cash, the
Purpose of this transfer being to simplify the mechanics of accounting.
Motion seconded by Alderman Wininger and carried.
RESOLUTION NO. 5
That %hereas, on Septenber 25, A. D. 1944, the City of Wichita Falls,
acting by its Mayor, W. B. Hamilton, executed a Deed conveying Lots 1 to 13,
inclusive, in Block 76 of the Original Town of Wichita Falls , Texas, to Amis
Brothers Company,
And whereas, by oversight, the Mayor was not officially authorized by
the Board of Aldermen to execute such Deed; notwithstanding the fact that the
Board of Aldermen authorized the City Manager to make the sale-and have the
Deed executed, the Mayor was not officially authorized by the Board of Aldermen
to execute said Deed.
Now, therefore, be it resolved by the Board of Aldermen of the City
of Wichita Falls, Texas, as follows:
That the execution of the above mentioned Deed by Mayor W. B. Hamilton
conveying said property to Amis Brothers Co#eny is hereby ratified and confirmed
for all purposes, and said Deed will have the same force and effect as if the
Board of Aldermen had officially authorized the execution of the same by the
Mayor.

RESOLUTION NO. 6
A RESOLUTION JOINING IN THE REQUEST OF THE HOUSING AUTHORITY OF THE
CITY OF WICHITA FALLS TO THE FEDERAL PUBLIC HOUSING AUTHORITY TO NEGOTIATE THE
SALE OF WESTOVER HILLS PIO JECT TEX-41121, TO THE HOUSING AUTHORITY OF THE CITY
OF WICHITA FALLS FOR THE PURPOSE OF PROVIDING HOUSING FOR THE LOW INCOME GROUP,
WHEREAS, Westover Hills, Project Tex-41121, has been operated under
lease to the Housing Authority of the City of Wichita Falls, Texas, and has been
notified byFederal Public Housing Authority that disposition will have to be made
of the Project; and
Whereas, there is need of this housing to take care of low income
tenant group in the City of Wichita Falls, Texas; and
Whereas, at a meeting of the Commissioners of the Housing Authority
of the pity of Wic hit a Falls, Texas, on December 16, 1946, the said Housing
Authority of the City of Wichita Falls passed a Resolution requesting the F.P.H.A.
to negotiate the sale of Westover Hills, Project Tex-41121 to the said Housing
Authority of the City of Wichita Falls for the purpose of providing housing
for the low income group, at which meeting the Mayor of the City of Wichita Falls,
W. B. Hamilton, the City Manager, George Fairtrace, and Aldermen, C. A. Spragins,
A. Jay Eastham, E. J. Wininger, J. M. Baber and Melvin B. Evans , were present,
and at said time agreed that said request to negotiate a sale of said Project to
the Housing Authority of the City of Wichita Falls, Texas, should be made; and

Whereas, the said Federal Public Housing Authority requires a Resolution
be passed by the Board of Aldermen, requesting that sale of Westover Hills be negotiated
with the Housing Authority of the City of Wichita Falls.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN, That the City of
Wichita Falls does. hereby join with the Housing Authority of the City of Wichita Falls
in its request that the F.P.H.A. negotiate the sale of Westover Hills, Project
Tex-4121, to the Housing Authority of the City of Wichita Falls for the purpose of
providing housing for the low income group.
