Min 03/10/1947 i '361 Wichita Falls, Texas Memorial Auditorium March 10, 1947 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session at 7:00 o'clock P. M. on the above date in the Council Room in the Memorial Auditorium, with the following members present: C. A. Spragins, J. T,�% Fitzpatrick, E. J. Wininger, 0 Aldermen J. M. Baber, A. Jay Eastham, Q Thelbert Martin, Assistant City Attorney Geo. T. Henderson, City Clerk Moved by Alderman Wininger that Alderman J. W. Fitzpatrick be elected Mayor Pro tem for this meeting. Motion seconded by Alderman Ea�tham and carried. The Minutes of the regular meeting held February 10, 1947, were read and approved as read. Likewise the Minutes of the called meetings held February 19 and 26, 1947, respectively, were read and approved as read. Certain representatives of Hardin College presented a petition to the Council requesting a small strip of read between Taft and Milby on Hamp- stead Lane be hard surfaced at any early date; whereupon the following motion was had: Moved by Alderman Spragins that Mayor Pro tem J. W. Fitzpatrick appoint a committee to investigate the feasibility and determine the cost of such paving and to further confer with the paving committee at Hardin College. Motion seconded by Alderman Wininger and carried. Mayor Pro tem J. W. Fitzpatrick appointed Aldermen Wininger, Eastham and Baber as a committee of three to serve on the aforesaid paving committee and report back to the Council. Mr. E. F. Riley came before the Council on behalf of the Kiwanis Club requesting certain properties previously donated to the City of Wichita Falls be deeded back to the said Kiwanis Club; thereupon the .following motion was had: Moved by Alderman Eastham that the City of TATic hita Falls deed back to the Kiwanis Club the following described tracts of land; being all of Block 4 except Lots 3 and 4, all of Block 5 except Lots 1 and 2, and all of Blocks 6, 7, 8, 9, 10, 11 and 12; all being out of Cannon Park Addition, except, how- ever, any part of the above described land which is now being used by the City for street right-of-way purposes or other- ise, and to authorize Mayor W. B. Hamilton to execute a deed for the same for and on behalf of the City; the purpose of this conveyance being to give back all the above described land not now being used by the City since it is deemed that the public interest can best be served by such conveyance. Motion seconded by Alderman Spragins and carried. 362 I' Moved by Alderman Wininger that a permit be granted to Frederick Sehman Chapter No. 21, Disabled American Veterans, to bring the D. S. Dudley Carnival shows to the City of �n1ichita Falls for the ^eriod from March ?lst to April 5th, inclusive, provided the Disabled American Veterans shall nay a regular license fee of $50.00 and that the said carnival shall be conducted according to provisions and regulations as prescribed in the ordinance govern- ing carnivals; further that permission is also hereby granted to the Disabled American Veterans the use of the grounds adjacent to Spudder Ball Park for carnival exhibition pumoses f or the same period for consideration of $100.00. payable in advance. Motion seconded by Alderman Eastham and carried. Moved by Alderman Spragins that the proposed Ordinances No. 1434 and 1435, respectively, granting franchises to the Wichita Valley Railway Company, a corporation, be referred to the City Manager for written report of his approval or disapproval. Motion seconded by Alderman Eastham and carried. Moved by Alderman Eastham that if the City Manager makes a favorable report on the proposed Ordinances No. 1434 and 1435 that public hearing be held on the said proposed Ordinances No. 1434 and 1435 at th next regular meeting to be held in the Council Room at 7:00 P. M. April 1947, and fur- ther that the City Clerk shall cause notice of the said public hearing to be published in the Record News. Motion seconded by Alderman Spragins and carried. Moved by Alderman Eastham that permission be granted to P. P. Lang- ford, Jr., to place a gate across the alley between Tilden and Hayes from Tenth to Avenue D. Motion seconded by Alderman Spragins and carried. Moved by Alderman Spragins that the application of G. D. Crockett for permission to construct a drive-in entrance at the Lowrance-White Co's place of business next to the alley on Sixth Street at the entrance of Sixth and Indiana with a further request for the removal of the parking meter at the location, be referred to the City Manager for approval or disapproval, with full authority to grant such permission, providing he may deem it advis- able,and to execute a contract for the same for and on behalf of the City of Wichita Falls; and further to set such annual rental charge for removal of the said parking meter as may seem proper. Motion seconded by Alderman Eastham and carried. ORDINANCE NO. 1433 AN ORDINANCE AME14DING SECTION TWO OF ORDINANCE NO. 1296, PASSED AM APPROVED ON THE 22ND DAY OF JANUARY, A.D. 1940, ENTITLED "AN ORDINANCE CREATING AND DEFINING PARKING METER ZONES IN THE CITY OF WICHITA FALLS, TEXAS; PROVIDING FOR THE INSTALLATION, OPERATION AND MAINTENANCE OF MECHANICAL DEVICES TO REGU- LATE PARKING IN SAID PARKING METER ZONES; PROVIDING FOR THE COLLECTION OF REGULATORY AND INSPECTION FEES FOR THE USE OF SUCH DEVICES; PROVIDING FOR THE DEPOSIT OF SUCH FEES BY THE CITY TREASURER IN A SPECIAL FUND PROVIDING FOR THE METHOD AND PURPOSES OF DISBURSEMENT OF SAID FUND; MAKING IT UNLAWFUL TO USE THE STREETS OR PORTION OF THE STREETS SO DESIGNATED FOR PARKING EXCEPT THROUGH USE OF PARKING METERS; DEFINING WHAT ACT SHALL BE UNLAWFUL, AND F IXING PENALTIES FCR THE VIOLATION OF THE PROVISIONS OF THIS ORDINANCE, AND REPEALING ALL ORDI- NANCES AND PART OF ORDINANCES IN COYFLICT HEREWITH, AND DECLARING AN EMERGENCY. 363 I Moved by Alderman Baber that Ordinance No. 1433 be approved and passed as read on its first reading. vote: Motion seconded by Alderman Spragins and carried by the following Yeas: Aldermen Spragins, Wininger, Baber and Eastham. Mays: None Moved by Alderman Spragins that F. M. Rugeley, City Engineer, be appointed Acting City Manager with authority to sign checks during the absence of City Manager G. D. Fairtra.ce who has been called out of the City on account of a death in his family. Motion seconded by Alderman and Eastham and carried. Moved by Alderman Baber that the meeting be adjourned.
