Min 01/07/1947 333 Wichita Falls, Texas Memorial Auditorium January 7, 1947 The Board of Aldermen of the City of Wichita Falls, Texas, met in called session at 7:30 o'clock P.M. on the above date in the Council Room in the Memorial Auditorium, with the following members nresent: h'. B. Hamilton, Mayor C. A . S pra gins, 0 J. ViT. Fitzpatrick,, 0 E. J. Wininger, 0 Melvin B. Evans, Aldermen J. M. Baber., A. Jay Ea,stham, G. D. Fairtrace, City Manager Geo. T. Henderson, City Clerk Mayor W. B. Hamilton announced the purpose of this meeting to be further consideration of certain ordinances held over from the previous meeting. ORDINANCE NO. 1421 AN ORDINANCE CLOSING AND ABANDO1 ING THAT PORTION OF AVENUE N BErT,TEEN POLK AND TAYLOR STREETS, AND CLOSING AND ABANDONING THE ALLEY IN BLOCK 106A OF HIGHLAND ADDITION TO THE CITY OF WICHITA FALLS, TEXAS, BETV.TEEN POLK AND TAYLOR STREETS IN THE CITY OF WICHITA F ALIS, TEXAS, AND DECLARING AN EMERGENCY. Moved by Alderman Spragins that Ordinance No. 11t21 be approved and passed as read on its second reading. Motion seconded by Alderman Baber and carried by the following vote: Yeas: Aldermen Spragins, Fitzpatrick, Wininger, Evans, Bather and Eastham. Nays : None. Moved by Alderman Fitzpatrick that the rules requiring ordinances to be read on three separate days be and is hereby suspended and that Ordi- nance No. 1421 be passed on its third and final reading and declaring an emergency. vote: Motion seconded by Alderman Wininger and carried by the following Yeas: Aldermen Spragins, Fitzpatrick, Wininger, Evans, Baber and Eastham. Nays: None. 334 Moved by Alderman Wininger that the Board of Aldermen approve and authorize Mayor W. B. Hamilton to execute for and on behalf of the City of Wichita Falls a Quit Claim Deed to C. W. WAlker for all of Avenue N lying between Polk and. Taylor. Streets and all of the alley extending across Block 106A, Highland Addition, from Polk Street to Taylor Street. The purpose of this conveyance being for title perfection only. Motion seconded by Alderman Fitzpatrick and carried. ORDINANCE NO. 1422 AN ORDINANCE CLOSING AND ABANDONITG THE ALLEY IN BLOCK 30A, HIGH- IAND ADDITION, BETNTEN AVENUE T AND AVII!'UE U IN THE CITY OF 'v-,;TICHITA FALLS, TEXAS, RESERVING ALL NECESSARY EASEMENTS FOR UTILITIES, AND PROVIDING THAT THE CITY SHALL UNDER NO CIRCIJh,F)TANCES BE LIABLE FOR DAMAGES IN EVENT BUILD- INGS ARE CONSTRUCTED OVER EXISTING SET4ER LINE BY VIRTUE OF THE MAINTENMICE AND OPERATION OF THE SFP ER. ORDINANC E NO. 1423 AN, ORDINANCE CLOSING AND ABANDONING THAT PORTION OF THE ALIEY LYING BETWEEN LOTS 1, 2, ? AND 4, BLOCK 3, AND LOT 24, BLOCK 4, OF KEMP AvTD JACKSON SUBDIVISION OF BLOCK 11, BELLEWE ADDITION TO THE CITY OF VTICHITA FALI-S, TEXAS, RESERVING ALL NECESSARY EASEMENTS FOR UTILITIES PROVIDING TEAT THE CITY SHALL, UNDER NO CIRCUMSTANCES, BE LIABLE FOR DAMAGES IN THE EVENT BUILDINGS ARE CONSTRUCTED OVER EXISTING SE'TR. LINE BY VIRTUE OF THE MAINTENANCE AND OPERATION OF THE SE"'ER, AND DECLARING AN EMERGENCY. 33K Moved. by Alderman Eastham that Ordinance No. 1423 be approved and passed as read on its second reading. Moved by Alderman Evans that the rules requiring ordinance to be read on three separate days be and is hereby suspended and that Ordinance No. 1423 be approved and passed as read on its third and final reading and declaring an emergency. Motion seconded by Alderman Baber and carried by the following vote: Yeas: Aldermen Spragins, Fitzpatrick, Wininger, Evans, Baber and Easth am. Nays: None. OFDINANCE NO. 1424 AND ORDINAPU E PROHIBITING PARKING OF TRUCK AND MOTOR VEHICLES USED IN THE TRANSPORTATION OF GASOLINE OF.. LIQUIFIED PETROLEUM GASES OF ALL KINDS FROM THE STREETS, ALLEYS OR OTHER PUBLIC PLACES OF THE CITY OF WICHITA FALLS, TEXAS, EXCEPT Tnlf-IEN SUCH TRUCKS AND MOTOR VEHICLES ARE ACTUALLY ENGAGED IN UNLOADING GA`',OLINE OR LIQUIFIED PETROLEUM GASES AT FILLING STATION AND OTHER PLACES WHERE SUCH GASOLINE AND LIQUIFIED PETROLEUM GASES ARE SOID AT RETAIL OR AT PLACES WHERE SAME ARE BEING LAWFULLY USED FOR DOMESTIC AND COMMERCIAL PURPOSES; PRESCRIBING A PENALTY, AND DECLARING AN EMERGENCY.
