Memorial Auditorium
May 13, 1946
The Board of Aldermen of the City of Wichita Falls, Texas, met in
regular session at 8:00 o'clock P. M. on the above date in the Council Room
in the Memorial Auditorium, with the following members present:

Moved by Alderman Baber that Alderman Spragins be elected Mayor Pro
tem for this meeting.
Motion seconded by Alderman Wininger and carried.
The Minutes of the regular meeting held April 8, 1946, were read and
approved as read. Likewise the Minutes of the called meetings held April 24,
26, and May 6, 1946, respectively, were read and approved as read.
Mrs. C. B. Lonsw4y appeared before the Council requesting permission
to construct and erect a building to be occupied as a cafe on certain city owned
property located at 2006 ,Fifth Street, being adjacent to the highway.
The request was discussed by the Council, whereupon Mayor Pro tern
C. A. Spragins appointed Aldermen Evans, Eastham and Wininger as a committee
of three to-investigate the proposition and report back to the Council.
Moved by Alderman Wininger that the Board of Aldermen approve and
authorize payment to Kindel Paulk, Chairman of Wichita County Bond Committee,
the sum of $250 being the City's part of necessary preliminary expense of the
proposed $800,000 County bond issue for the purpose of constructing a new
hospital adjacent to the present City-County hospital, and further to order
the City Clerk to draw a warrant for the same, upon like payment by Wichita County.
Motion seconded by Alderman Evans and carried.
Moved by Alderman Evans that the Board of Aldermen authorize the
issuance of a permit to Early Van Deventer to construct and erect a business
building to be constructed of stone, brick or other mason material at 901 Austin
Street, when and only at such time as the said Early Van Deventer furnishes the
City Engineer with a letter signed by Mrs. Camp stating she offers no objection
to the erection of the proposed building.

Jack Austin, Marion Barrett, Max Lester and Henry Anderson, representatives
of the Junior Chamber of Commerce, presented a written request to the City Council
asking that traffic lanes be marked on Indiana, Ohio and Lamar Streets, from
12th to 6th Streets, inclusive; also on 7th, 8th, 9th, loth, llth and 12th from
Ohio to Lamar, inclusive.
The letter was turned over to the City Manager for further consideration.
ORDINANCE NO. 1412
AN ORDINANCE CLOSING AND ABANDONING AN ALLEY LOCATED BETWEEN LOT 7,
BLOCK 9, FLORAL HEIGHTS ADDITION, AND LOT NO. 1, BACK 12, SUNSET HEIGHTS ADDI-
TION TO THE CITY OF W ICHITA FALLS, TEXAS; SAID ALLEY TO BE CLOSED AND ABANDONED
RUNNING FROM ROBERTS AVENUE BETWEEN THE ABOVE LOTS TO THE ALLEY BETWEEN ROBERTS
AVENUE AND STH STREET.
Moved by Alderman Wininger that Ordinance No. 1412 be approved as read
and passed on its first reading.
Motion seconded by Alderman Baber and carried by the following vote:
Yeas: Aldermen Fitzpatrick, Wininger, Evans, Baber and Eastham.
Nays: None.
Moved by Alderman Baber that the Board of Aldermen authorize payment
to the Wichita General Hospital the sum of $2,389.50 for charity patients for
the month of April, upon like payment by Wichita County.
Motion seconded by Alderman Eastham and carried.
Moved by Alderman Fitzpatrick that the Board of Aldermen authorize and
order the City Clerk to transfer the sum of $50,000 from the City of Wichita
Falls Water Works Revenue Water Improvement No. 5 time deposit account in the
First National Bank to the City of Wichita Falls Water Works Revenue Water
Improvement No. 5 checking account, and a like amount from the City of Wichita
Falls Water Works Revenue Water Improvement No. 5 time deposit account in the
City National Bank to the City of Wichita Falls Water Works Revenue Water
Improvement No. 5 checking account.
Motion seconded by Alderman Wininger and carried.
Moved by Alderman Eastham that the Board of Aldermen authorize the
Issuance of a permit to C. H. Parker for the purpose of installing a four unit
air conditioner at 500-506 Indiana, providing the same shall be installed under
the supervision of the City Lngineer.
Motion seconded by Alderman Fitzpatrick and carried.
RESOLUTION
WHEREAS, the State Highway Department of the State of Texas is desirous
of constructing Highway No. FM 171 through the City of Wichita Falls over
Jefferson Street; and,
WHEREAS, the State Highway Department is desirous of receiving Federal
Aid f or the improvement of said highway; and,

WHEREAS, the Public Roads Administration of the Federal Works Agency
of the United States of America will not participate in the construction of said
highway until and unless the City of Wichita Falls will agree to refrain from
permitting encroachments upon the right-of-way of said above mentioned streets,
and until and unless the City of Wichita Falls will agree to refrain from
passing ordinances or laws fixing a speed limit of under twenty miles per hour
on said above mentioned streets, and until and unless the City of Wichita Falls
will agree to refrain from erecting signs, semaphores, and signals that will
give preference to local routes or that will hinder or delay traffic on said
above mentioned streets.
THEREFORE, BE IT RESOLVED by the City Council of the City of Wichita
Falls that, for and in consideration of the State Highway Department of the
State of Texas and the Public Roads Administration of the Federal Works Agency
of the United States of America constructing said Highway No. F M 171 through
the City of Wichita Falls over Jefferson Street, it hereby agrees with the State
Highway Department of the State of Texas and the Public Roads Administration of
the Federal Works Agency of the United States of America that it will not, in
the future, permit encroachment on the right-of-way of said above mentioned
streets; nor will it pass an ordinance or laws fixing a speed limit on the above
mentioned streets of under twenty miles per hour, nor will it allow the erection
of signs, semaphores, and signals that will give preference to local routes
which intersect with said above mentioned streets nor that will slog up, hinder,
or delay traffic on said above mentioned streets; nor will it repeal or amend
any of the provisions of this resolution without the consent of the State
Highway Commission.
Moved by Alderman Evans that the above and foregoing resolution be
adopted and passed as read.
vote: Motion seconded by Alderman Eastham and carried by the following
Yeas: Aldermen Fitzpatrick, Wininger, Evans, Baber and Eastham.
Nays: None.
Moved by Alderman Fitzpatrick that the Board of Aldermen authorize
the City Manager to purchase of J. N. Sherrill, Agent for the Kempner Estate, ,
262.02 acres of land carrying only 1/2 the mineral rights, for a consideration
of $100 per acre; said land being necessary for use in connection with water
conduit, water storage and equalizing reservoir from the new water reservoir in
Archer County; and further to order the City Clerk to draw a warrant for the
same.
Motion seconded by Alderman Eastham and carried.
Moved by Alderman Wininger that the Board of Aldermen authorize the
City Manager to purchase of Gordon Travis 5 acres in feel simple title for a
consideration of $100 per acre; said land being necessary for use in connection
with water conduit, etc, from the new water reservoir in Archer County; and
further to order the City Clerk to draw a warrant for the same.
Motion seconded by Alderman Fitzpatrick and carried.

Moved by Alderman Evans that the special investigator's office in
connection with the City Attorney's payroll, be abandoned effective May 152
1946.
Motion seconded by Alderman Eastham and carried; Alderman Baber
voting no.
Moved by Alderman Wininger that the meeting be adjourned.
Motion seconded by Alderman Fitzpatrick and carried.
The Board of Aldermen then adjourned.
