Min 10/08/1945 220 Wichita Falls, Texas Memorial Auditorium October 8, 1945 The Board of Aldermen of the City of I' ichita Falls, Texas, met in regular session at 8:00 o'clock P. 'IA. on the above date in the Council Room in the Memorial Auditorium, with the following members present: C. A. Spragins, E. J. Wininger, W. Ralph Hyer, Aldermen 0. G. Stephens, G. D. Fairtrace, City Manager T. A. Hicks, City Attorney Geo. T. Henderson, City Clerk Moved by Alderman Wininger that W. Ralph Hyer be elected Mayor Pro- tem for this meeting. Motion seconded by Alderman Stephens and carried. Mayor Protem Hyer announced a quorum present and that the Council would. proceed with its regular order of business. The Minutes of the regular meeting held September 10, 1945, were read and approved as read. Members of the Students Council of Hardin Junior College appeared be- fore the City Council for the purpose of requesting the City to pave a certain portion of Taft Street and Hampstead Lane, whereupon the Council advised the Committee that the City would take the matter under advisement and give the same careful consideration when and at such time as the necessary funds and labor are available. A petition signed by various citizens residing on the North Side was presented to the Council protesting the recent change in bus routing, also a group of citizens was present to likewise protest the change. Mr. James, local manager of the traction company, was present and the matter was thoroughly discussed by all present, and by common consent of the Council Mayor Protem Hyer requested the traction company to temporarily resume the old route with the hope in view of eventually arranging a route satisfactory to all concerned. Moved by Alderman Stephens that the Board of Aldermen authorize the issuance of a permit to the Central Church of Nazarene and the First Church of the Nazarene for the purpose of soliciting funds for their respective churches. Motion seconded by Alderman Wininger and carried. Moved by Alderman Spragins that the Board of Aldermen authorize and order payment of the sum of 41,000 to the members of the City Tax Equalization Board for their services rendered for the fiscal year ending September 30, 1945, the same to be equally divided as follows: Rosco Staton $333.33 Alan T. Bryce 333.33 T. E. Hill 333.34 Motion seconded by Alderman Stephens and carried. 221 I II f I! Moved by Alderman Spragins that the Board of Aldermen approve, authorize and order payment to V. A. HUff the sum of $$613.78, ,being amount due the said V. A. Huff as of April 1, 1945, by virtue of a certain water main con- tract entered into by and between Kemp, Welch & Richardson and the City of Wichita Falls dated April 6, 1926, covering Kemp Fair Park Addition, subsequent- ly assigned to V. A. Huff. Motion seconded by Alderman Wininger and carried. ORDINANCE NO. 1403 AN ORDINANCE CLOSING AND ABANDONING THAT PORTION OF BARWISE STREET IN WICHITA FALLS, TEXAS, WHICH LIES EAST OF VIRGINIA STREET AND WHICH ESTENDS UP TO THE RIGHT OF WAY AND/OR PROPERTY OF THE MISSOURI-KANSAS-TEXAS RAILROAD COM- PANY AND Z HICH IS MORE PARTICULARLY HEREINAFTER DESCRIBED. Moved by Alderman Stephens that Ordinance No. 1403 be approved and passed as read on its second reading. Motion seconded by Alderman Wininger and carried by the following vote: Yeas: Mayor Protem Hyer, Aldermen Spragins, Wininger and Stephens. Nays : None. The application of A & A Taxi for a permit to operate 6 additional taxicabs and likewise the application of Hamp's Taxi for a permit to operate 3 additional taxicabs were considered by the Council, whereupon the following motion was had: Moved by Alderman Stephens that the Aldermen set Friday, 10:00 A.M. , October 122 1945, as the date for a called session of the Council at which time a public hearing will be held on the applications of the A&A Taxi and Hamp's Taxi for permits to operate additional taxicabs will come up for proper consideration. _`_otion seconded by Alderman Spragins and carried. Moved by Alderman Wininger that the Board of Aldermen authorize pay- ment to L. E. Satterwhite in the amount of $69.51 for alleged damages to his automobile and son by the City of Wichita Falls, and further to order the City Clerk to draw a warrant for the same when and at such time as the said L. E. Satterwhite executes a release to the City of Wichita Falls from further liability to said city. Motion seconded by Alderman Stephens and carried. Moved by Alderman Stephens that the Board of Aldermen authorize 'Mayor Protem Ralph Hyer to execute for and on behalf of the City of Vichita Falls a lease agreement with the Mid-Continent Supply Company for that portion of Indiana Avenue lying between Lots 2 to 8, inclusive, Block 76, and Lots 22 to 28, inclusive, Block 77, Original Townsite, less certain trackage right of way and unloading dock space heretofore granted to the Fort Worth & Denver Railway Company, said tern of lease to be for a period of one year beginning October 15, 1945, and ending October 14, 1946, being occupied as a pipe and material yard and not otherwise, for a consideration of v$150 per annum, payable in advance. Ralph Hyer to execute a lease agreement for and on behalf of the City of Wichita Falls and Hicks Oil Company for a lease on the Vlest 40 f of that portion of Colorado Street lying between the South line of Waco Street and the North line of East Scott Street, for a term of one year beginning October 15, 1945, and ending October 14, 1946, being occupied as a gasoline tank storage yard and not otherwise, for a consideration of $100 per annum payable in advance. ORDINANCE NO. 1404 AN ORDINANCE CLOSING AND ABANDONING AN ALLEY LOCATED BETTZEN LOTS FIVE (5), SIX (6) , SEVEN (7), AND EIGHT (8) OF THE LILLY ADDITION TO THE CITY OF VJICHITA FALLS, TEXAS, AND LOT ELEVEN (11), BLOCK FIVE (5) OF THE FLORAL HEIGHTS ADDITION TO THE CITY OF 1"dICHITA FALLS, TEXAS, WHICH ALLEY IS TO BE CLOSED AND ABANDONED UP TO THE EASTERLY BOUNDARY OF LOT ELEVEN (11) , BLOCK FIVE (5) , FLORAL HEIGHTS ADDITION TO THE CITY OF WICHITA FALLS, TEXAS. Moved by Alderman Spragins that Ordinance No. 1404 be approved and passed as read on its first reading. Motion seconded by Alderman Stephens and carried by the following vote; Yeas: Mayor Protem Hyer, Aldermen Spragins, Wininger and Stephens. Nays: None. Moved by Alderman Spragins that the Board of Aldermen approve and authorize a contribution to the `Wichita Falls Junior Chamber of Commerce in the amount of 30 for the purpose of decorating the Central Fire Station during the Victory Day celebration to be held October 27th, 28th and 29th, and order the City Clerk to draw a warrant for the same. lotion seconded by Alderman Wininger and carried. 3RDINANCE NO. 1405 AN ORDINANCE MAKING APPROPRIATION FOR SUPPORT OF THE CITY GOVERN?.ENT FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1945, AND ENDING SEPTEMBER 30, 1946. Moved by Alderman Spragins that Ordinance No. 1405 be approved and passed on its first reading. lotion seconded by Alderman Stephens and carried by the following vote: Yeas: Mayor Protem Hyer, Aldermen Spragins, Wininger and Stephens. Moved by Alderman Spragins that a called session be held Friday at 10:00 A.M., October 12, 1945, to be set as the date to conduct a public hearing on the proposed Ordinance No. 1405, being annual appropriation ordinance for the support of the city government for the fiscal year ending September 30, 1946. Motion seconded by Alderman Stephens and carried. 223 1 ORDINANCE NO. 1406 AN ORDINANCE LEVYING, ASSESSING AND FIXING THE TAX RATE FOR THE USE AND SUPPORT OF THE MUNICIPAL GOVERNMENT OF THE CITY OF WICHITA FALLS, TEXAS, I AND PROVIDING FOR THE INTEREST AND SINKDG FUND FOR THE FISCAL YEAR 1945-46, AND APPORTIONING EACH LEVY FOR THE SPECIFIC PURPOSE, AND PROVIDING FOR COLLECTION OF ALL ANNUAL OCCUPATION TAXES PROVIDED BY STATE LAIN. Moved by Alderman Stephens that Ordinance No. 1406 be approved and passed as read on its first reading. Motion seconded by Alderman Wininger and carried by the following vote: Yeas: mayor Protem Hyer, Aldermen Spragins, Wininger and Stephens. Nays: None. Moved by Alderman Spragins that the Board of Aldermen accept the bid and award to J. B. Allred & Company contract to audit the records of the City of Wichita Falls, Texas, for the fiscal year ending September 30, 1945, for a con— sideration of $1,575, inclusive of the Wichita General Hospital, the amount to be charged for the city audit being $1,275 and the sum of $300 for the General Hospital audit; the bid of said J. B. Allred & Company being the lowest and best bid. Motion seconded by Alderman Stephens and carried. Moved by Alderman Stephens that the meeting be adjourned.
