The Board of Aldermen of the City of Wichita Falls, Texas, met in
regular session at 7:00 o'clock P. M. ofi the above date in the Council Room
in the Memorial Auditorium with the following members present:

Moved by Alderman Spragins that Alderman Wininger be elected Mayor
Pro tem for this meeting.
Motion seconded by Alderman Stephens and carried.
The Minutes of the regular session held April 9th and the called
sessions held April 17th and May lst were read and approved as read.
ORDINANCE NO. 1400
AN ORDINANCE AMENDING SECTION 2 OF ORDINANCE NO. 1398 PASSED AND
APPROVED ON THE 9TH DAY OF APRIL, A. D. 1945, AND FIXING PENALTIES FOR THE
VIOLATION OF THE PROVISIONS OF THIS ORDINANCE AND REPEALING ALL ORDINANCES
AND PARTS OF ORDINANCES IN CONFLICT HEREWITH AND DECLARING AN EMERGENCY.
Moved by Alderman Stephens that Ordinance No. 1400 be approved and
passed as read on its second reading.
Motion seconded by Alderman Spragins and carried by the following
vote:
Yeas: Mayor Pro tem Wininger, Aldermen Spragins, Baber and Stephens.
Nays: None.
Moved by Alderman Baber that the Board of Aldermen approve and
authorize payment to the Wichita General Hospital the sum of $807.94 for
charity patients for the month of April, upon like payment by Wichita County,
and direct the City Clerk to draw a warrant for the same.

ORDINANCE NO. 1401
AN ORDINANCE AMENDING SECTION 6-1503 OF THE CODIFICATION OF ORDINANCES
FOR THE CITY OF WICHITA FALLS, TEXAS, 1941, ADOPTED BY ORDINANCE NO. 1315,
PASSED AND APPROVED ON THE 6TH DAY OF JANUARY, A. D. 1941, FIXING THE ANNUAL
LICENSE FEE FOR ALL OPERATORS OF AUTOMOBILES, MOTCR VEHICLES, OR SERVICE CARS
OPERATED FOR HIRE IN THE CITY OF WICHITA FALLS, PROVIDING A FORFEITURE OF
LICENSE FOR VIOLATION THEREOF AND DECLARING AN EMERGENCY.

Moved by Alderman Baber that the Board of Aldermen approve and
authorize for payment the bill of James W. Harvey in the amount of $50.00 for
legal services in connection with the purchase of the Dugan land for the water
reservoir in Archer County, and direct the City Clerk to draw a warrant for the
same out of the Water Improvement No. 5 Fund Cash.
Motion seconded by Alderman Spragins and carried.
Moved by Alderman Stephens that the Board of Aldermen approve and
authorize payment of the bill of the Guarantee Abstract Company in the amount
of $25.25 for abstract work in connection with the purchase of the Dugan land
in Archer County for the new lake, and direct the City Clerk to draw a warrant
for the same, payable out of the Water Improvement No. 5 Fund Cash.
Motion seconded by Alderman Baber and carried.
Moved by Alderman Spragins that the Board of Aldermen approve and
authorize for payment the bill of Guy M. Baggett,, County Clerk, in the amount
of $9.75, the same being court costs in connection with the purchase of land
from the J. H. Dugan Estate for the new lake in Archer County, and direct the
City Clerk to draw a warrant for the same, payable out of the Water Improvement
No. 5 Fund Cash.

Moved by Alderman Stephens that the City Attorney be instructed and
ordered to carry the case of L. B. Bruner, et al, vs the City of Wichita Falls
to the Court of Appeals and, if necessary, to the Supreme Court and prosecute
same to the final adjudication.
Motion seconded by Alderman Baber and carried.
By common consent of the Council the City Manager was instructed to
communicate with the proper authorities or persons in Archer County for the
purpose of perfecting agreement for the necessary change of roadways to the new
lake in Archer County.
ORDINANCE NO. 1402
AN ORDINANCE AMENDING SECTION 7 AND SECTION 11 OF ORDINANCE NO. 1179,
PASSED AND APPROVED NOVEMBER 19, 1934, BEING AN ORDINANCE AGREEMENT BETWEEN
SOUTH1h1STERN BELL TELEPHONE COMPANY AND CITY OF WICHITA FALLS; SAID SECTIONS
ALSO BEING KNOWN AS SECTION 7-907 AND SECTION 7-910 OF THE CODIFICATION OF
ORDINANCES OF THE CITY OF VTICHITA FALLS, TEXAS, 1941, ADOPTED BY ORDINANCE NO.
1315 ON JANUARY 6, 1941, SO AS TO PROVIDE THAT SAID SOUTHINESTERN BELL TELEPHONE
COMPANY SHALL, PAY TO THE CITY A SUM EQUAL TO TWO PER CENT OF THE GROSS RECEIPTS
FOR THE PRECEDING YEAR RECEIVED BY THE SAID COUPANY FROM LOCAL EXCHANGE TELE-
PHONE SERVICE WITHIN THE CORPORATE LIMITS OF TIE.. CITY; SUCH PALIENTS TO BE MADE
AS OF MAY 11 1945, AND UPON THE 15TH DAY OF MARCH FOR EACH AND EVERY YEAR THERE-
AFTER; AND EXTENDING SAID ORDINANCE 1179 FOR ADDITIONAL TEN YEAR PERIOD, AND
ALSO REPEALING ORDINANCE NO. 1399 PASSED AND APPROVED APRIL 17, 1945, AND

Moved by Alderman Spragins that the Board of Aldermen approve and
authorize the sale of Lot 6, Block 7, Kemp Addition, to Ike Hayes for a con—
sideration of $75.00, and further to authorize Mayor W. B. Hamilton to execute
for and on behalf of the City of Wichita Falls a Quit Claim Deed to the said
Ike Hayes.
Motion seconded by Alderman Baber and carried.
Moved by Alderman Stephens that the Board of Aldermen approve as read
the proposed contract by and between the City of Wichita Falls Wichita County
and the Managers of the Wichita General Hospital Board affecting the management
of the said Wichita General Hospital and directing that the same shall expire
one year from date of the execution of the said contract, and further to
authorize mayor W. B. Hamilton to execute the same for and on behalf of the
City of Wichita Falls.

Moved by Alderman Baber that the Board of Aldermen approve and
authorize payment to Glenn Haynes, District Clerk, the sum of $2,650.00 to
satisfy a judgment allowed in the 30th District Court, being No. 39528—A,
J. R. Curtiss, et al, vs. Safeway Taxicab & Baggage Co., and further to direct
the City Clerk to draw a warrant out of the Taxicab Fund cash in payment of
the same.

The Board of Aldermen of the City of Wichita Falls, Texas, met in
called session at 10:00 o'clock A. 11. on the above date in the Council Room
in the memorial Auditorium, with the following members present:

Mayor W. B. Hamilton announced the purpose of this meeting to be the
consideration of various items of importance to the City.
The application of John C. Armstrong to solicit funds for the benefit
of J. B. Littleton and wife for the purpose of helping defray hospital expenses
of their ten year old son who received serious injuries when their house
recently burned, and to raise funds to help rebuild their house, was by common
consent of the Council, referred to Mrs. Loyce Dotson, City and County Welfare
Worker, for investigation.
Moved by Alderman Hyer that "layor V . B. Hamilton be authorized to
appoint a committee to confer with officials of Hardin Junior College for the
purpose of procuring the necessary land, etc, for the proposed new airport to
be located near the Junior College.
Motion seconded by Alderman Fitzpatrick and carried.
Mayor Hamilton appointed Aldermen Spragins and Hyer and City Manager
G. D. Fairtrace to serve in the above mentioned capacity.

Moved by Alderman Spragins that the Board of Aldermen ratify agree-
ment of Mayor W. B. Hamilton, acting for and on behalf of the City of Wichita
Falls to pay the sum of $12,000.00 to Archer County for inundation of roads by
the construction of the new water reservoir in Archer County; the purpose of
this authorization being to forestall a threatened litigation which apparently
would cost considerably in excess of the compromise agreement above stated,
and further to direct and order the City Clerk to draw a warrant payable out
of the 4ater Improvement No. 5 Fund cash in payment of the same.
Motion seconded by Alderman Hyer and carried.
Moved by Alderman Wininger that the Board of Aldermen approve and
authorize the City Manager to purchase 333.18 acres of land for a consideration
of $15.00 per acre, aggregating the sum of $4,997.70, and one triangular tract
of land containing 9a acres for a consideration of 380.00, also to purchase a
right-of-way easement for roadway purposes containing 6.8 acres for a consid-
eration of $500.00, also 4 pieces of land for a conduit right-of-way for a
consideration of 500.00, all of the above to be acquired of the 17ilson Estate
and to be used for the new water reservoir in archer County, aggregating the
total sum of $6,337.70, and further to direct and order the City Clerk to draw
a warrant payable out of the Water Improvement No. 5 Fund cash in payment of
same,

Moved by Alderman Baber that the Board of Aldermen authorize Mayor
I'l. B. Hamilton to execute for and on behalf of the City of Wichita Falls a
right-of-w,ay easement to -Archer County for the purpose of locating and con-
structing public roadway on certain lands now owned by the City of Wichita
Falls located near the new water reservoir in Archer County, the exact location
and field notes for the said right-of-way to be furnished by Archer County
which shall be acceptable to the City of Wichita Falls.

Moved by Alderman Hyer that the Board of Aldermen authorize Mayor
W. B. Hamilton to execute for and on behalf of the City of Wichita Falls a Quit
Claim Deed to Joe Pistocco of Wichita Falls, Texas, covering all of Lot 10,
Block 172, Original, the purpose of this Deed being for title perfection only.

RESOLUTION
WHEREAS, the City National bank in Z'ichita Falls, Texas, Depository
for the City of �yichita Falls, Texas, has deposited in trust with the First
National Bank in Dallas the sum of $600,000.00 U. S. 7/8% Certificate of
Indebtedness, Series No. C-1945 Bonds as security for the account of the City
of Wichita Falls, Texas, as evidenced by First National Bank in Dallas Certi-
ficate No. 28115 dated July 24, 1944, and
WHEREAS, the above described bonds being Nos. 739-744 at $100�000.00
each are maturing June 1, 1945, and
WHEREAS, the City National Bank in Wichita Falls has requested a
release of the above described bonds maturing June 1, 1945, and
WHEREAS, the City National Bank in Wichita Falls agrees to substitute
in lieu thereof $600,000.00 of 0.90% U. S. Treasury Notes Series D-1946 maturing
July 1, 1946,

THAT the City Treasurer and the City Clerk be and are hereby authorized

Treasury Notes Series D-1946 due July 1, 1946, and surrender 6 U. S. 7/8% Certi-
ficate of Indebtedness Series C-1945 Bonds at $100,000.00 each maturing June 1,
1945, as evidenced by First National Bank in Dallas Certificate No. 28115 dated
July 24, 1944, now on deposit in First National Bank in Dallas.
