Hamilton under date of December 13, 1944, from the United Contracting Company of Wichita Falls, Texas, requesting permission to reform their bid submitted on the City of Wichita Falls Contract No. 2 in the amount of $50,000.000 thereby raising their bid from $86,698.50 to $136,698.50, and further requested the Council to avow them the privilege of reforming their bid or disregard the original bid entirely, the original letter being filed in the office of the City Clerk, a copy being attached hereto and made a part of the Minutes hereof. Moved by Alderman Hyer that the board of Aldermen allow the United Contracting Company the privilege of reforming their original bid on Contract No. 2 in the amount of $50,000.009 less an agreed reduction of $2,000.00, auto- maticelly increasing the original bid on same of $48,000,00. Motion seconded by Alderman Wininger and carried. The City Manager, G. D. Fair.trace, recommended to the Council that the Water Improvement Contract No. 2 be awarded to the United Contracting Comrany as outlined in the above and foregoing motion. Moved by Alderman Fitzpatrick that the Board of Aldermen accept the recommendation of the uity Manager that the eater Improvement Contract No. 2 be awarded to the lowest and best bidder, the United Contracting uompany, of Wichita Falls, Texas, for a consideration of $134,698.50. Moved by Alderman Baber that the Board of Aldermen authorize the uity Manager to proceed with the purchase or the necessary land for the new lake in Archer uouaty, and the confirmation of the deal with the Turbeville Estate for consideration of $40.00 per acre, fee simple title, subject to the approval of title by the City ,rttorney, and further to authorize and order the City Clerk to draw a warrant for the same upon like conditions. D. Fairtrace recommended to the Council that the proposed changes be granted. Moved by Alderman -jpragins that the Wichita Transit Corporation be granted permission to re-route certain bus lines,in the City of Wichita Falls, as shown by a`plat and letter submitted by the said Wichita Falls Transit Corporation, said plat and letter being attached hereto and made -a part of the Minutes hereof. Moved by Alderman Wininger that the City Attorney be authorized and instructed to proceed to file suit against the Seaboard Oil & Gas Company and Gray Bros. , operating the Star Drilling Uompany,' for the purpose of restraining the Seaboard Oil & Gas Company and the Star Drilling company from permitting salt water to flow into Holliday Creek which eventually drains into Lake Wichita, thereby polluting the drinking water of residents of the City of Wichita Falls. Motion seconded by Alderman Baber and carried. Moved by Alderman Spragins that the City Attorney be authorized and instructed to appeal the case of L. B. Bruner et al. vs. the City of Wichita Falls, Texas, and prosecute to a conclusion in the higher courts. A petition was presented to the Council by Mrs. John Wilks requesting the 11onroe Street bus to continue south to the Wichita Valley Railway Company crossing on Taft Street. Mayor Hamilton assured Mrs. Wilkes that the request would be given due and careful consideration. The City Clerk read a communication to the Council from L. V. Aber- nathy, Attorney for the plaintiff in a suit styled R. L. Redin vs Uneeda Taxicab Company involving a suit for alleged damages in the amount of $197.84. The letter was ordered filed in the office of the City Clerk. Moved by Alderman Spragins that the Board of Aldermen authorize pay- ment to G. E. Kadane & Sons the sum of $500.00 for the release of an oil and gas lease on the Hunt land recently acquired for the new lake site in Archer County, and further to order the City Clerk to draw a warrant in payment of the same. Motion seconded by Alderman Stephens and carried. Moved by Alderman Stephens that the Board of Aldermen authorize and order the City Clerk to draw a warrant payable to W. R. Brown to refund the sum of $1.00 on account of a duplicate payment of a gas inspection fee. Motion seconded by Alderman Wininger and carried. 161 Moved by Alderman Wininger that the Board of Aldermen authorize and order the City Clerk to draw a warrant payable to the City National Bank in the sum of $1,600.00 in accordance with provisions of a resolution passed October 1 91 1944, establishing the fees to be paid to the said bank as trustee for the $3,000,000.00 water improvement bond issue. Motion seconded by Alderman Baber and carried. Moved by Alderman Baber that the Board of Aldermen authorie payment to the City National Bank the sum of 428.48 for expenses to Austin in connection with the certification of the 3,000,000.00 water improvement bond issue, and order the City Clerk to draw a warrant in payment of the same, payable out of the Water Improvement Fund. Motion seconded by Alderman Spragins and carried. Moved by Alderman Wininger that the Board of Aldermen authorize the purchase of 50.7 acres of land from L. T. Burns necessary for the new lake site in Archer County, at a consideration of $40.00 per acre, fee simple title, aggregating the sum of $2,028.00, and further to authorize and order the City Clerk to draw a warrant for the same. Notion seconded by Alderman Stephens and carried. Moved by Alderman Baber that the City Attorney be authorized and ordered to appeal the suit of L. B. Bruner et al vs the City of 'Kichita Falls and prosecute the same to final adjudication in the higher courts. Motion seconded by Alderman Spragins and carried. RESOLUTION 'RESOLUTION FIXING THE V:'AGE RATE TO BE PAID FCR EACH CLASSIFICATION OF LABOR USED ON PROPOSED INkfER IMPROVEMENT PROJECTS WHEREAS, the Board of Aldermen, in compliance with the laws of the estate of Texas, did by resolution fix -.he minimum wage rate to be paid on the proposed water improvement projects for the City of Vvichita Falls, Texas, and WHEREAS, it becomes necessary under the rulings of the �-oar Labor Board to fix a wage rate that will be both minimum and maximum. The reason for this request is due to an error in extension of the tally sheet covering item number one of Contract No. 2, clearing of the lake, wherein our Secretary used a unit price of $12.50 when the unit price should have been $22.50, with a total for this item of 4112s500 rather than the amount listed in error of $62,500s We ask that you either avow us the privilege of reforming our bid or disregard the whole bid entirely and throw it out. If additional evi- dence of this error is desired, we are prepared to have our secretary, Miss Billie Hallmark, make an affidavit to this effect. We assure you that this request is not make for any purpose other than correcting this error. Conkling, Partner ROUTES NOT AFMECTED ROUTES AFFECTED� y ` Kemp Southland Holliday Monroe North Side Tilden-Westover Barwise $rook East Side Taylor STATE;�ET OF PROPOSED CHATuGES: 1. Southland This line originally served a good purpose. When Street Cars were operating, the Southland car line covered substantial- ly the same route as the present bus line. There was no service in the areas now served by the Monroe, Brook and Taylor lines. When the City grew, bus routes were added to take care of the ex- pansion in building, and later the Southland bus superseded the Southland car route. The Southland bus route duplicates service on the other routes stated above. Little or no business is car- ried on this route between Harrison and Kemp, and this portion of the route is wasteful service. All other portions of the South- land route are taken care of by service over the same streets. 2. Monroe Tze Monroe route serves a good area north of the Southern railroad. No, change is proposed in the route between the busi- ness section and the intersection of Monroe and Avenue J. Please note further explanation under the proposal for change in the Brook route. 3. Tilden-Westover The Ti en- estover route is quite sorry in itts present operation. The route closely parallels the Kemp Boulevard bus line from the business section to the intersection of Tenth and Grant, resulting in small patronage and low earnings. This por- tion of the route, however, cannot be changed at the present time. From the intersection of Tenth and Grant the route operates over Tenth to Hayes , thence over Hayes to the intersection of Layes and Seymour Road, where one spur operates south over Hayes to Cumber- land, over Cumberland to Wenonah, over Idenonah to York, commencing a loop through Fairview addition over York, Lebanon, Lafayette and Wenonah to York, then returning over Wenonah to Cumberland, over Cumberland to Hayes, over Hayes to Ozark, at which point it digresses from the outbound route. From Hayes and Ozark it ope- rates east over Ozark to Tilden, then over Tilden to Tenth where it again joins and parallels the outbound route. From this point it parallels the outbound route to the downtown business section. Beginning again at the intersection of Hayes and Seymour, the Westover spur operates west over Seymour Road to Wenonah, thence north over vuenonah to and through the Westover Hills addition, re- turning over ' enonah and Seymour to Hayes and returning to the business section over the same as the outbound route. Page 2 Numerous problems are presented, both to the passengers and the Company, through t"rye operation of this route and spurs as presently set up. These problems are: (a) The Tilden spur, operating outbound over Hayes and inbound over Tilden cause passengers to be greatly confused as to routing and schedule. The Uvestover operation causes further confusion. At no point on the route beyond Tenth and Tilden do prospective passen- gers receive good, dependable, frequent and understandable service. A person standinc at the intersection of Hayes and Seymour enjoys twice as requent service outbound as inbound. A person waiting at any point on the route on Tilden has no service whatsoever outbound, while any one waiting on Hayes between Seymour and Ozark has no ser- vice whatsoever inbound. The area on Seymour between Hayes and Weno- nah is sparsely settled and with the proposed routing, any resident has service within a reasonable distance. (b) By the proposed routing, both in and out on Tayes, everyone has full service in both directions, and it is our judgment that ' this area needs the service to a greater extent than any other sec- tion on the route. 1�01� X (o) Tilden is but one block from n and as there is good service on Kemp Boulevard, any one living on Grant has the choice of two good lines within two blocks distance on either side. (d) Both Fairview addition and "iestover Hills receive half the service of other portions of the line, which is the case at present and their service would remain undisturbed. It is our contention that division of service in the middle of a route, as at present maintained on Hayes and Tilden, results in harm to both streets or areas. By consolidating the inbound and outbound service on the same street, it is understandable, and re- sults in more frequent -service to all concerned. 4. Brook The Brook route has always been a problem. Here again, pass- engers on Brook beyond Elizabeth are offered one way service only, and likewise, passengers on Harrison beyond Elizabeth have like ser- vice. A passenger on Brook in this area, desiring to ride to town must board on the outbound trip, riding to the end of the line, then ride inbound to town. A passenger desiring to ride from town to a point on Harrison must ride to the end of the line, then back to their destination. Numerous complaints have been registered in this regard, and these complaints are well taken. Again may we repeat, two way service in the middle of a route is the only way to take care of our passengers. The proposal takes care of this situation, fur- nishing two way service on both Harrison and Brook. The area south of the railroad is comparatively sparsely settled, and will not with it' s present population support two routes. For Page 3 ' this reason, we propose to serve the area with one line, which will give ample service, and serve practically every street that is now served. Due to the fact that the Brook line will serve this area, and the Brook line intersects or closely parallels the Tilden, Kemp, Monroe and Southland routes, transfers from practically the entire south part of the City in in easy reach of Hardin College and Country Club Estates. There will be no need for such passengers to go nearer down town than Brook in order to transfer to the Brook line for these destinations. At present, passengers living in the territory served by the Tilden and ' estover routes must ride all the way to town to effect a transfer to Hardin College, the Woman' s Forum or other points in Country Club Estates. 5. Taylor The Taylor route serves no good purpose. It parallels the Brook route as far as Brook and Elizabeth, and intersects with Monroe et Monroe and Avenue C. Service given consists of three round trips in the morning and four round trips in the evening rush hours, operating on a forty minute round trip schedule, and such a schedule is almost impossible to retain in onefs memory. Revenues received do not pay for the operators wages, let alone the coat of fuel, lubricants, tires, upkeep and depreciation. Most passengers living on Taylor depend on the Monroe or Kemp buses for service, which is but two blocks in either direction. A substantial proportion of the business carried, consists of persons who could ride other routes, also children bound for the 1_i6h School who could ride other school buses. ."ally the route was ever inaugurated is unknown to us , however a continued operation will be a drag on the system, and assist in preventing proper service on other lines where the frequency is of importance to a greater num- ber of customers. A quick glance at the map showing the proposed layout of routes should impress you with the eveness of spread of routes, the absence of duplications of service, the absence of difference in inbound and outbound routes on the same lines. Motion seconded by Alderman Spragins and carried. Moved by Alderman Spragins that the Board of Aldermen approve the recommendation of the City Manager to increase the salaries of A. J. Gates, Water Department Engineer, and F. M. Rugeley, City Engineer, the sum of $150.00 per month each, effective January 1, 1945, and to continue throughout the dura- tion of the construction of the new water reservoir and conduit for their engineering services in connection with the Water Improvement program; said increase in salaries to be paid out of vVater Improvement Bond funds. Assistant City Attorney Thelbert Martin submitted a written opinion to the effect that, according to the ruling by one of the local district courts, the City of Wichita Falls has no legal authority to collect admission tax from the Dailey Brothers Circus. , Moved by Alderman Wininger that the Board of Aldermen authorize and order the City Tax Collector.to accept the sum of $87.56 as payment in full for delinquent taxes of J. After discussion of the petition and by common consent of the Council, the City Manager was instructed to advise the petitioners committee by letter that the Council decided to temporarily defer the matter until such time as they are able to determine the action of Congress with reference to Social Security for municipal employees, and likewise the final action of the State Legislature with reference to pensions for state, county and .municipal employees. s Moved by Alderman Stephens that the meeting be adjourned. Moved by Alderman Stephens that the Board of Aldermen authorize the sale of Lot 12, Block 5, Granger Park Addition, to Mary Martinez for considera- tion of $75.00, and to authorize Mayor W. B. Hamilton to execute a deed for the same for and on behalf of the City of Wichita Falls. Motion seconded by Alderman Hyer and carried. Moved by Alderman Hyer that the Board of Aldermen authorize and order the City Tax Collector to accept the sum of $173.65 of Mrs. F. B. Jackson, Jr., as payment in full for delinquent taxes for the years 1931 to 43, inclusive, covering Lot 3, Block 3, Indian Heights Addition. Motion seconded by Alderman Fitzpatrick and carried. Moved by Alderman Stephens that the Board of Aldermen approve for pay- ment the bill of Wichita General Hospital in the amount of $653.56 for charity patients for the month of December, and authorize and order the City Clerk to draw a warrant for the same, upon like payment by Wichita County.
