Min 07/17/1944 101 Wichita Falls, Texas Memorial Auditorium July 17, 1944 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session at 8:00 o'clock P. M. on the above date in the Council Room in the Memorial Auditorium, with the following members present: C. A. Spragins, J. W. Fitzpatrick, E. J. Wininger, W. Ralph Hyer, Aldermen J. Li. Baber, 0. G. Stephens, G. D. Fairtrace, City Manager T. A. Hicks, City Attorney Geo. T. Henderson, City Clerk Moved by Alderman Hyer that the Board of Aldermen elect C. A. Spragins Mayor P.rotem for this meeting. Motion seconded by Alderman Stephens and carried. The Minutes of the previous meeting were read and approved as read. Eli Morgan and J. K. Walsh appeared before the Council on behalf of the Lamar Street USO requesting the Council to repair or recondition Lamar Street in front of the USO building so the same would be more suitable for street dancing, whereupon the Council instructed the City Manager to take this matter under advisement. ORDINANCE NO. 1390 AN ORDINANCE AUTHORIZING THE CITY COUNCIL TO COMPEL THE REPAIR OF SIDEWALKS, CURBS, GUTTERS AND/OR DRIVEtiEAYS WHICH ARE IN A DEFECTIVE AND DANGER- OUS CONDITION; DEFINING OFFENSES;IMPOSING LIABILITY FCR DAMAGES AND LOSS SUFFERED; REGULATING THE USE AND MAINTENANCE OF SIDDIALKS, CURBS, GUTTERS AND/OR DRIVEWAYS;DEFINING BROKEN AND DANGEROUS SIDEEALKS, CURBS, GUTTERS AND/OR DRIVE- WAYS AS A NUISANCE; PROVIDING FOR NOTICE TO PROPERTY gvNERS OR USERS THEREOF; PRESCRIBING A PENALTY AND DECLARING AN EMERGENCY. Moved by Alderman Wininger that Ordinance No. 1390 be approved and passed on its third and final reading. Motion seconded by Alderman Hyer and carried with the following vote: Yeas: Aldermen Fitzpatrick, Wininger, Hyer, Baber and Stephens. Nays: None. Moved by Alderman Baber that the Board of Aldermen authorize issuance of chauffeur's licenses to J. 111. Farrington, H. A. Myers and W. F. Sellers. Motion seconded by Alderman Fitzpatrick and carried. 102 Moved by Alderman Hyer that the Board of aldermen refuse and deny issuance of a chauffeur's license to Lavena Eggenberg. Motion seconded by Alderman Stephens and carried. RESOLUTION WHEREAS, the City National Bank of Wichita Falls has pledged through the First National Bank in Dallas to secure the deposits of the City of Wichita Falls the following securities: $280,000.00 U.S. 2% Tr. bonds of 1951/53; First National Bank, Dallas, Receipt No. 27745 dated 6-21-44, 51,200.00 U.S. 2% Tr. bonds of 1951/55; First National Bank in Dallas, Receipt No. 27743 dated 6 12-44, 5842600.00 U.S. 2% Tr. bonds of 1949/51, First National Bank in Dallas Receipt No, 27744 dated 6-12-44, and, 400,000.00 U. S. lj% Tr. notes, Series A 1947, First National Bank in Dallas Receipt .No. 27987 dated 7-7-44, totaling the sum of $1,315,800.00, and WHEREAS, the City National Bank of 14ichita Falls desires to substitute $1,200,000.00 of the above described securities for a like amount of U. S. Government securities, NOW, THEREFORE, BE IT RESOLVED by the Board of Aldermen of the City of Wichita Falls, Texas, that the City Clerk be and is hereby authorized to exchange $280,000.00 U.S. 2% Tr. bonds of 1951/53; First National Bank in Dal 4s, Receipt No. 27745 dated 6 12-44 51,200.00 U.S r. bonds of 1951/55: First National Bank in Dallas, Receipt No. 27743 dated 6-12-44, 584,600.00 U.S. 2% Tr. bonds of 1949/51: First National Bank in Dallas, Receipt No. 277.44, dated 6-12-4.4, and 284,200.00 only of the U.S..1j% Tr. notes, Series A-1947, as described in First National Bank in Dallas Receipt No. 27987 dated 7-7-44, for the following securities to be pledged by the City National Bank of Wichita Falls through the First National Bank in Dallas to secure the deposits of the City of Wichita Falls: $600,000.00 U.S. 1�%Tr. notes, Series B-1947, due 3-15-47, First National Bank in Dallas Receipt No. 28055, 600,000.00 U.S. 7/8% Certificate of Indebtedness, Series C 1943, due 6-1-45, First National Bank in Dallas Receipt No. 28056, totaling the sum of $1,200,000.00, plus the remaining amount of $115,800.00 U.S. lj% Tr. notes Series A 1947, as described in First National Bank in Dallas Receipt No. 27987, dated 7-7-44. Moved by Alderman Hyer that the above and foregoing resolution be adopted and passed as read. Motion seconded by alderman Wininger and carried by the following vote: Yeas: Aldermen Fitzpatrick, Wininger, Hyer, Baber and Stephens. Nays: None. 103 City Manager, G. D. Fairtrace, reported to the Council that he had agreed to increase the gages of the employees of the Garbage Department to 650 per hour for truck drivers and 550 per hour for laborers, effective August 1st, and recommended that the above wage scale increase be approved by the Board of Aldermen, whereupon the following motion was made: Moved by Alderman Hyer that the Hoard of Aldermen approve and ratify the action of the City Manager in increasing the Garbage Department wage scale to 65¢ per hour for truck drivers and 550 per hour for laborers, effective August 1st. Motion seconded by Alderman Fitzpatrick and carried. Moved by Alderman Stephens that the Board of Aldermen authorize a tax refund of 619.90 to J. T. Stephen on account of error in payment of taxes not belonging to the said Stephen, and further authorize and order the City Clerk to draw a warrant for the same. Motion seconded by Alderman Fitzpatrick and carried. The Uity Manager read to the Council a letter from Albert E. Wratten requesting the "ouncil to consider paving Denver Street in the 500 and 600 blocks. Acting upon the recommendation of the City Manager the matter was deferred to such time as the City may be able to secure Federal aid for such projects. Moved by Alderman Fitzpatrick that since L. H. Gould is ill and his condition being such that he will not be able to serve on the Equalization Board, that the Council is compelled to and does hereby now declare the place of L. H. Gould to be vacant. Motion seconded by Alderman Baber and carried. Moved by Alderman Hyer that the Board of Aldermen appoint T. E. Hill to fill the vacancy for this place on the 0ity of V ichita falls Equalization Board. Motion seconded by Alderman Stephens and carried. Moved by Alderman Stephens that the Board of Aldermen approve and authorize payment to the Wichita General Hospital the sum of 41,459.10 for the City's share of charity patients for the month of June 1944, upon like payment by Wichita County.
