'v'lichita Falls, Texas Memorial Auditorium June 12, 1944 ON THIS the 12th day of June 1944, the Board of Aldermen of the CITY OF WICHITA FALLS, TEXAS, convened in Regular Session in the Council Room in the Memorial Auditorium, the following members thereof, to wit: W. B. HAMILTON, MAYOR. C. A. SPRAGINS, ALDERMAN, J. M. BAKER, ALDEWAN, J. N. FITZPATRICK, ALDERMAN, 0. G. STEPHENS, ALDERMAN, E. J. WINLNGER, ALDERMAN, W. RALPH HYER, ALDERMAN, GEORGE T. HENDERSON. CITY CLERK GARLAND FRANKS, ACTING CITY MANAGER T. A. HICKS, CITY ATTORNEY MINUTES of the meeting of June 5th and the called session of June 8, 1944, were read. MOVED by Alderman Stephens that the Minutes of June 5th and 8th, 1944, be approved as read. MOTION seconded by Alderman Spragins and carried. THE MEETING was called order by Mayor Hamilton who announced the pur- pose of the meeting, among other matters to be the consideration of Ordinance No. 1387, granting a franchise for the operation of the City's Waterworks System in accordance with the terms set out in that certain Trust Indenture dated May 1, 1944. ORDINANCE N0.1M -'hAN ORDINANCE by the Board of Aldermen of the City of Wichita Falls, Texas, expressly granting to the purchaser, or purchasers, of the waterworks System of said City, the exclusive right, privilege and franchise to operate the said System, in event of default in payment of all or any portion of the $3,500,000.00 'CITY OF WICHITA FAILS, TEXAS, FIRST MORTGAGE WATEIVIORKS SYSTEM REVENUE IMPROVEMENT BONDS' authorized at the eldetion held in said City on April_ll, 1944, for the purpose of paying off, refunding and cancelling $351,000.00 'City of Wichita Falls, Texas. Waterworks System Improvement Revenue Bonds,' dated October 1, 1940, and for the purpose of purchasing additional water powers, riparian rights, improving, enlarging, extending and repairing such System at a cost of not exceeding $3,149,000.00, as authorized by the Constitution and laws of the State of texas, particularly Articles 1111 et seq., Revised Civil Statutes of 1925, as amended, and which franchise shall run for a term of twenty years from the date the properties of said Waterworks #ystem may be acquired by such purchaser or purchasers; by judicial sale, or otherwise; and enacting provisions incident and relating to the subject and purpose of this Ordinance;" was introduced in writing by Mayor Hamilton, and was read. Moved by Alderman Fitzpatrick that Ordinance No. 1387 be passed on third and final reading and approved as read. Motion seconded by Alderman Stephens and carried with the following vote: Yeas: Hamilton, Spragins, Fitzpatrick, Wininger, Baber, Stephens and Hyer. Nays: None. 78 McComas. Moved by Alderman Baber that chauffeur's license be granted to John Motion seconded by Alderman Fitzpatrick and carried. Moved by Alderman Wininger that the Board of Aldermen authorize the issuance of a solicitor's license to the First Church of the Nazarene. Motion seconded by Alderman Fitzpatrick and carried. Moved by Alderman Fitzpatrick that the Board of Aldermen authorize a transfer of the sum of $8,750.00 from the regular Water account to the Water Improvement No. 4 account. Motion seconded by Alderman Baber and carried. ORDINANCE NO. 1389 AN ORDINANCE AMBR'DING SECTION 12-3016 OF TITLE 12 CHAPTER 3 OF THE CODIFICATION OF CRDINANCES OF THE CITY OF WICHITA FALLS, TEXAS, ADOPTED By ORDINANCE NUMBER 1315 PASSED AND APPROVED THE 6TH DAY OF JANUARY, A.D. 1941, SO THAT SAID SECTIONS SHALL PROVIDE NO MILK AND/OR MILK PRODUCTS SHALL BE SOLD TO THE FINAL CONSUMER, RESTAURANTS, SODA FOUNTAIN, GROCERY STORES OR SIMILAR ESTABLISHMENTS EXCEPT CERTIFIED PASTUERIZED AND GRADE A PASTUERIZED MILK AND/OR MILK PRODUCTS AS DEFINED IN THE RULES AND REGULATIONS PROMULGATED BY THE STATE HEALTH OFFICERS. Moved by Alderman Fitzpatrick that Ordinance No. 1389 be approved as read and passed its first reading. The motion died for want of second. Moved by Alderman Spragins that the Board of Aldermen appoint J. B. Hickerson Acting City Clerk during the absence of the regular City Clerk from the City of Wichita Falls. Motion seconded by Alderman Baber and carried. Moved by Alderman Spragins•that the Board of Aldermen authorize and approve payment to the Wichita General Hospital for charity patients during the month of May in the amount of $1,432.65 upon like payment by Wichita County. Motion seconded by Alderman Wininger and carried. 1 79 Moved by Alderman Spragins that the Board of Aldermen authorize delincuent tax adjustments, both person and real as set forth in the fol- lowing schedule: Motion seconded by Alderman Baber and carried.
