Min 06/05/1944 67 Wichita Falls, Texas Memorial Auditorium_ June 5, 19" ON THIS the 5th day, of June, 1944, the Board of Aldermen of the CITY OF V`yICHITA FALLS, TEXAS, convened in Regular Session in the Council Room in the Memorial Auditorium, the following members thereof, to wit: W. HENDERSON, CITY CLERK GARLAND FRANKS, ACTING CITY-MANAGER T. A. HICKS, CITY ATTORNEY - MINUTES of the meeting of May 29, 19", were read. MOVED by Alderman Hyer that the minutes of May 29th be approved as read. MOTION seconded by Alderman Fitzpatrick and carried. MAYOR HAMILTON introduced Ordinance No. 1387, being a Franchise Ordi- nance for the operation of the City's Waterworks System in accordance with the terms set out in the Trust Indenture dated May 1, 1944, and said Ordinance being read in full, the Mayor called for public hearing on said Ordinance as advertised and set by the terms thereof. WHEREUPON a public hearing on Ordinance No. 1387 was had. Moved by Alderman Fitzpatrick that the public hearing be closed on Ordinance No. 1387. Motion seconded by Alderman Hyer and carried by the following vote: Yeas: Hamilton, Spragins, Fitzpatrick, Wininger, Baber, Stephens and Hyer. Nays: None. ORDINANCE N0. 1387 "AN ORDINANCE by the Board of Aldermen of the City of Wichita Falls, Texas, expressly granting to the purchaser, or purchasers, of the Waterworks System of said City, the exclusive right, privilege and franchise to operate the said System, in event of default in payment of all or any portion of the $3,500,000.00 'CITY OF WICHITA FALLS, TEXAS, FIRST MORTGAGE WATERWORKS SYSTEM REVENUE IMPROVEMENT BONDS, ' authorized at the election held in said City on April ll, 1944, for the purpose of paying off, refunding and cancelling $351,000.00 'City of �richita Falls, Texaa, Waterworks System Improvement Revenue Bonds, ' dated October 1, 1940, and for the purpose of purchasing additional water powers, riparian rights, improving, enlarging, extending and repairing such System at a cost of not exceeding 3,149,000.00 as authorized by the Con- stitution and laws of the State of Texas, particularly Articles 1111 et seq. , Revised Civil Statutes of 1925, as amended, and which franchise shall run for a term of twenty years from the date the properties of said Waterworks System may be acquired by such purchaser or purchasers, by judicial sale, or otherwise; and enacting provisions incident and relating to the subject and purpose of this Ordinance." 68 Moved by Alderman Wininger that Ordinance No. 1387 be passed on its second reading. Motion seconded by Alderman Stephens and carried with the following vote: Yeas: Hamilton, Spragins, Fitzpatrick, titiininger, Baber, Stephens and Hyer. Nays: None. Dr. 0. W. Wilson and Dr. Roberts and members of the tiichita County Health Unit appeared before the Council proposing that an ordinance be passed to prohibit the sale of raw milk within the city limits of the City of 4ichita Falls. Harry Simons, Mr. Walker and Mr. Ditto, among other dairymen, voiced their opposition to the proposed ordinance, whereupon the matter was discussed by the Council and deferred until the next regular meeting. Moved by Alderman Spragi.ns that the Council authorize and order the construction and installation of a sanitary sewer line in the alley in the 600 and 700 blocks between Welch and Sullivan Streets. Motion seconded by Alderman Fitzpatrick and carried. A petition requesting permission to fish in Lake Wichita by wading with rubber boots on, again came up for consideration, whereupon the following motion was made: Moved by Alderman Fitzpatrick that that portion of the ordinance pro- hibiting fishing by, wading in Lake 4ichita be repealed. Motion seconded by Alderman Kininger, and after considerable discuss- ion by the Council, the motion, by consent of the second, was withdrawn. Moved by Alderman Stephens that chauffeur's license be granted to 1,1. C. Johnson. Motion seconded by Alderman Baber and carried. Moved by Alderman Baber that chauffeur's license be granted to H. N. Joyner. Motion seconded by Alderman Spragins and carried. Moved by Alderman Wininger that the application of Chas. L. Holloway for a chauffeur's license be rejected and refuse issuance of the same. Motion seconded by Alderman Stephens and carried. 69 Moved by Alderman Hyer that the City Clerk be authorized and ordered to draw a warrant payable to Glenn Haynes, District Clerk, in the amount of 1,751.60 to satisfy ,judgment in the 78th District Court granted A. I. McAda against Wilkes and Huffines, dba Hamp's Taxi; said warrant to be drawn on the Taxicab Deposit Find and charged to that portion of the taxicab fund belonging to Hamp's Taxi. Motion seconded by Alderman Wininger and carried. Moved by Alderman Hyer that the Mayor be authorized to executed a release to W. B. Bennett on dot 1, Block 112, Original, since the said lot was never paved and therefore owes nothing to the City of Wichita Falls. Motion seconded by Alderman Fitzpatrick and carried. ORDINANCE NO. 1388 AND ORDINANCE LEVYING A RENTAL CHARGE OF TWO PER CENT OF THE GROSS INCOAE RECEIVED FOR TRANSPORTING PASSENGERS WITHIN THE CITY OF WICHITA FALLS, TEXAS, TO BE PAID BY PERSONS, TRUSTEES, FEULS, ASSOCIATIONS AND CCRPCRATIONS ENGAGED IN THE BUSINESS OF TRANSPORTING PASSENGERS FOR HIRE ON AND OVER UNDESIG- NATED ROUTES WITHIN SAID CITY AND WHO USE THE STREETS, ALLEYS AND PUBLIC WAYS OF SAID CITY FOR SUCH PURPOSE, PRESCRIBING PENALTIES. Moved by Alderman Fitzpatrick that Ordinance No. 1388 be passed on its first reading. Motion seconded by Alderman Baber and carried by the following vote: Yeas: Aldermen Spragins, Fitzpatrick, Wininger, Hyer, Baber and Stephens. Nays: None. Moved by Alderman Stephens that the Board of Aldermen authorize the purchase of one air compressor for the Water Department at a cost of $1,991.00, plus transportation charges, if any, and the same to be paid out of the Water Fund. Motion seconded by Alderman Hyer and carried. The proposed purchase of 10 trucks for the Garbage Department was post- poned indefinitely. i n The City Clerk was instructed by the Council to draw a warrant payable either to the City National Bank, Trustee, or Crummer & Co., as may be necessary to retire the $351,000.00 worth of Water Revenue Bonds plus the interest, which amount is necessary to be retired before the $3,500,000.00 Water Revenue Improve- ment Bonds can be validated. The City Clerk was also instructed by the Council to pr4eed to Austin with Alderman Stephens or some other member of the Council for the purpose of delivering 63,000,000.00 water revenue bonds to the Comptroller's office in Austin for his attention. Mayor Hamilton recommended to the Council that Geo. D. Fairtrace be appointed City Manager for a period of two years at a salary of $9,000 per year and to begin not later than July 1st, and that Garland Franks be appointed Assistant City Manager. Moved by Alderman Hyer that the Board of Aldermen appoint Geo. D. Fairtrace City Manager, effective not later than July lst, at a salary of $9,000.00 per year. Motion seconded by Alderman Stephens and carried. It was moved by Alderman Stephens that the Board of Aldermen adjourn. Motion seconded by Alderman Spragins and carried.
