Min 05/29/1944 61 Wichita Falls, Texas Memorial Auditorium May 29, 1944 ON THIS the 29th day of may, 19440 the Board of Aldermen of the CITY OF WICHITA FALLS, TEXAS, convened in Regular Session in the Council Room in the Memorial Auditorium, the following members thereof, to-grit: W. B. Hamilton, Mayor, C. A. Spragins, J. W. Fitzpatrick, X E. J. Wininger, X J. M. Baber, Aldermen 0. G. Stephens, X W. Ralph Hyer, George T. Henderson, City Clerk Garland Franks, Acting City Manager T. A. Hicks, City Attorney MINUTES of the meeting of May 22, 1944 were read. Moved by Alderman Spragins that the minutes of May 22, 1944 be approved as read. Motion seconded by Alderman Baber and carried. THE MEETING was called to order by Mayor Hamilton who announced the purpose of the meeting, among other matters, to be the consideration of Ordi- nance No. 1387, granting a franchise for the operating of the City's Waterworks System in accordance with the terms set out in that certain Trust Indenture dated May 1, 1944, and said ordinance being introduced in writing by Mayor Hamilton and read in full, the Mayor called for a public hearing on said ordinance as advertised and set forth by the terms thereof. V.!HEREUPON A PUBLIC HEARING ON Ordinance No. 1387 was had. Moved by Aldeman Stephens that the public hearing on Ordinance No. 1387 be closed for this session. Motion seconded by Alderman Fitzpatrick and carried by the following vote: YEAS: Hamilton, Spragins, Fitzpatrick, Wininger, Baber, Stephens and Hyer. NAYS: None. ORDINANCE NO. 1387 "AN ORDINANCE by the Board of Aldermen of the City of Wichita Falls, Texas, expressly granting to the purchaser, or purchasers, of the Waterworks System of said City, the exclusive right, privi- lege and franchise to operate the said System, in event of de- fault in payment of all or any portion of the $3,500,000.00 'CITY OF WICHITA FALLS, TEXAS, FIRST MORTGAGE VIATEFSORKS SYSTEM REVENUE DAPROVEMT BONDS,' authorized at the election held in said City on April 11, 1944, for the purpose of paying off, re- funding and cancelling $351,000.00 'City of Wichita Falls, Texas, Waterworks System Improvement Revenue Bonds, ' dated October 1, 1940, and for the purpose of purchasing additional water powers, riparian rights, improving, enlarging, extending and repairing such System at a cost of not exceeding $3,14.9,000.00 as authorized by the Constitution and laws of the State of Texas, particularly Articles 1111 et seq., Revised Civil Statutes of 1925, as amenddd, and which franchise shall run for a term of twenty years from the date the properties of said Waterworks System may be acquired by such purchaser or purchasers, by judicial sale, or otherwise; and enacting provisions incident and relating to the subject and pur- pose of this Ordinance." 62 MOVED by Alderman Fitzpatrick that Ordinance No. 1387 be passed on its first reading. vote: OTION SECONDED BY Alderman Wininger and carried by the Following YEAS: Hamilton, Spragins, Fitzpatrick, Wininger, Baber, Stephens and Hiner. NAYS: None. A petition was presented to the Council wherein the signers thereof were seeking permission for the erection of a Methodist church building at Holliday and 23rd Streets. The petition was accepted as presented to the Council who unanimously voiced their approval-of the same. A petition bearing approximately 140 signatures, requesting permission to fish in Lake Wichita by wading with rubber boots on, was presented to the Council by R. C. Roden. The petition was accepted and deferred for further consideration. A petition requesting the refusal of permission for circuses, carni- vals and other traveling shows to exhibit on the ball park grounds came up again for consideration; whereupon the Council ordered the matter referred to the Planning and Zoning Commission. Moved by Alderman Hyer that since it becomes necessary to retire the entire amount of the outstanding Water Department time warrants before the $3,500,000.00 Water Revenue Bonds can be approved by the Attorney General and others, that the board of Aldermen authorize and order the City Clerk to draw city warrants in the amounts of $52,750.00 and #203.33, respectively, to retire both principal and interest. Motion seconded by Alderman Fitzpatrick and carried. Moved by Alderman Stephens that the Board of Aldermen designate the First National Bank of Wichita Falls, Texas, as a special depository for one- third of the proceeds of the sale of the City of Wichita Falls Waterworks System Improvement Revenue Bonds; the amount to be deposited in the said bank being approximately $883,000.00. Motion seconded by Alderman Baber and carried. Moved by Alderman Fitzpatrick that the Board of Aldermen designate the Wichita National Bank of 14ichita Falls, Texas, as a special depository for one- third of the proceeds of the sale of the City of Wichita Falls Waterworks System Improvement Revenue Bonds; the amount to be deposited in the said bank being approximately $8$3,000.00. Motion seconded by Alderman Wininger and carried. 63 Moved by Alderman Wininger that the Board of Aldermen authorize and order delinquent tax adjustments, both personal and real,as set forth in the following schedule: Motion seconded by Alderman Fitzpatrick and carried. H. Gould and Alan T. Bryce to serve on the City of Wichita Falls Tax Equalization Board for the year 1944, at a salary of $300.00 each. Motion seconded by Alderman Stephens and carried. Alderman Fitzpatrick and Alderman Wininger reported that they had contacted Keener the Kleaner and he had assured them he would purchase a gas burner immediately uhich would eliminate the soot nuisance. Moved by Alderman Fitzpatrick that the Board of Aldermen rescind the action of the Council on May 8, 19", authorizing settlement with E. F. Moore and L. B. Bruner for alleged damage sustained in the East Side gardens, and further to instruct the checks to be returned to the City Clerk for cancellation. Motion seconded by Alderman Hyer and carried. Moved by Alderman Wininger that the Board of Aldermen authorize issu— ance of chauffeur's licenses to R. P. Tabor and James F. Taylor. Motion seconded by Alderman Fitzpatrick and carried. It was moved by Alderman Spragins that the Board of Aldermen adjourn. Motion seconded by Alderman Stephens and carried. The Board of Aldermen then adjourned.
