Min 04/17/1944 27 i i Wichita Falls, Texas Memorial Auditorium April 17, 1944 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session at 8:00 o'clock P. M. on the above date in the Council Room in the Memorial Auditorium Building, with the following members present: W. B. Hamilton, Mayor C. A. Spragins, J. W. Fitzpatrick, � E. J. Wininger, Aldermen J. M. Baber, 0. G. Stephens, T. A. Hicks, City Attorney Geo. T. Henderson, City Clerk Mayor W. B. Hamilton announced a quorum present and that the Council would proceed with the regular order of business. The Minutes of the previous meeting were read and approved as read. ORDINANCE NO. 1381 AN ORDINANCE AMENDING SECTION'S 1 AND 2 OF ORDINANCE NO. 445, AS SAME HAS HERETOFORE BEEN AMENDED BY ORDINANCES 1121 AND 1132; SUCH ORDINANCE NO. 44.5 BEING ENTITLED "AN ORDINANCE PROVIDING FOR RULES, REGULATIONS AND RATES FOR THE OPERATION AND MANAGFIMTT OF THE WICHITA FALLS WATER DEPARTMENT," SAID SECTIONS ALSO BEING KNOWN AS SECTION 7-1001 AND SECTION 7-1001.1, TITLE 71 CHAPTER 10 OF THE CODIFICATION OF ORDINANCES OF THE CITY OF WICHITA FALLS, TEXAS, 1941, REPEALING ALL ORDINANCES IN CONFLICT HrGWrITH, AND DECLARING AN EMERGENCY. Moved by Alderman Fitzpatrick that Ordinance No. 1381 be approved as read and passed on its third and final reading. Motion seconded by Alderman Stephens and carried by the following vote: Yeas: Aldermen Spragins, Fitzpatrick, 'J'oininger, Baber and Stephens. Nays: None. The alternate bids of Russell Kolp for the purchase of an oil and gas lease, being 68.5 acres out of a part of Block 22, Walker and Fletcher Cowherds Subdivision, League No. 1 Denton County School Lands, Wichita County, Texas, were read to the Council by the Clerk and, after some discussion, the following motion was made: Moved by Alderman Stephens that the Mayor be authorized to appoint a committee to consult with Mr. Kolp for a more canprehensive understanding with reference to the proposed sale of the oil and gas lease abolre mentioned and report back to the Council at its next regular meetuing. Votion seconded by Alder±ran Baber and carried. Mayor Hamilton appointed Aldermen Stephens, Baber and Spragins to serve on the above mentioned committee. 28 Moved by Alderman Spragins that the Hoard of Aldermen authorize and order the City Clerk to draw a warrant payable to A. J. Gates, 'pater Superin- tendent, reimbursing him in the amount of $31.25 for his expenses while attending the National. Association of Corrosion Engineers at Houston, April loth to 12th. Motion seconded by Alderman Fitzpatrick and carried. Moved by Alderman Stephens that the Board of Aldermen authorize payment to the Luichita General Hospital for charity patients during the month of March in the amount of $1,322.44, upon like payment by Wichita County, subject to ad- justments, if any, which might reduce the amount to be paid. Motion seconded by Alderman Fitzpatrick and carried. Moved by Alderman Fitzpatrick that the Board of Aldermen authorize the issuance of chauffeur's licenses to J. L. Jones, E. H. Moore, H. A. McCrary, Dolly Mae Estes, and Martha Dean Shanks. Motion seconded by Alder-man Wininger and carried. Moved by Alderman Stephens that the City Clerk be instruc d not to present any application for chauffeur's license to the Council approval, unless same shall have been presented to the Clerk's office not later than 10:00 A.M. Friday preceding the regular Council meeting night; further all applications shall have the approval or disapproval of the City Manager and Chief of Police and, in the absence of either, the City Clerk shall serve in that capacity. Motion seconded by Alderman Wininger and carried. ORDINANCE NO. 1382 AN ORDINANCE kMI FZING SECTION 2 OF ORDINANCE NO. 1373, PASSED 91D APPROVED ON NOEMBER 1, A. D. 1943, INCREASING THE NMLEER OF MEMBERS WITH THE PLANNING AND ZONING COMMISSION FROU NINE MEtSEERS TO FIFTEEN MEMBERS AND PRO- VIDZVG THEIR TENURE UNDER SUCH APPOINTMENT. Moved by Alderman Stephens that Ordinance No. 1382 be approved as read and passed on its first reading. Motion seconded by Alderman Spragins and carried by the following vote: Yeas: Aldermen Spragins, Fitzpatrick, Wininger, Baber and Stephens. Nays: None. Moved by Alderman Spragins that Mayor W. B. Hamilton be authorized to execute a contract on behalf of the City of 'i"ichita Falls by and between Murph and Taylor and the City of Wichita Falls for the construction of an addition to the Airport Administration Building in the amount of $9,546.48. B. Hamilton, h1AYQR, C. A. Spragins , ALDERMMAN J. M. Baber, ALDERMAN J. W. Fitzpatrick, ALDMIUN 0. G. Stephens, ALDERMAN E. J. Wininger, ALDFRMAN George T. Henderson, CITY CLERK, T. A. Hicks, City Attorney, being present, and, among other proceedings had, were the following: Alderman J. W. Fitzpatrick offered the following resolution to the Board of aldermen and moved its adoption: WHEREAS, under and by virtue of an ordinance duly passed by the Board of Aldermen of the CITY OF WICHITA FALIS, TEXAS, on the 13th day of March, 1944, an election was held in said City on the llth day of April, 1944, on the following proposition: "SHALL the Board of Aldermen of the City of Wichita Falls, Texas, be authorized to issue the revenue bonds of said City in the principal sum of not exceeding THREE MILLION FIVE HUN- DRED THOUSAND DOLLARS ($3,500,000.00) , matur- ing serially over a period of years not to exceed forty years from the date thereof, bearing interest at the maximum rate of THREE AND ONE HALF PER CENTUM (31%) per annum, for the purpose of paying off, refunding and can- celling not exceeding $351,000.00 of bonded indebtedness of the City's Waterworks System and for the purpose of purchasing additional water powers, riparian rights, improving en- larging, extending and repairing such System at a cost of not exceeding Three Million One Hundred Forty Nine Thousand Dollars ($3,149,000.00) , as authorized by the General Laws of the State of Texas, particularly Arti- cles 1111 et seq. , Revised Civil Statutes of 1925, as amended, said bonds to be special obligations of the City of `Wichita Falls, Texas, payable as to both principal and interest solely from the revenues of the City's Wateworks System and, SHALL the Board of Aldermen be authorized to encumber the City's Waterworks System or the revenue there- of, or both, for the purpose of securing the payment of the principal of and interest on said bonds, said encumbrance on said revenues to be an exclusive first lien on and pledge of said revenues, after the deduction of reasonable expenses of operating and maintaining said System, as said expenses are defined by statute, and all 31 bonds of said series are to be ratably secured in such manner that no one bonds hall have priority of lien over any other bond of said series; the indebtedness to be paid off, refunded and can- celled now being in the principal sum of $351,000,00, represented by "City of Wichita Falls, Texas, Waterworks System Improvement Revenue Bonds," dated October 1, 1940, bearing interest at the rates of 3% and 34% per annum, due serially in each of the years 1945 to 1960, both inclusive; but redeemable on October-1, 1955, or on any interest payment date thereafter, which bonds were authorized and issued pursuant to an election held in said City on September 30, 1938, and an ordinance adopted by the Board of Aldermen of said City on September 23, 1940, recorded in Ordinance Book Number 8, and to which ordinance reference is hereby made for further description of said indebtedness?" AND, WHEREAS, on this the 17th day of April, 1944, same being a regu- lar session of the Board of Aldermen, there came on to be considered the returns of said election; and, WHEREAS, upon consideration of the returns of the said election it appears that the same was in all respects legally held, after due notice had been given, and that the said returns were duly and legally made; and, WHEREAS, it further appears from said returns thatthere were cast at said election 2995 votes "FOR THE ISSUANCE OF WATERWORKS SYSTEM REVENUE BONDS AND ENCUMBERING 'IHE CITY'S 7ATERWOF.KS SYSTEM OR THE REVENUES THEREOF, OR BOTH, FOR THE PAYMENT OF SAME;" and 1333 votes "AGAINST THE ISSUANCE OF WATERWORKS SYSTEM REVENUE BONDS AND ENCUMBERING THE CITY'S WATERWORKS SYSTEM OR THE REVENUES THEREOF, OR BOTH, FCR TIDE PAYMENT OF SAME." THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY CF WICHITA FALLS, TEXAS: That the proposition to issue the aforesaid bonds was sustained by a majority of the qualified voters of said City, voting at said election, who owned taxable property in said City and who had duly rendered the same for taxa- tion, and that the Board of Aldermen of said City is authorized to issue said bonds and to provide for the payment of the principal of and interest on said bonds in the time and manner prescribed by law. The motion for the adoption of said resolution was duly seconded by Alderman 0. G. Stephens. Thereupon, the Mayor put the motion..to a vote of the members of the Board of Aldermen of the City of "ichita Falls, with request that as many as favored the resolution to vote "AYE", and all those opposed to vote 11NO11; the following members of the Board, to-wit: Mayor W. B. Hamilton and Aldermen C. A. Spragins, J. W. Fitzpatrick, E. J. Wininger, J. M. Baber, 0. G. stephens voted "AYE11; and none voted "NO." Hendarson, City Clerk City of dvichita Falls, Texas 32 A written resolution presented to the Uouncil by certain executive members of the local USO requesting free use of a grader and operator for recon- ditioning Spudder Ball Park for free exhibition games of Sheppard Field baseball teams, free water being also requested; whereupon the following motion was made: Moved by Alderman Spragins that the Board of-Aldermen authorize free gratis to Sheppard Field use of a grader and operator and any other necessary small tools for conditioning Spudder Ball Park, and further authorize water to be furnished at the Ball Park through the Park Department without charge for the purpose above mentioned and so long as the same is used for Sheppard Field free exhibition ball games. Motion seconded by Alderman Fitzpatrick and carried. Moved by Alderman Stephens that the request of authorities at Sheppard Field, for the City to construct a 2-inch water main outside the city limits and furnish water to them at a figure much lower than its actual cost, be tabled. Motion seconded by Alderman Wininger and carried. Moved by Alderman Spragins that the meeting be adjourned. Motion seconded by Alderman Stephens and carried. The Board of Aldermen then adjourned.
