Min 04/03/1944 17 Wichita Falls, Texas Memorial Auditorium April 3, 1944 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session at 8:00 O'clock P. M. on the above date in the Council Roam in the Memorial Auditorium Building with the fo]lowi.ng members present: W. P. Hood, Mayor C. A. Spragins, E. J. Wininger, W. Ralph Hyer, X Aldermen J. M. Baber, X 0. G. Stephens, Garland Franks, Acting City Manager T. A. Hicks, City Attorney Geo. T. Henderson, City Clerk Mayor Hood announced a quorum was present and that the Council would proceed with the regular order of business. The Minutes of the previous meeting were read and approved as read. Moved by Alderman Hyer that the Council authorize issuance of a domino license to Mr. and Mrs. Matel Bankston, dba The Arcade Recreation Club located at 721J Eighth Street. Motion seconded by Alderman Stephens and carried. RESOLUTION- WHEREAS, the City National Bank in Wichita Falls, Texas, Depository of the City of Wichita Falls, Texas, has deposited in trust with the First National Bank in Dallas, the sum of $48,000.00 in Wichita County 4 3/4% Refunding Bonds as security for the account of the City of Wichita Falls, as evidenced by the First National Bank in Dallas Certificate No. 23168, dated `February 20, 1942, as follows: Description Par Value County of Wichita Falls, 4 3A% Refunding Bonds Due; 4 10-44; Nos; 186/190 @ 1M ea. 4 10-42 $5,000 Due; 4-1045; Nos; 201/205 @ 1M eac. 5,000 Due; 4-10-46; Nos; 221/230 @ 1M ea. 10 000 Due: 410-47; Nos. 239/250 @ 1 M ea. 12,000 Due, 410-48; Nos; 255-256 0 1M ea. 2,000 Due; 4-10-49; Nos; 271/273 0 1M ea. 276/285 13,000 Due; 4-10-50; No; 301 @ 1M 1.000 $48,000 AND, I'MEREAS, five (5) of the above described bonds, being Nos. 186 to 190 at $1,000 each are maturing April 10, 1944; and, WHEREAS, the City National Bank in Wichita Falls has requested a release of the said five (5) bonds maturing April 10, 1944; and, WHEREAS, the City National Bank in Wichita Falls agrees to substitute in lieu thereof five (5) Archer County, Texas, 2% Refunding Road Bonds at $1,000 each, due July 1945; 18 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF AIDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT the City Treasurer and the City Clerk be and are hereby author- ized to accept as security for the City of Wichita Falls, Texas, five (5) Archer County, Texas, 2% refunding Road Bonds at $1,000.00 each, due July 1, 1945, and surrender five (5) Wichita County Bonds No. 186 to 190 at $1,000.00 each, maturing April 10, 1944, now on deposit in the First National Bank in Dallas. Moved by Alderman Stephens that the above and foregoing resolution be adopted and passed as read. Motion seconded by Alderman Wininger and carried with the following vote: Yeas: Aldermen Spragins, Wininger, Hyer, Baber and Stephens. Nays: None, ORDINANCE NO. 1381 AN ORDINANCE AMENDING SECTIONS 1 AND 2 OF ORDINANCE NO. 445, AS SAME HAS HERETOFORE BEEN AMENDED BY ORDINANCES 1121 AND 1132; SUCH ORDINANCE NO. 445 BEING ENTITLED "AN ORDINANCE PROVIDING FCR RULES, REGULATIONS AND RATES FOR THE OPERATION AND MANAGWNT OF THE WICHITA FALLS WATER DEPARTMENT," SAID SECTIONS ALSO BEING KNOWN AS SECTION 7-1001 AND SECTION 7-1001.1, TITLE 7, CHAPTER 10 OF THE CODIFICATION OF ORDINANCES OF THE CITY OF WICHITA FALL, TEXAS, 1941, REPEALING ALSO ORDINANCES IN CONFLICT HEREWITH, AND DECLARING AN EMERGENCY. Moved by Alderman Spragins that Ordinance No. 1381 be approved as read and passed on its first reading. Motion seconded by Alderman Baber and carried with the following vote: Yeas: Aldermen Spragins, Wininger, -flyer, Baber and Stephens. Nays: None. Moved by Alderman Stephens that the Board of Aldermen rescind the action of the Council of March 20, 1944, wherein the Acting City Manager was authorizelto advertise for bids for the sale of an 80 acre oil and gas lease out of Block 22, Walker & Fletcher Cowhered Subdivision of Denton County School Lands. Motion seconded by Alderman Spragins and carried. Moved by Alderman Stephens that the Board of Aldermen authorize and instruct the Acting City Manager to advertise for bids for the sale of an oil and gas lease approximating 70 acres out of an 80 acre tract of land known as Lakeview Cemetery, described as the East 1/2 of Block 22 of the Walker & Fletcher Subdivision, League No. 1, Denton County School Lands in Wichita County, Texas; it being specifically stated and understood that that portion of the said above described 80 acre tract of land which has been previously sold as grave spaces, which approximate 10 acres, shall not be included in the oil and gas lease for sale, also that part of the cemetery upon which apse** paupers graves are located, and, under no circumstances, shall any well be drilled for oil -or gas within 200 feet of any grave. Motion seconded by Alderman Spragins and carried; Alderman Hyer voting no. Motion seconded by Alderman Spragins and carried. Moved by Alderman Hyer that the meeting be adjourned. Motion seconded by Alderman Spragins and carried. The Board of Aldemen then adjourned.
