Min 03/13/1944 7 i Wichita Falls, Texas Memorial Auditorium March 13, 1944 The Board .of Aldermen of the City of Wichita Falls, Texas, met in regular session at 8:00 o'clock P. M. on the above date in the Council Room in the Memorial Auditorium Building with the following members present: VT. P. Hood, Mayor C. A. Spragins, J. W. Fitzpatrick, X E. J. Wininger, W. Ralph Hyer, X Aldermen J. M. Baber, 0. G. Stephens, X Garland Franks, Acting City Manager T. A. Hicks, City Attorney Geo. T. Henderson, City Clerk The Minutes of the previous meeting were read and approved as read. Moved by Alderman Wininger that the Board of Aldermen reject and deny the issuance of a domino license to Mike Zaborowski. Motion seconded by Alderman Hyer and carried. Moved by Alderman Stephens that the Board of Aldermen authorize the issuance of chauffeur's licenses to Homer Humphries, Vim. J. Simpkins and Wm. E. Keith. Motion seconded by Alderman Wininger and carried. Moved by Alderman Hyer that the Board of Aldermen refuse the issuance of chauffeur's licenses to Chas. R. Likins and Edgar E. Phillips. Motion seconded by Alderman Wininger and carried. The Acting City Manager reported the lowest price offered to the City for the contemplated purchase of a strip of land lying adjacent to Riverside Cemetery was $1,200 plus assumption of the taxes. The Council considered the price excessive and requested Mr. Franks to continue negotiations with the view of obtaining a lower price. Acting City Manager Garland Franks reported numerous complaints had been received regarding unsatisfactory bus schedules, etc, whereupon the Council instructed Mr. Franks to contact the new manager of the local bus company in an effort to arrange for � more suitable schedules. 8 i Moved by Alderman Fitzpatrick that the following resolution be adopted and passed as read. �:{otion seconded by Alderman Baber and carried by the following vote: Yeas: Aldermen Spragins, Fitzpatrick, 94ininger, Hyer, Baber and Stephens. Nays: None. F.ES QLUTION THAT, v',iHEREAS, R. C. Bowen, Trustee, the onwer of t'_ze Twin Fields Transportation Company oerating from Sheppard Field to its station on Ohio Street in the City of Wichita Fall s, and claims to hold a Certificate of Con- venience and Necessity granted by the Railroad Commission of the State of Texas for such operation, and; 1%THEREAS, it has come to the knowledge of the Board of Aldermen of the City of Kichita Falls that the said R. C. Bowen, Trustee, has contracted to sell the Twin Fields Transportation Company to Messrs. Moore and Brown and has pend- ing before the Railroad Commission an application for permission to transfer said certificate of convenience and necessity to the said Moore and Brown, Purchasers, and; ?':'HEREAS, the City of Wichita Falls contends that the Railroad Com- mission of Texas is without jurisdiction to issue a Certificate of Convenience and Necessity for the operation of busses within the City Limits of the City of Wichita Falls, Texas, and opposes the attempting transfer of such Certificate by the said R. C. Bowen, Trustee. N9.V, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDEP EN, AS FOLLO'hS: That a member of the Legal Department of the City of Wichita Falls is hereby authorized and directed to proceed to Austin, Texas, for the purpose of attending the hearing on the application of R. C. Bowen, Trustee, to secure permission of the Railroad Commission of Texas to transfer said Certificate to Messrs Moore and Brown and to represent the City at said hearing, and contest the application of said R. C. Bowen, Trustee, at such hearing. A petition was read to the Council wherein certain residents of the north side requested installation of street lights on North First and North Second Streets; whereupon the Council instructed the Acting City Manager to inform said petitioners that due consideration would be given their request when and at such time as the Texas Electric Service Co. was able to procure the necessary material, Moved by Alderman Baber that the Board of Aldermen approve and authorize a $25.00 monthly salary increase to Mrs. Dodson (formerly Loyce Spencer) effective April 1st, upon the condition that the County pay 50% of the said increase and the City to pay the other half. Motion seconded by Alderman Spragins and carried. 9 Loved by Alderman Baber that the contract previously entered into by and between the City of Wichita Falls and W. T. Macy Co. for the collection of delinquent taxes be amended to include the 1943 delinquent tax roll, but under no circumstances shall this motion be construed to mean an extension of the,time limit of the original contract, and all such agreements shall expire May 2A, 1944, as recited in said original contract. Motion seconded by Alderman Stephens and carried. The Council instructed the Committee previously appointed to negotiate a satisfactory settlement with certain property owners of East Side Gardens for alleged damages"to continue negotiations with their attorney to determine his best proposition for successful conclusion of the litigation and report the same back to the Council. Moved by Alderman Wininger that the Board of Aldermen accept the recom- mendation of the City Planning and Zoning Commission as outlined in their report for providing better water for the City of Wichita Falls. Motion seconded by Alderman Spragins and carried. ORDINANCE NO. 1380 AN ORDINANCE ORDERING AN ELECTION IN THE CITY OF WICHITA FALLS, TEXAS, TO BE HELD ON THE 11TH DAY OF APRIL, 1944, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY THE FOLLOWING PROPOSITION, TO-WIT: WHETHER OR NOT THE BOARD OF ALDERITEN SHALL BE AUTHORIZED TO ISSUE THREE MILLION FIVE HUNDRED THOUSAND DOLLARS ($3,500,000.00) IN REVENUE BONDS F(R THE PURPOSE OF PAYING OFF, REFUNDING AND CANCELLING NOT EXCEEDING THREE HUNDRED FIFTY ONE THOUSAND ($351,000.00) OF BONDED INDEBTEDNESS OF THE CITY'S WATERWORKS SYSTEM AND FOR THE PURPOSE OF PURCHASING ADDITIONAL WATER POWERS,$ RIPARIAN RIGHTS, IMPR0VING, ENLARGING, EXTENDING AND REPAIRING SUCH SYSTEM AT A COST OF NOT EXCEEDING THREE MnLION ONE HUNDRED FORTY NINE THOUSAND DOLLARS ($3,149,000.00) AS AUTHORIZED BY THE GENERAL LAWS OF THE STATE OF TEXAS, PARTICULARLY ARTICLES 1111 ET SEQ., REVISED CIVIL STATUTES 1925, AS AMENDED; DESIGNATING THE PLACES AT WHICH SUCH ELECTION SHALL BE HEIR; PRESCRIB ING THE FORM OF THE BALLOT TO BE USED THEREIN; PROVIDING FOR NOTICE OF SUCH ELECTION; ENACTING PROVISIONS INCIDENT AND RELATING TO THE SUBJECT AND PURPOSE OF THIS ORDINANCE; AND DECLARING AN EME OENCY. Moved by Alderman Fitzpatrick that Ordinance No. 1380 be approved as read and passed on its first reading. Motion seconded by k1derman Spragins and carried by the following vote: Yeas: Aldermen Spragins, Fitzpatrick, Wini.nger, Hyer, Baber and Stephens. Nays: None. Beloved by Alderman Spragins that the rule requiring ordinances to be read on three separate days be and is hereby suspended and that Ordinance No. 1380 be approved as read and passed on its second reading. Motion seconded by Alderman Stephens and carried by the following vote: Yeas: Aldermen Spragins, Fitzpatrick, Wininger, Hyer, Baber and Stephens. Moved by Alderman Spragins that the Board of Aldermen pass a resolution accepting the supplemental contract dated March 13, 1944, presented by Crummer & Co. and authorize Mayor W. P. Hood to sign the supplemental contract. Motion seconded by Alderman Stephens and carried. Moved by Alderman Baber that the meeting be adjourned. Motion seconded by Alderman Wininger and carried.
