The Board of Aldermen of the City of WichitaFalls, Texas, met in
regular session at 8:00 o'clock P. M. on the above date in the Council Room
in the Memorial Auditorium Building with the following members present:

Moved by Alderman Stephens that in the absence of Mayor W. P. Hood,
Alderman J. W. Fitzpatrick be appointed Mayor Pro tam for this meeting.
Motion seconded by Alderman Hyer and carried.
Mayor Pro tam J. W. Fitzpatrick declared since a quorum was present
the Council would proceed with the regular order of business.
Moved by Alderman Stephens that the Minutes of the previous meeting be
approved as read.
Motion seconded by Alderman Baber and carried.
The written resignation of Alderman J. W. Hunt was read to the Council,
whereupon the following motion was had:
Moved by Alderman Baber that the Board of Aldermen accept the resigna-
tion of Alderman J. W. Hunt.
Motion seconded by Alderman Hyer and carried.
Moved by Alderman Hyer that the Board of Aldermen officially appoint
'E. J. Wininger to fill the unexpired term of Alderman Hunt for Place No. 3 on
the Board of Aldermen of the City of Wichita Falls, Texas, and until his
successor is elected and qualified.
Motion seconded by Alderman Stephens and carried.
The Oath of Office was administered to E. J. Wininger by the City Clerk.
Bids for the construction of the proposed addition to the Administration
Building at the Airport were read to the Council.
Moved by Alderman Stephens that the bids for construction of the pro-
posed addition to the Administration Building at the Airport be shelved until
such time as a full Council is present.
Motion seconded by Alderman Hyer and carried.

Eli Goodman, colored, appeared before the Council seeking permission
to continue peddling peanuts near his stand in the fire zone, whereupon the
Council gave their consent for him to continue with the previous procedure.

Henry Courtier again appeared before the Council to discuss his pre- I _.
vious complaint of the alleged encroachment of Alderman W. R. Hyer near his
property in the 1400 block on Holliday Street, whereupon Mayor Pro tem J. W.
Fitzpatrick called a five minute recess to discuss the complaint along with the
opinion rendered by the City Attorney.
After a short recess, Mayor Pro tem J. W. Fitzpatrick called the
Council back into regular session and the following motion was had:
Moved by Alderman Baber that the application of Henry Courtier to re-
quire the City Engineer to enforce the city ordinances requiring W. Ralph Hyer
to remove his house and garage t( th '� th on the lot so that the same would
not cover any portion of the garage
or he reason that the City Attorney has
ruled in a written opinion in whih he holds that the City has lost the title
by limitations to that portion of the alley covered by the buildings belonging
to Mr. Hyer.
Motion seconded by Alderman Stephens and carried; Alderman Hyer not
voting.
Moved by Alderman Stephens that the Board of Aldermen approve a refund of $39.71
to John R. Chambers on account of overcharge of penalty and interest, and
authorize and order the City Clerk to draw a warrant to pay the same.
Motion seconded by Alderman Baber and carried.
Moved by Alderman Baber that the Board of Aldermen approve a tax refund
for $16.72 to Kyle M. Drollinger covering Lot 17, Block 13, East Side Sunset
Heights, as recommended by City Attorney T. A. Hicks, and authorize and order
the City Clerk to draw a warrant to refund the same.
Motion seconded by Alderman Hyer and carried.
Moved by Alderman Hyer that the application of the Wichita Falls Junior
College requesting the City to annex and include all of Blocks 38 and 39 of the
Highland Land & Irrigation Company subdivision of the C. Eackman Survey, Abstract
No. 450, in the city limits be granted and that the Council hold a public hearing
of said application at its next regular meeting to be held March 6, 1944.
Motion seconded by Alderman Stephens and carried.
Moved by Alderman Stephens that the Board of Aldermen rescind the
action of the Council on February 21, 1944, wherein the City Clerk was ordered
to withhold the approximate sum of $1,100 from the remittance to L. E. Whitham
& Co. for the purchase price of certain machinery, etc, recently acquired from
the said L. E. Whitham & Co. to pay delinquent taxes due the City of Wichita
Falls, but further authorize and order the City Clerk to draw a warrant in full
to L. E. Whitham & Co. for the total amount due them by reason of such purchase.

_ A written report from the City Engineer stating the estimated cost
of paving a portion of Avenue L to the Sacred Heart Cemetery was read to the
Council.
Moved by Alderman Baber that the Board of Aldermen authorize and
order delinquent tax adjustments, both personal and real, as set forth in
the following schedule:

of a life time golf club membership to John 71. Hunt, vhich is in keeping with the
policy of issuing such memberships to members of the Council who have terminated
their tenure of office with the City of Wichita Falls.
