Min 11/08/1943 1106 ^_richita Falls, Texas Memorial Auditorium November 8, 1943 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session at 8:00 O'clock P. M. on the above date in the Council Room in the Memorial Auditorium Building with the following members present: W. P. Hood, Mayor C. A. Spragins, X J. W. Hunt, X j J. M. Baber, X Aldermen 0. G. Stephens, J. A. Giddings, Jr., City Manager T. A. Hicks, City Attorney Geo. T. Henderson, City Clerk Mayor Hood announced a quorum present. The Minutes of the regular meeting held November 1, 1943, were read and approved as read. ORDINANCE NO. 1374 AN OPDINANCE REGULATING THE SALE AND MANUFACTURE OF ICE CREAM, FROZEN CUSTARD, ANL, ALL PRODUCTS 1LkNUFACTURED FCR SALE OR SOLD UNDER SUCH NAMES, DEFINING THE SAYS, AND PRESCRIBING RULES AND REGULATIONS FOR THE MANUFACTURE OF SUCH PRODUCTS: SETTING OUT THE BACTERIAL COUNT PERMITTED, REQUIRING A HEALTH EXAMINATION OF PERSONS HANDLING ICE CREAM, OR PRODUCTS THEREOF; CONSTRUCTION OF SUCH ESTABLISHMENTS; REQUIRING SCREENS TO BE ON ICE CREAM ti';AGONS; PROVIDING THAT IF ANY PART OF THIS ORDINANCE IS DECLARED VOID, SUCH HOLDING SHALL NOT AFFECT THE VALID PORTIONS THEREOF; AND PROVIDING A PENALTY. ORDINANCE NO. 1375 AN ORDINANCE MAKING IT UNLAY-WL TO CAUSE NOISES DETRIKENTAL TO LIFE OR HEALTH, AND FURTHER PROHIBITING LOUD AND DISTURBING NOISES OFFENSIVE TO PERSONS OF ORDINARY SENSIBILITIES, AND PROHIBITING LOUD AND DISTURBING NOISES, DECLARING CERTAIN NOISES LOUD AND DISTURBING, PROVIDING FCR. A PENALTY, AND REPUALING CERTAIN ORDINANCES, AND DECLARING AN EMERGENCY. Nays: None. 1107 ORDINANCE NO. 1376 i AN ORDINANCE AMENDING SECTION 6-1509.2 OF THE CODIFICATION OF ORDINANCES OF THE CITY OF V1ICHITA FALLS, TEXAS, 1941, ADOPTED BY ORDINANCE NO. 1315 PASSED AND APPROVED ON JANUARY 6, 1941, BY CHANGING THE TERbf OF CHAUFFEUR'S LICENSE AND THE FEE PAID FCR SAME. Moved by Alderman Stephens that Ordinance No. 1376 be approved as read and passed on its second reading. Motion seconded by Alderman Hunt and carried with the following vote: Yeas: Aldermen Spragins, Hunt, Baber and Stephens. Nays: None. Moved by Alderman Hunt that chauffeur's licenses be granted to Sisrow MI. Miller, Cecil G. Bailey and John C. Tucker. Motion seconded by Alderman Spragins and carried. RESOLUTION THAT aHEREAS, on February 1, 1941, the City of 71ichita Falls as Lessor, and the United States of America as Lessee, entered into Lease No. W 257 eng-272, being hereafter referred to as the Original Lease; and, WIIEREAS, the said Original Lease was amended by Supplemental Agree- ment No. 1, dated the 31st day of August, 1942; No. 2, dated the 14th day of February 1942; No. 3, dated the 14th day of June, 1943; and No. 4, dated the 19th day of July, 1943; modifying the terms of the Original Lease; and, 107MAS, the United States Government has prepared and presented to the City of Wichita Falls its Supplemental Agreement No. 5, proposing to delete paragraphs 3, 5 and 9 of said Original Lease and supplements thereto; and, WHEREAS, the paragraph proposed in substitution of paragraph 9 of said Original Lease is unsatisfactory to the City of Wichita Fails; and, W-HEREAS, the City of Wichita Falls has redrafted the proposed section 9 of Supplemental Agreement No. 5 of said Original Lease in a manner that the same is now acceptable to the City of Wichita Falls, Lessor, NOK, THEREFORE,, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, AS FOLLOWS: SECTION 1. That W. P. Hood, Mayor of the City of Wichita Falls, be and he is hereby authorized to execute Supplemental Agreement No. 5, amending Lease No. W 257 eng-272, as amended. Moved by Alderman Hunt that the above and foregoing resolution be adopted and passed as read. Motion seconded by Alderman Stephens and carried by the following vote: Yeas: Aldermen Spragins, Hunt, Baber and Stephens, Nays: None. 1108 Moved by Alderman Spragins that the Board of Aldermen authorize the City Manager to proceed with negotiations for the purchase of Lots 8, 9 and 10, Block 156, Original, for use of the Garbage Department. Motion seconded by Alderman Hunt and carried. Hood of certain members to serve on the City Planning and Zoning Commission as follows: John Gould - 6 year term Vt. B. Hamilton - 5 year term Geo. Beavers - 1 year term Motion seconded by Alderman Stephens and carried. 1109 Moved by Alderman Spragins that the Board of Aldermen appoint Alder- man 0. G. Stephens as an ex-officio member of the City Planning and Zoning Commission. Motion seconded° by Alderman Hunt and carried. Moved by Alderman Spragins that the meeting be adjourned.
