jThe Board of Aldermen of the City of Wichita Falls, Texas, met in
regular session at 8:00 o'clock P.M. on the above date in the Council Room
in the Memorial Auditorium Building with the following members present:

Mayor Hood declared a quorum present.

The Minutes of the regular meeting held September 20.. 1943, were read
and approved as read.
Moved by Alde man Spragins that the application of Jack C. Wilson for
chauffeur's license be disapproved and denied.
Motion seconded by Alderman Hyer and carried.
Moved by Alderman Stephens that the Board of Aldermen approve and
authorize the issuance of chauffeur's licenses to Arthur M. Ogletree, Nathan R.
Byrd, and Doris Dean Williams.
Motion seconded by Alderman Hunt and carried.
The public hearing was had on Ordinance No. 1371 being the proposed
appropriation budget for the fiscal year beginning October 1, 1943, and ending
September 30, 1944.
There was no opposition voiced.
ORDINANCE NO. 1371
AN ORDINANCE MAKING APPROPRIATION FOR SUPPORT OF THE CITY GOVERNMENT
FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1943, AND ENDING SEPTEMBER 30, 1944.
Moved by Alderman Hunt that Ordinance No. 1371 be approved and passed
as read on its second reading.
Motion seconded by Alderman Spragins and carried by the following
vote:
Yeas: Aldermen Spragins, Hunt, Hyer and Stephens.
Nays: None.

ORDINANCE NO. 1370 +�
ORDINANCE AMENDING SECTION 13-1037 OF THE CODIFICATION OF ORDINANCES

OF THE CITY OF WICHITA FALLS, TEXAS, 1941, ADOPTED BY ORDINANCE NO. 1315 PASSED
AND APPROVED ON JANUARY 6, 1941, BY ADDING THERETO CERTAIN PROVISIONS AND
REQUIREMENTS PITH REFERENCE TO AIR CONDITIONING APPARATUS AND OTHER APPLIANCES
AND FIXTURES, AND DECLARING AN EMERGENCY.
Moved by Alderman Stephens that Ordinance No. 1370 be approved and
passed as read on its third and final reading and declaring an emergency.
Motion seconded by Alderman Spragins and carried by the following
vote:
Yeas: Aldermen Spragins, Hunt, Hyer and Stephens
Nays: None.
The committee consisting of Aldermen Hyer and Baber, who recently were
designated to appraise the value of a certain 5 acre tract of land located near
the city dump ground now owned by the City of Wichita Falls, reported that the
said committee disapproved of the sale of this property, and the Council concurs
with the committee in its decision. ;
The City Manager recommended that the Council appoint a committee to
estimate the damages to the East Side Gardens as alleged b� , g y certain property a
owners of that district, for the purpose of effecting a reasonable settleament,
and perhaps propose an extension of the irrigation rights in lieu of any cash
settlement the City might be liable for. Thereupon the Mayor appointed Alder-
men Hyer and Baber as a committee to serve in conjunction with the City Manager
and City Attorney.
The CityAttorney reported the Barren case was heard `Y P s ar in the Court of
Civil Appeals, Fort Worth, about two weeks ago but thus far the decision of the
Court has not been announced.

Mayor Hood requested permission of the Council to call in consulting
engineers for the purpose of making ad independent report and verification of
the findings of the city engineers hto
the auxiliary water supply, whereupon the
Council instructed the City Manager communicate with Black & Veatch for the
purpose of ascertaining the cost of their services for such purpose.
Moved by Alderman Hyer that the Board of Aldermen authorize and order
homestead exemption be granted K. C. Spell for the years 1940, 1941, and 1942,
on Lot 7, Block 6, Harrison Addition, only, and being situated at 1914 Speedway
Avenue.

RESOLUTION
That, whereas, notwithstanding the fact that Ordinance No. 1192 of the
City of Wichita Falls provides for the issuing of permits to carnivals to show
in said City, the Board of Aldermen has at all times upon the application for
such permits expressed their opposition to the granting of same to carnivals to
show in the City of Wichita Falls, Texas, and,
Whereas, the acts of the Board of aldermen in granting permits for the
shaving of carnivals in the past have been based upon the fact that various
organizations in the City were sponsering the showing of said carnivals for the
reason that they were receiving a percentage of the receipts from the showing of
the same which was being devoted to various charitable purposes by such sponsor-
ing organizations, and,
Whereas, carnivals heretofore showing in Wichita Falls, have always
furnished a low class of entertainment and operated various gambling devices in
violation of the laws of the State of Texas, and,
Whereas, the various sponsering organizations of said carnivals have
been unable to prevent said carnivals from engaging in gambling and shaving of
lewd and obsene shows, notwithstanding the fact that they have diligently
attempted to do so.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY
OF WICHITA FALLS, AS FOLLOWS:
SECTION 1. That the Board of aldermen is of the opinion that the
best interests of the citizens of Wichita Falls will be served by the refusal
of all permits to carnivals.
SECTION 2. That the Board of Aldermen shall not issue permits to
any carnivals authorizing them to show in the City of Wichita Falls, Texas,
but shall at all times oppose the showing of carnivals, in said City.
Moved by Alderman Hyer that the above and foregoing resolution be
adopted and passed as read.
Motion seconded by Alderman Stephens and carried by the following
vote
Yeas: Aldermen Spragins, Hunt, Hyer and Stephens.
Nays: None.
Moved by Alderman Hyer that the meeting be adjourned.
Motion seconded by Alderman Spragins and carried.
The Hoard of Aldermen then adjourned.

The Board of Aldermen of the City of Wichita Falls, Texas, met in
called session at 5:00 PM. on the above date in the Council Room in the Memorial
Auditorium Building with the following members present:

Mayor Hood announced a quorum present, and that the Minutes of the
previous meeting would be dispended with until the next regular meeting.
The Mayor announced the purpose of the called session was to consider
the advisability of calling in Black & Veatch as Consulting Engineers on the
proposed new water project.
Moved by Alderman Spragins that the Board of Aldermen approve and
authorize the employment of Black & Veatch for the purpose of making an
independent survey and report as to the feasibility of the proposed auxiliary
water project.
Motion seconded by Alderman Stephens and carried.
Moved by Alderman Spragins that the meeting be adjourned.
