Min 01/04/1943 896 :ichita Falls, Texas Memorial Auditorium January 4, 1943 i The Board of Aldermen of the City of Wichita Falls met in regular E session at 8:00 o'clock P.M. in the Council Room of the Memorial Auditorium Building, on the above date, with the following members present: I Jas. IA. Williams, � J. W. Fitzpatrick, � V. E. Stampfli, Aldermen V1. Ralph Hyer, J. M. Baber, X J. A. Giddings, Jr., City Manager T. A. Hicks, City Attorney Geo. T. Henderson, City Clerk In the absence of Mayor W. P. Hood, due to serious illness, it was moved by Alderman V+il;iams that ',% Ralph Byer be elected Mayor P rotem for a period of two weeks. ?Motion seconded by Alderman Fitzpatrick and carried. The minutes of the reg lar meeting of December were read and approved. ORDINANCE NO. 1348 AN ORDINANCE GRANTING TO COM1,d1UNITY NATURAL GAS C0I`PANY, A CORPORA- TION, THE RIGHT, PRIVILEGE, AND FRANCHISE TO DISTRIBUTE GAS IN THE CITY OF 4tiICHITA FALLS, TEXAS, FOR A PERIOD OF T',g"LNTY (20) YEARS, REGULATING SAID DISTRIBUTION; PROVIDING FOR THE RATES TO BE CHARGES TO CONSUMERS OF GAS; AND REQUIRING ACCEPTANCE OF SAID FRANCHISE IN FIFTEEN (15) DAYS. ORDINANCE NO. 1358 AN ORDINANCE DEFINING RESTAURANT, ITINERANT RESTAURANT, EIAPLOYEE, UTENSILS, HEALTH OFFICER, ETC., RE,UIRING PERg:.1ITS FOR THE OPERATION OF SUCH ESTABLISITlxNTS, PROHIBITING THE SALE OF ADULTERATED, U%HOLESOIME OR MIS- BRANDED FOOD OR DRINK, REGULATING THE INSPECTION, GRADING, REGRADING, AND PLACARDING OF SUCH ESTABLISIRSENTS, THE ENFORC12JENT OF THIS ORDINANCE, AND THE FIXING OF PENALTIES. Williams that Ordinance No. 1358 be passed on its first reading, as amended, with the provision to clarify Section 7, and also change Section 11 to read "Six months.1' Motion seconded by Alderman Fitzpatrick and carried by the following vote: Yeas: Aldermen Fitzpatrick, Baber and Williams. Stampfli that the Board of Aldermen authorize and order the City Clerk to refund the sum of 0.00 to Louis Mitchell for Plumbing and Excavation Permits, which he was unable to use on account of unavailable materials. Motion seconded by Alderman Baber and carried. Moved by Alderman Baber that the City Clerk be authorized and ordered to refund the sum of 4$15.27 to Mrs. H. C. Mayfield for Homestead Exemption, with instructions to the City Tax Collector to deduct the sum of 6.30 Personal taxes. Motion seconded by Alderman Stampfli and carried. ORDINANCE NO. 1359 AN O':IDINANCE ALIENDING SECTION 1 OF ORDINANCE 841, PASSED AND APPI-60VED ON THE 8TH DAY OF NOVTMBER, 19261, ENTITLED "AN ORDINANCE PROVIDING FOR A TAX ON DOGS, PROVIDING FOR VACCINATION OF DOGS AGAINST RABIES BY A LICENSED VETERINARIAN AS A CO.,DITION PRECEDENT TO THE ISSUANCE OF SUCH LICENSE TAG, THE FEFE TO BE CHARGED FOR SUCH VACCINATION AND PROVIDING FOR THE COLLECTION OF SAID TAX, AND PROVIDING A PENALTY, REPEALING ORDINANCES NOS. 196 and 589 AND ALL OTHER ORDINANCES IN CONFLICT HERD ITH;" SUCH SECTION BEING ALSO KNOWN AS SECTION 3-101 OF CODIFICATION OF ORDINANCES CF THE CITY OF '",ICHITA FALLS, TEXAS, 1941, SO THAT SAID SECTION SHALL PROVIIE FOR AN `NNUAL TAX OF ONE DOLLAR ON HALE DOGS AND T;O DOLL:RS FOR FEI,;ALE DOGS; AND DECLARING AN L1ERGENCY. ORDNANCE 1W 1360 AN ORDINANCE REQURING THE QUARANTINE OF ALL DOGS EXPOSED TO RABIES AIM EVERY ANIMAL OF THE DOG KIND THAT HAS RABIES OR SYv[PTOPAS THEREOF, OR ANY ANIMAL THAT BITES, SCRATCHES OR OTHLTV;ISE ATTACKS ANY PERSON OR PERSONS WITH- IN THE CITY LIMITS, REUIRITJG THE C:°NER OR KEEPER OF DOGS AND OTHER PERSONS TO REPORT ALL CASES OF RABIES COMING TO THEIR ATTENTION, PROVIDING A PENALTY, ANT) DECLARING AN ElIERGENCY. Perkins by the City of 'Vv'ichita Falls, 'notion seconded by Alderman Stampfli and carried. 11oved by jlderman Stampfli that the City Clerk be authorized and ordered to draw a City -Warrant, payable to the J. A. Richolt Estate, in the amount of Y50.00 for liquidated damages on lot located at 7th and Seymour Streets, from May to November 15, 1942, said amount to be applied on their city taxes.
