A. .ricks, City Attorney Vayor Hood announced the purnose of this special meeting to be, among other matters, the consideration of the following Resolution. The Resolution vas read in full. YIIFRFY.9, the United States of America acting through the Federal ?Forks A�-ency, has offerer' to aid in financing certain improvements to the sanitary sewer systen;, knovn_ as Docket Tf=xas 41-167, and V1LMEEAS, the City of ►-ichita Falls, Texas, accepted the said offer of the United t• tes Government on April 20, 1942, and VEERPAS, the City of 51'iebita Falls, Texas, did advertise and call for bids on the wrk covered by the said offer on Y ty 7, 1942, and again on l:'ay 25, 1942, and V,IIERIAS, on both of the aforesaid dates the City failed to receive a bid on tie proposed work, and VEEREAS, on Tune 15, 1�'42, an attenipt was made to negotiate a contract on the proposed work, and VIEREAS, on this dste the City failed to receive a bid on the proposed work, and VIMEAS, the delay in starting construction on the sewer improve- ments caused by the failure to receive any bids on either of the aforesaid dates has resulted in an unsanitary condition that is a menace to the public health and welfare and therefore creates an emergency. DJOY,,, UIE-EFORE, RE IT gESOLVED that the Board of Aldermen of the City of 'Wichita Falls be and are hereby authorized to negotiate a contract for the construction of the said sanitairy sewer improvements with such responsible bidder or bidders as may be interested in this work, and BE IT FURTIM IFILES0177ED that sealed bids will be received and negoti- ation conducted at 10:00 A. V% Cooper, a citizen of Wichita Falls, T-xas, has filed a suit in the 34th District Court of Mchita County, Texas, styled G. t. Cooper vs City of Wichita Falls , #37438-A, in which he attacks the constitutionality of Ordinance No. 1269, which pxants exemptions on taxable values of homestead property in the sum of Three Thousand t$3,000.00) Dollars, and VE,42EAS, it is the desire of the City of Wichita Falls that the City Attorney appear and defend said suit. NCW, MREIURF, be it resolved by the Board of Aldermen in a special called session that the City Attorney, be, and he is hereby directed to defend said suit in the 30th District Court of Wichita County, Texas, when the same is set for trial. BE IT FUR`MR RESOLVED that the City Attorney, be, and he is hereby directed that in the event a decision is rendered by the Judge of the 3Oth District Court trying said cause adversely to the City of Wichita Falls, that he immediately appeal the same to the Court of Appeals, and do all things necessary to prosecute said cause to final decision.
