Min 09/21/1942 833 'Wichita Falls, Texas Memorial Auditorium September 21, 1942 The Board of Aldermen of the City of Wichita Falls met in regular session at 8:00 o'clock P. Al. in the Council Room of the A1emorial Auditorium Building on the above date with the following members present: J. W.Fitzpatrick, W. Ralph Hyer, Aldermen V. E.Stampfli, 0. G. Stephens, I Jas. A. Giddings, Jr. City Lanager J. TI. Crouch, City Clerk T. A. nicks, City Attorney In the absence of 1.1ayor W. P. Hood, it was moved by Alderman Hyer that Alderman V. E. Stampfli be appointed Mayor-Protem for this meeting. Lotion seconded by Alderman Stephens and carried. The minutes of the regular meeting of September 14th, were read. The Yayor-protem approved the minutes of September 14th, as read. Moved by Alderman Hyer that the Board of Aldermen grant the applica- tion of the American Legion to sponsor a carnival show adjacent to the Ball Park site, on condition that certain resident property have immediate police protection, and further provided that all tents and equipment of the carnival show be lccated 300 feet distant from any residence. P.,otion seconded by Alderman Fitzpatrick and carried. koved by Alderman Hyer that the Board of Aldermen authorize the City Manager to execute lease bearing date of September 21, 1942, with Holbrook & Woods for quarters for Military Police to be stationed in Wichita Falls. potion seconded by Alderman Stephens and carried. Loved by Alderman Fitzpatrick that the Board of Aldermen authorize and order refund of 1941 taxes paid on homestead in the amount of $10.50 to Bertha Turner, Lot 13, Block 10, Bateson's Second Addition. Motion seconded by Alderman Stephens and carried. The City Attorney, T. A. Hicks, filed a written report dated September 21st, with the Board of Aldermen claim of W. W. Taylor and Wife, represented by H. L. Ratliff, Attorney, for alleged damages caused by the construction of the new water plant to property owned by the ecmplainants. Moved by Alderman Hyer that the Board of Aldermen accept the report of the City Attorney, and the claim of W. 'A. Taylor and Wife, and request the Mayor Hood to appoint a committee of the Council to investigate this claim and make further recom-endations to the Board of Aldermen, ll`:otion seconded by Alderman Fitzpatrick and carried. 834 Vayor-protein Stampfli appointed a committee of Aldermen Hyer and Stephens to investigate the report on the claim of W. IT Taylor and wife. R E S O L U T I O N Resolution for removal and salvage of Street Railve.y Tracks That whereas, the City of 'Fichita Falls is the owner of approximately 510 tons of abandoned street car rails now lying in the streets of the City of Yichita I'alls, which said city desires to have removed fl-cm said streets in order that the same may be sold and streets repaired, and p7hereas, the W. P. A. an agency of the United States of America, has agreed to remove said street car tracks for the City of Wichita Falls in con- sideration of the City of Wichita Falls sell Ong said salvaged tracks and using such funds for the purchase of materials to be used in reconditioning the streets after the removal of said tracks. NOt, THERT ILDE, BE IT "ESCLVED BY THE BOARD OF ALDERAM C F THE CITY OF NI CzII TA FAIJ 5, T_!orVS, AS FOLLOM: I That the City of Wichita Falls hereby agrees to the removal of the rails from the streets, and that the rails salvaged will be sold by the City and the proceeds therefrom devoted to the expenses involved in the salvage operation and repaving of the track areas from which the rails will be removed, provided, the City shall not be obligated for the payment of any sum of money other than the sums received from the sale of the salvage recovered from the streets by the W.P.A. II That the rails will be removed with a minimums disturbance to the streets and the use thereof, and after removal of said rails the portion of the street from which the rails have been removed shall be repaired by the W. P. A. with first class materials and in a good and vo rkman-like manner, which shall be subject to M 836 the inspection and approval of the City Engineer of the City of Wichita Falls, Texas.
