M. in the Council Room cf the Memorial Auditorium Building on the above date vt th the following members present: W. P. Hood, Mayor T. M. Baber, 1. W. Fitzpatrick, 1 W. Ralph Hyer, Aldermen V. E. Stampfli, 0. G. Stephens, Tas. A. Giddings, Jr. City Manager 1. H. Crouch, City Clerk T. A. Hicks, City Attorney The minutes of the regular meeting of September 8th, were read. The Mayor approved the minutes of September 8th, fl s read. The Idayor referred to the action of the Board of Aldermen at their regular session of September 8th, relating to the Board's instructing suit to cancel contract between the City of Wichita Falls and the Wichita Garbage Company. L. ,P.Greene, owner and operator of the Wichita Garbage Co. , submitted in a letter proposal to the City of Wichita Falls, heretofore requested by the 830 Mayor in conference, for the surrender of the Wichita Garbage Company contract with the City. This proposal was read and discussed by members of the Board and Alderman Fitzpatrick recommended that the proposal be accepted, Moved by Alderman Fitzpatrick that the Board of Aldermen of the City of Wichita Falls, 'texas, accept the compromise settlement set out in letter by L. B. Greene, owner of Wichita Uarbage Company,as of 9-14-42,fo +he surrender and cancellation an,' release of contract held by L. B. Greene, doing business as The Wichita Garbage Company, with the City of Wichita Falls, Texas, sail contract being for the collection and disposal of refuse, trash and garbage, and dated August 1, 1941, and in lieu of settlement proposed by L. B. Greene that the Board of Aldermen hereby authorize and order paid tc L. B. Greene the sum of $6750.00 cash in full settlement of all accounts due to L. B. Greene by the City, said sum of $6750.00 in addition to all sums previously paid to L. B. Greene on said contract above mentioned as of the close of business Sept- ember 14, 1942, it being understood and agreed that all sums paid on said contract, including the $6750.00 herein ordered paid are in full consider- ation for the release of said contract and release of all interest in all garbage accounts receivable reflected on the records and books of the City as of the close of business September 14, 1942; and further that the Board of Aldermen hereby release L. B. Greene from any and all claims and obligations due the City by virtue of said contract and the operation and maintenance of refuse, trash and garbage collection and disposal under said contract. Motion seconded by Alderman Stampfli and carried. Moved by Alderman Fitzpatrick that the Board of Aldermen instruct the City Manager to notify by letter all delinquent trash and garbage accounts reflected on the City books, with the request that these accounts be paid promptly. Motion seconded by Alderman Stampfli and carried. With the consent of the Board of Aldermen the Mayor instructed the Manager to set up and organize on temporary basis, personnel and equipment necessary for collection and the disposal of trash and garbage within the City Limits. Moved by Alderman Stephens that the �oard of Aldermen of the City of Wichita Falls hereby authorize and order the City Treasurer to sell $20,000 City of Wichita Falls Water Works Improvement Series 1941 No. 1 Bonds on the bid of R. A. Moved by Alderman Hyer that the Board of Aldermen authorize the Mayor to execute for and on behalf of the City of Wichita Falls deed conveying to 1. T. Harrell,for a consideration of $750,00 and ease- ments on certain tract described as follows: I f 831 i All that certain parcel of land out of the John V. Wheeler, Survey, Abstract 377, Wichita County, Texas, and more particularly described as follows: TRACT #1. Beginning at a point in the corporate line of the City of Wichita Falls, also being the West line of the North Yorningside Park Subdivision, said point being 240.2 feet North of the Southwest corner of said Subdivision and also being at the intersection of said corporate line and the North line of Sturdevant Place Street; Thence best 749.8 feet; Thence North 10 deg. 51, East 797.8 feet to a point in the South right-of-way line of State Highway No. 30, said point being on a curve having a radius of 2789.9 feet, the tangent to which at said point bears North 73 deg. 05' East; Thence in an Easterly direction 446.8 feet around said curve to the right; Thence South 20 deg. 34' East 485.2 feet to a point in the corporate line of the City of Wichita Falls; Thence South 423.0 feet along said corporate line to the place of beginning and containing 12.13 acres, more or less. Harrell tract, being 200 feet North of the intersection of the North right-of-way line of Highway No. 30, and in the said East line of the said J. T. Harrell tract; Thence North 89 deg. 34' West 100.0 feet to a point; Thence South 200.0 feet to the North right-of-way line of Highway No. 30; Thence North 89 deg. 34' West 345.5 feet with the said North right-of-way line of said Highway No. 30 to the beginning point of a curve to the left; Thence in a Southwesterly direction 825.9 feet around a curve whose radius is 2939.9 feet, said curve being the North right-of-way line of Highway ivo. 30. T. Harrell tract; Thence South 10% feet to the point of beginning, and containing 28.CBacres of land more or less. It is the intent of this instrument to convey all the land conveyed by J. T. Harrell to the City of Wichita Falls in a deed dated February 7, 1939 save and except a 150 foot right-of-way for Highway No. 30 and a 100 x 200 foot tract reserved by the City of Ulichita Falls for a sedge pump station site. Provided the City of Wichita Falls reserved an easement across said tract of land herein conveyed along the sewage line as now located and laid together with right of ingress and egress, for the purpose of repairing and maintaining said sewage pipe line. 832 Moved by Alderman Fitzpatrick that the Board of Aldermen grant chauffeur's license to Eli P. LcKee. Motion seconded by Alderman Stampfli and carried. &oved by Alderman Stampfli that the Board of Aldermen authorize payment to Wichita General hospital of $1927.57 for August deficit, upon payment of like amount by Wichita County. Motion seconded by Alderman Stephens and carried. Moved by Alderman Stephens that the Board of Aldermen authorize the expenditure of g50.00 per month for the duration of National Emergency, to provide dormitory quarters for military police stationed in Wichita Falls, and instruct the City Yanager to prepare estimates on cost of renovating building for occupancy, and report to the Board of Aldermen.
