session at 8:00 o'clock Y. -. in the Council zoom of the L.emorial Auditorium
building on the above date with the following members present:

The minutes of the regular meeting of April 13th, were read,
moved by Alderman Fitzpatrick that the minutes of the regular meeting
of April 13th, be aPproved as read.

The special committee of the Board of Aldermen appointed to negotiate
with the Community ivatural Gas Co;, and the United Gas Corporation, Vas reappointed
by the Vayor. Said committee was composed cf Aldermen flyer, Stephens and Williams.

MiStt,,AS, Clouse and Eeathis and the City of Wichita Falls, Texas, on
October 23, 1941, entered into a contract for extensions to the Sanitary Sewer System
identified as Docket 'Texas 41-121, and
vtiEREAS, the said Clouse & Mathis, Contractors, have requested that
the Liquidated Damages as set out in Paragraph 39 of the General Conditions of
agreement be waived for the following reasons:

1. On November 6, 1941, the office of Production hanagement
granted a preference rating, Serial ivo. 2182a, covering all materials,
except the 6 inch cast iron pipe for the force main.
Upon receipt of this preference rating the City asked that
the rating be amended to cover the pipe in the force main and this request
was granted on December 9, 1941.
Immediately upon receipt of the amended preference rating an
order was placed for this pipe, together with a request for immediate
delivery. Due to higher preference ratings this pipe was not delivered on
the site of the project until February 2, 1942.
2. Upon receipt of the preference rating tvo. 2182a, an order
was placed for the sewerage lift pump, due to the low preference rating
these pumps were not received on the project site until April 6, 1942.
3. i�he major part of the construction on the sewer lines was
finished on January 14, 1942, and had the pipe for the force main and the
lift pumps been available, Clouse & k�athis would have been able to complete
the contract within the 100 calendar days allowed, and
i�rmAI!AS, the Board of Aldermen are of the opinion that the
delay on the completion of this work was not caused by negligence on the
part of the Contractors, and was due solely to circumstances over which
they had no control.

Ucntract be and are hereby vaived.

federal assistance in connection with the public works re='erred to in said
application and described in said Offer; and

authorize the expenditure not to exceed the sum of $120.00 for the purchase
of four or more short sound films for use for volunteer groups under the
Direction of the Civilian Defense Schools.

Moved by Alderman Stampfli that the Board of Aldermen authorize
the remission of $71.12 City taxes on Lot 12 Block 165, original townsite,
same being delinquent taxes for the year 1933, for the reason that said
propert-- was owned by baptist Uhurch Trustees.
