City Attorney Moved by Alderman Naylor that the Board of Aldermen, in the absence of Alayor W. E. Fitzgerald appoint Alderman Williams to act as P,ayor ±Totem for this meeting. rv'otion seconded by Alderman Hyer and carried. The Minutes of the regular meeting of January 5th, were read. Moved by Alderman Fitzpatrick that the minutes cf the regular meeting of January 5th, be approved as read. Lotion seconded by Alderman Hyer and carried, rinal public hearing was called on the application of the Wichita Transit Co., submitted in Ordinance No. 1337. Several citizens were heard in the discussion of the application for franchise. Illoved by Alderman Fitzpatrick that the Board of Aldermen accept as the lowest and best bid the bid of the Cyclone Fence Co. , for an 8 foot non- climable chain link fence of 4287 feet at 05038,00 plus galvanized cost of 4237.00 and plus $240.00 construction supervision. Motion seconded by Alderman Naylor and carried. rl'he Citc Attorney, Thelbert Yartin, recom- ended that the Board of Aldermen pass a certain resolution aut)torizing the acceptance of easement granted by Mrs. Lillian Grady and husband, Hugh S. Grady, covering a ten 2)ot strip across Lot 13, Block 10 of Sibley-Taylor First Addition to the City of Vichita Falls, said easement to be for the purpose of laying a 20" i>1ater line. i BL TT RESULVED by the Board of Aldermen of the City of Wichita Falls, Texas, that the form of easement granted by Mrs. Lillian Grady and husband, iiugh S. Grady, covering a ten fcot strip across Lot 13, Block 10, of Sibley- Taylor rirst Addition tothe Uity of Wichita Falls, said easement being fbr the purpose of laying a twenty inch water pipe line, the same to be laid in a ditch approximately four feet wide and the working area for the purpose of laying and i 686 maintaining said pipe line comprising a strip of ground extending five feet on each side of a center line beginning 27 feet South of the `°ortheast corner of said Lot 13 and running in a 1�orthwesterly direction across the Aortheast corner of said Lot to a point tr-enty feet Vest of said northeast corner of said Lot 13, be and the same is hereby accepted and the said City of Wichita calls does hereby agree to be bound by all of the terms and conditions set out and contained in said instrument granting said easement of date December 16, 1941. A. Scott and D. Leona Surveys; and, WhEAtA8, the State Highway Department is desirous of receiving Federal Aid fbr the improvement of said highway; and, 4t1L.tuO, the Public -toads Administration of the federal works Agency y of the United States of America will not participate in the construction of said highway until and unless the City of Wichita Falls will agree to refrain from permitting encroachments upon the right-of-way of said above mentioned streets, and until and unless the City of itiichita Falls will agree to refrain from passing ordinances or laws fixing a speed limit of under twenty miles per hour on said above mentioned streets, and until and unless the City of Wichita Falls will agree to refrain from erecting signs, semaphores, and signals that will give preference to local routes or that will hinder or delay traffic on said above mentioned streets. be it .resolved by the Board of Aldermen of the City of *ichita Falls that, for and in consideration of the State highway Depart=nt of the State of Texas and the Public Koads Administration of the Federal Works Agency of the United States of America constructing said Military Access Road through the City of VAchita calls over new location it hereby agrees with the { State Highway Department of the State of Texas and the Public goads Administra- tion of the Federal Works Agency of the United States of America that it will not, in the future, permit encroachment on the right-of-way of said above mentioned streets; #or will it pass an ordinance or laws fixing a speed limit on the above mentioned streets of under twenty miles per hour, ner will it allow the erection of signs, semaphores, and signals that will give preference to local routes which intersect with said above mentioned streets nor that will slow up, hinder, or delay traffic on said above mentioned streets; nor will it repeal or amend any of the provisions of this resolution without the consent of the State highway Comr_ission. That the Highway Department will submit a project for the improvement of 0.83 miles of the kilitary Access Road from Into US rtwys j287 & 70 to Nbrth City limits, known as new location, and to be designated as DA-M project !No. 19-A (1), and will recommend its approval by the Secretary of Agriculture for construction with funds apportioned to the State under the Federal Highway Act as emended and supplemented; subject, however, to the condition that the City of vdchita Falls shall provide for ( its proper maintenance after caampletion of its improvement. 2. That the said City of Vdchita r'alls hereby requests the Highway Department to submit the aforementioned project with recommendation j that it be approved by the Secretary of Agriculture, and agrees that if I such project is approved and constructed by the Highway Department and the Secretary of Agriculture it thereafter, at its own cost and expense, will maintain the project in a manner satisfactory to them, or their authorized representatives, and vdll make ample provision each year for such mainte- nance, LA INITIZab VAEkBOY, the parties have hereunto affixed their signatures, the City or Wichita Falls on the 12th day or January 1942, and the Highway Department on the 12th day of January 1942.
