Min 09/08/1941 629 Wichita FaDs, Texas Sept. 8, 1941 The Board of Aldermen of the City of Wichita Falls met in regular session at 8:00 o'clock in the Council Room of the Memorial Auditorium Building on the above date with the following members present: p W. E. Fitzgerald, Mayor J. W. Fitzpatrick, H. J. Naylor, Aldermen ( V. E. Stampf li, Jas. bi. Williams, J. Bryan Miller, City Manager J. H. Crouch, City Clerk T. A. Hicks, City Attorney The minutes of the regular session August 18th, regularly called session August 19th and regularly called session September 3rd, were read. i Moved by Alderman Williams that the minutes of the r-gular session August 18th, regularly called session August 19th, and regularly called session September 3rd, be approved as read. i Motion seconded by Alderman Fitzpatrick and carried. - - - - - - - - - - f Moved by Alderman Naylor that the Board of Aldermen accept and approve a right of way and easement in favor of the City of Wichita Falls, Texas, executed by the Missouri, Kansas & Texas Railroad Cc, of Texas under date of August 30, 1941, covering certain properties said Railroad Cempany described therein, for use in widening of United S1-ates Highway Numbers 70, 277, 281 between Wichita Falls and Sheppard Field. Motion seconded by Alderman Stampf li and carried. - - - - - - - - - - i Moved by Alderman Naylor that the Board of Aldermen award to Keasebey Matison Co. , the lowest and bett bidder on approximately 6135 feet of water pipe: i 6" pipe at 620 per ft 8" " " 960 12" " "1.90 and certain Class D fittings at $255.90. Motion seconded by Alderman Stampfli and carried. I - - - - - - - - - - - A duly advertised public hearing set for the regular council meeting of September 8th, on Ordinance No. 1328, being an ordinance providing for the extension of the Texas Electric Service Co. , franchise, was called by the Mayor. Representatives of the Chamber of Commerce read a resolution setting out the attitude of the Chamber of Commerce. Special committees d i s 1 i I 630 regarding the adoption of said ordinance ; representatives of an es- pecially called meeting of citizens concerning Ordinance No. 1328 report- ed to the council that a resolution offered in this meeting requested the Board of Aldermen defer further consideration of Ordinance No. 1328 for at least 90 days, and was unanimously adopted. Other citizens includ- ing C. H. Clark, W. W. Silk and L. L. Kountz opposed the passage of Ordinance No. 1328, with particular reference to the time of the extension requested by the Texas Electric Service Co., The attorney for the Texas Electric Service Co., was heard in support of the passage of the ordinance. Moved by Alderman Williams that the Board of Aldermen defer any official consideration of Ordinance No. 1328, proposed by the Texas Electric Service Co., and providing for an extension of franchise. held by said company for a period of 90 days from date. Motion seconded by Alderman Naylor and carried. Moved by Alderman Williams that the Board of Aldermen authorize and order refund to M. Blank the sum of $10.00 paid on license 41-1 covering the operation of trailer camp; refunding conditioned on discontinuance of the operation of camrp license. a Motion seconded by Alderman Stampfli and carried. Bids on 6,000 barrels of cement for water construction improvement were opened, and tabulated. Moved by Alderman Naylor that the Board of Aldermen award 3,000 barrels of cement for water construction improvement to Rounds and Porter, and 3,000 barrels of cement to Long Bell Lumber Co., as the lowest and best bid, it being understood that these bids cover deliveries of cement until the completion of said construction. Bid prices as follows: Long Bell Lumber Co;, ;2.53 per bbl, less 100 per bbl. discount, 20 days. Rounds & Porter Lumber Co. , $2.53 per barrel less 10d per barrel discount, 20 days. i Motion seconded by Alderman Williams and carried. A citizen's petition was filed with the Board of Aldermen together with ordinances enforced in other cities, requesting the passage of an ordinance for the prevention of cruelty to animals. E Moved by Alderman Williams that the Board of Aldermen authorize the adjustment of delinquent personal and property taxes and settlement of same as set out in the following schedule. R E S O L U T I O N Sk f RPj1OLUTION AND ORDER OF THE CITY COCJNCIL OF THE CITY OF WICHITA s FALLS, TEXAS, AUTHORIZING AND ORDERING THE ABA WNNENT AND VACATION OF A PORTION OF AVENUE "0" IN SAID CITY AS ORIGINALLY SHOWN IN THE PLAT AND DEDICATION OF I THE HIGHLAND ADDITION TO THE CITY OF Z"TICHITA FALLS, TEXAS, AND AUTHORIZING THE CONSTRUCTION OF A CURB ALONG THE VEST SIDE OF SAD STREET IN THE W. E. WILSON E ADDITION TO THE CITY OF WICHITA FALLS, TEXAS, IMRIEDLATELY EAST AND ADJACENT TO THE PORTION OF AVENUE "0" VACATED AND ABANDONED. j On this the 8th, d6y;-of`-SeptemtW A. D. 1941, at a regular meeting of the Oity Council of the City of Wichita Falls, Texas, a full quorum of said Council being present and acting, came on to be heard the petition of Stephens & Truitt Company, a co-partnership composed of 0. G. 'itephens and George W. Truitt, re- questing the vacation and abandonment cf a part of Avenue 0 as shown in the Plat and Dedication of the Highland Addition to the City of Wichita Falls, Texas, that part of Avenue 0 sought to be vacated and abandoned^bein7 described as follows, to-wit: BEGINNING at the Northwest corner of said Lot 1, in said Block 4; Thence East along the North line of said Lot 1, 130 feet to the Northeast corner of same; Thence north 60 feet to the Southeast corner of Lot a 5, in Block 3, in said Addition; Thence West along the a South line of said Lot 130 feet to Southwest corner of the same; 'Thence south 60 feet to the Northwest corner of said lot 1, in said Block 4, the place of beginning; i and for authority to construct a curb along the West diide of Shepherd Street in said W. E. Wilson Addition, now being paved by petitioners, immediately East and adjacent to that part of Avenue 0 sought to be vacated and abandoned. And no opposition to said petition being presented or known, and it being considered by this Council that said petitioner, Stephens & Truitt Lumber Company, a co-partnership composed of the members aforesaid, are the owners of j Alot 5, in Block 3, of the W. E. Wilson Addition, and Lot 1, Block 4, of the W. E. Wilson Addition, and that said Lots are the only lots adjacent to the above described portion of Avenue 0 sought to be vacated and abandoned, and that such portion of Avenue 0 has never been opened, graded or used by the public; and that it will be detrimental to the lot owners in that vicinity to not vacate and abandon such portion of Avenue 0 in order that a curb may be placed along the j Zbst side of Shepherd Street immediately East o f the same, and that it will not I be detrimental to the rights and uses of the other property owners in that vicinity to vacate the above described portion of Avenue 0 and to permit said curb to be constructed along the West side of Shepherd Street adjacent thereto, the Council is of the opinion that the petition of the said Stephens & Truitt Lumber Company should be granted. Therefore, BE IT RESOLVED, AND ORDERED by the City Council of the City of Wichita Falls, Texas, that the petition of Stephens & Truitt Lumber Company, a co-partnership composed of 0. G. Stephens and George W. Truitt, for the vacation and abandonment of the above described portion of Avenue 0, and to permit and authorize said petitioners to construct a curb along the West side of Shepherd Street immediately East of said portion of Avenue 0., is hereby granted and authorized and the said Stephens & Truitt Lumber Company, a copartner- ship as aforesaid, is hereby authorized to construct such curb along the West i i 6 632 side of Shepherd Street at the place aforesaid and that said portion of Avenue 0 is hereby vacated and abandoned as a public street. Motion seconded by Alderman Naylor and carried with the following vote: Yeas: Aldermen Fitzpatrick, Naylor, Stampfli and Williams Nays: None. Moved by Alderman Fitzpatrick that ttLe Board of Aldermen authorize payment of $150.00 to Bill McKinley for change in right of way for road purposes serving Sheppard Field and Municipal Airport. Motion seconded by Alderman Stampfli and carried. Moved by Alderman Williams that the Board of Aldermen approve the payment of fee of ;100.00 for the City of Wichita Falls membership in the United States Conference of Mayors, year 1941. Motion seconded by Alderman Fitzpatrick and carried. Moved by Alderman Fitzpatrick that the Board of Aldermen approve payment of $22.50 per month office rent for the National Youth Administration of Texas through August 1941. Motion seconded by Alderman Stempfli and carried. Moved by Alderman Williams that the Board of Aldermen adjourn. i Motion seconded by Alderman Stampfli and carried. i The Board of Aldermen then adjouxned.
