Motion seconded by Alderman StanpM and carried. * * * * * * * * * * * ORDINANCE NO, 1317 AN ORDINANCE EXEMPTING FROM TAXATION FOR CITY PURPOSES THREE THOUSAND ($39000.00) DOLLARS OF THE ASSESSED TAXABLE VALUE OF ALL RESIDENCE HOMESTEADS AS NOW DEFINED BY LAW, LOCATED AND SITUATED WITHIN THE CORPORATE LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, FROM NOW AND AFTER THE 1ST DAY OF JAIv'UARY, A. D. 1934, PROVIDED THAT SUCH PROPERTY IS ACTUALLY OCCUPIED BY THE FAMILY CLAIMING SUCH EXEln>MCN AS A HOMESTEAD ON THE 1ST DAY OF JANUARY OF THE YEAR FOR ti1HICH SUCH EXEMPTION IS CLAIMED, AND PROVIDED THAT THE IERSON, OR PERSONS CLAIMING SUCH EXEMPTION SHALL HAVE RENDERED SAID PROPERTY CLAIMED AS A HOMESTEAD FOR TAXES, TOGETHER WITH ALL PERSONAL PROPERTY OWNED BY SUCH PERSON, OR PERSONS, WHICH SAID RENDITION SHALL BE MADE NOT LATER THAN APRIL 30TH OF EACH YEAR AND AT THE TILE- OF RENDERING SUCH PROPERTY THE SAID PERSON, OR PERSONS, SHALL CLAIM THE EXEMPTION PROVIDED FOR HERELN; AND PROVIDED FURTHER THAT SUCH HOMESTEAD EXEMPTION SHALL NOT BE GRANTED UNLESS AND UNTIL THE PERSON, OR EERSONS, CLAIMING THE SANE SHALL HAVE PAID ALL PERSONAL PROPERTY TAXES ASSESSED AGAINST HIM, OR THEM, ON THE T.X ROLLS OF THE CITY OF X CHITA FALLS, TEXAS, FOR THE YEAR IN WHICH SUCH HOMESTEAD EXEMPTION IS CLAIMED AND ALL PRIOR YEARS, AND REPEALING ORDINANCES NOS. 1167 AND 1269, BE IT OF.DAINED BY THE BOARD OF ALDERMEN OF THE CITrOF WICHITA FALLS, TEXAS. Nays: None. 519 R E S O L U T I O N r EREAS, the City of Wichita Falls, hereinafter referred to as the sponsor, has applied to the Government of the United States of America, through the Work Projects Administration, for a WPA project, Sponsors Serial Number 1-41, for the purpose of improvement of Kell Field Municipal Airport approximately 4 miles north City Limits of Wichita Falls, Wichita County, Texas, hereinafter referred to as the project, which, if such application is granted and said project is operated, will require the expenditure of a large amount in Federal funds; and, VtUFREAS, Federal funds may not be expended through the Work Projects Administration in the operation of such projects, which, when completed, will not be used in the general public interest and retained exclusively under the ownership, management, possession, and control of a public authority or political subdivision. NOW, THEREFORE, be it resolved `by the Board of Aldermen of the City of Wichita Falls, Texas: That W. E. Fitzgerald, Mayor, and J. H. Crouch, City Clerk, be and are hereby authorized and instructed to execute and attest ADM Forth 30 to the Works Projects Administration, for and on behalf of the City of Wichita Falls, the sponsor, and are hereby authorized to deliver these presents and any other data and information which may be necessary to fully advise the Works Projects Administration in completion of said WPA project Sponsors Serial No. 1-41,. In consideration of the premises and in order to induce the expenditure of Federal funds in the operation of the project, the City of Wichita Falls obli- gates and binds itself to the Government of the United States of America, as follows: 1. That the land on which the project is to be operated is owned by and is now in the exclusive possession of, the sponsor, and that the spon- sor will retain the exclusive ownership and possession thereof during the use- ful life of the project or any part thereof. 2. That the sponsor will not at any time during the useful life of the project or any part thereof, convey, lease, surrender possession of, or otherwise divest itself of the exclusive owmership, possession, control and management of the project to any person, association, organization or corpora- tion, and that it will devote the project to the public use without discrimina- tion. 3. That in the event of any breach by the sponsor of any obligation set forth in paragraphs numbered 1 b 2 above, it will forthwith return and refund to the Treasurer of the United States, upon demand by the Works Projects Administration, or other property agency of the Goverment of the United States of America, an amount of lawful money of the United States of America equal to the total amount of the Federal funds expended on the project. 4. That the Work Projects Administration is under no obligation to commence the project, nor to complete it if it is commenced, but should the Work Projects Administration commence the project, it will do so in reliance upon the representations and obligations herein set forth, and its commence- ment of the project will be ipso facto its acceptance of said representations and obligations. Moved by Alderman Williams that the foregoing resolution be adopted. Motion seconded by Alderman Naylor and carried by the following vote: Yeas: Aldermen Fitzpatrick, Hyer, Naylor, Stampfli, Williams and Wolf. Nays: None. f 520 Moved by Alderman Williams that the Board of Aldermen receive the tabulation of bids made by the City Manger under date of February 4th, for Park Department automotive equipment, and accept the bids of 1. 0. f Dotson, Inc. as the lowest and best bid, being for one - one and one half (1�) ton Ford Truck at $1,006.30, less old truck of $283.00 for a net price of $723.30 FOB Wichita Falls, said equipment being a cab and chassis I assembly. Motion seconded by Alderman Stampfli and carried. Petition of the Wichita Transit Corporation, by its Vice-President and General Manager, dated the 17th day of February 1941, requested designa- tion of new proposed routes for extension of its routes for bus service to, limits the City of Wichita Falls, was read by the City Clerk, and ordered filed. The Mayor deferred consideration of this petition. Moved by Alderman 'Wolf that the Board of Aldermen approve the payment of $2,865.44 to the Wichita General Hospital for January charity account, upon the payment of like sum by Wichita County. Motion seconded by Alderman Williams and carried. Moved by Alderman Naylor that the Board of Aldermen grant license to D. B. Abbott upon his application to operate a Minature Golf Course at 3006 Seymour Road. Motion seconded by Alderman Stampfli and carried. Alderman Williams not Toting. Moved by Alderman Wolf that the Board of Aldermen authorize the execution of contract or agreement between the City of Wichita Falls and Horne Film Co., Dallas, Texas, for the operation of free park motion picture shows during the 1941 summer season, contract to be approved by the City Attorney. Motion seconded by Alderman Fitzpatrick and carried. Moved by Alderman Naylor that the Board of Aldermen order paid to Ray Arnhold, Architect, the balance of $563.00 on fees accrued under agreement with Ray Arnhold for remodeling of the old Fire and Police Station. Motion seconded by Alderman Fitzpatrick and carried. 3 i 1 I 521 R E SO L U T I 0 N i Moved by Alderman Williams that the Board of Aldermen of the City of Wichita Falls authorize the execution for, and on behalf oft the City of WichitaFalls for that certain Works Progress Administration, Project Proposal, Sponsor's Proposal No. 1-41, and being a project for the improvement of Kell Field Airport to Class 4 rating, for the grading and drainage of field; surfacing of four runways, taxi-strips, and hangar aprons; installing daylight markers; installing boundary, range, contact, obstruction, and hangar apron lighting; sodding; constructing 6" water line to serve Airport; and other appurtenant work necessary for improving landing facilities, and further that W. E. Fitzgerald, Mayor of the City of Wichita Falls be authorized to execute such Project as the Sponsor's Agent, and that J. Bryan Miller, City Manager, be authorized to execute such project proposal as the fiscal officer of said City. Motion seconded by Alderman Naylor and carried. Moved by Alderman Williams that the Board of Aldermen of the City of Wichita Falls do hereby allocate and set aside to that certain project described in Works Progress Administration, Sponsor's Proposal No. 1-41, and entitled "Improvement of Kell Field Airport to Class 4 rating, for the grad- ing and drainage of field; surfacing of four runways, taxi-strips, and hangar aprons; installing'daylight markers; Installing boundary, range$ contact, obstruction, and hangar apron lighting; sodding; constructing 6" water line to serve Airport; and other appurtenant work necessary for im- proving landing facilities," all those certain funds, materials and equipment as set out in such Project Proposal, as the Sponsor's contribution, and 4 being a total amount of $43,245.009 and that such fund be allocated from and constitute a charge against the General and Water Funds of said City. Motion seconded by Alderman Naylor and carried. 9 i r Moved by Alderman Wolf that the Board of Aldermen authorize the payment by the City of Wichita Falls of policy premium for performance bonds of W. A. Lynn to the Home Owners Loan Corporation, and Y. B. Pearce to W. A. Lynn, to satisfy conditions necessary for the clearance of certain water plant improvement right of way. Motion seconded by Alderman Fitzpatrick and carried. S Moved by Alderman Williams that the Board of Aldermen authorize expenses paid of Mayor W. E. Youngfor many pears a resident and citizen - ] of Wichita Falls, and one of the outstanding pioneer characters of this section of the State was recently called by death; and, TMREAS, John T. Young invested his interests and energies in the development and progress of our City, and section throug h all the pears of his life, and espeeially in well serving his City in Positions of distinction as Commissioner and as Mayor; and, W EREAS, the citizenship at large honor and respect his life of service, and the Board of Aldermen officially recognize the invaluable contributions made by our fellow citizen and friend. NOW, THEREFORE, BE IT RESOLVED by the Board of Aldermen of the City of Wichita Falls, Texas, that the life of Tohn T. Young, his years of s service to our City and our section of the State, and his invaluable contributions be by this resolution officially memoralized, ani that this resolution be ordered spread upon the official records of the City of Wichita Falls, Texas, in honor, respect and memory of John T. L. Jackson, and leased or rented to T. V. Meaders and wife Leitha Meaders, the said Meaders having improvements and crops on said land approximating a value of $3,380; NOW, 'IHMEFORE, EE IT RESOLVED by the Board of Aldermen of the City of Wichita Falls, Texas, that Mayor W. E. Fitzgerald be authorized to execute for and on behalf of said City an ap-Teement or contract with the said Meaders providing for the purchase of the 1941 crop, and the right of possession of said lands, on the terms and conditions set out in said i i i j i 523 I i i I agreement or contract dated the 17th day of February A.
