Moved by Alderman11yer that the minutes of October 28th be approved as read. kotion seconded by Alderman Stampfli and carried. Moved by Alderman Fitzpatrick that the Board of Aldermen approve the payment of $25.00 attorney's fees to Leslie Humphrey for services rendered in the examination of instruments in connection with the Water System Improvement Revenue Bonds. Motion seconded by Alderman Williams and carried. ORDINANCE NO. 1311 AN ORDINANCE BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FAILS, TEXAS, RATIFYING AND APPROVING THE TRUST INDENTURE DATED AS OF THE FIRST DAY OF OCTOBER, 1940, EXECUTED BY THE T"AYOR AND ATTESTED BY THE CITY CLERK OF SAID CITY, TO SECURE PAYMENT OF $4009000.00 'CITY OF WICHITA FALLS, TEXAS, PA - MRKS SYSTEM JITROVEMENT REVENUE BONDS, ' DATED OCTOBER 1, 1940, AUTHORIZED AT THE ELECTION HELD IN SAID CITY ON THE 30TH DAY OF SEPTEMBER, 1938, FOR THE PURPOSE OF IMPROVING, ENLARGING, EXTENDING AND REPAIRING THE ITATERVORKS SYSTEM OF SAID CITY, AND WICH SAID TRUST INDENTURE WAS EXECUTED BY THE MAYOR AND CITY CLERK IN ACCORDANCE WITH ORDIIANCE NO. 1308, PASSED AND ADOPTED BY THE BOARD OF ALDERMEN ON THE 23RD DAY OF SEPTEMBER, 1940, RECORDED IN BOOK NO. 8, OF THE ORDINANCE RECORDS OF SAID CITY; APPROVING AND CONFIRI-IN G THE EXECUTION OF SUCH TRUST. INDENTURE BY THE MAYOR AND CITY CLERK, RESPECTIVELY, OF THE CITY OF VTCHITA FALLS, TEXAS; ENACTING PROVISIONS INCIDENT AND RELATING TO THE SUBJECT AND PURPOSE OF THIS ORDINANCE; AND DECLARING AN EMERGENCY." Nays: None. * * * * * * * * * * * Mayor Fitzgerald introduced Ordinance No. 1312, being a franchise for the operation of the City Waterworks System in accord- ance with the terms set out in Trust Indenture dated October 1, 1940, and said ordinance being read in full the Mayor called for public hearing on said ordinance as advertised and set by the terms thereof; Whereupon a public hearing on Ordinance No. 1312 was had. ORDINANCE N0. 1312 AN ORDINANCE BY THE BOARD OF ALDEMiN OF THE CITY OF WICHITA FALLS, TEXAS, EXPRESSLY GRANTING TO THE PURCHASER, OR PURCHASERS, OF THE WATERWORKS SYSTEM OF SAID CITY, THE EXCLUSIVE RIGHT, PRIVILEGE AND FRANCHISE TO OPERATE THE SAID SYSTEM, IN THE EVENT OF DMULT IN THE PAYMENT OF ALL, OR ANY PORTION, OF THE $400,000.00 'CITY OF WICHITA FALLS, TEXAS, IATERWORKS SYSM1 DPROVE16ENT REVENUE BONDS, ' DATED OCTOBER 11 1940, AUTHORIZED AT THE ELECTION HELD IN SAID CITY ON THE 30TH DAY OF SEPTEMBER, 1938, FOR THE PURPOSE OF IMPROVING, ENLARGING, ENDING AND REPAIRING THE "ATERXRKS SYSTEM OF SAID CITY, AND WjICH FRANCHISE SHALL, RUN FOR A TERM OF TVENTY YEARS FROM THE DATE THE PROPERTIES OF SAID VtATERWORES SYSTEM MAY BE ACaUIREDT BY SUCH PURCHASER, OR IURCHASERS, BY JUDICIAL SALE, OR OTRERWISE; AND ENACTING PROVISIONS INCIDENT AND RELATING TO THE SUBJECT AND PURPOSE OF THIS ORDINANCE. ORDINANCE NO. 1313 AN ORDINANCE CLOSING AND ABANDONING THE ALLEY SEPARATING LOTS 4, 5, 6, 7, 8, 9, and 10 IN BLOCK 57 OF THE ORIGINAL TOWN OF WICHITA FALLS, TEXAS, AND EX'I I DING FROM LIT COLN STREET TO NORTH BROOK AVENUE, AND RESERVING UNTO THE CITY OF WICHITA FALLS A RIGHT-OF-WAY AND EASE- 2 ELT FOR THE; LAYING OF A SEWER LINE WITH IHE RIGHT OF INGRESS AND EGRESS FOR THE REPAIRING AND MAINTAINING THE SAME. Moved by Alderman Naylor that Ordinance No. 1313 be passed on its third and final reading and approved as read. Motion seconded by Alderman Stampfli and carried with the following vote: Yeas: Layor W. E. Fitzgerald, Aldermen Fitzpatrick, Hyer, Naylor, Stampfli, Williams and Wolf. Naps: None. 475 A committee composed of Aldermen Williams and Wolf reported upon their investigation and recommended to the Board of Aldermen the reduction of all Riverside Cemetery lots now priced at 01.00 per square foot to a price of fifty cents (50¢) per square foot. bioved by Alderman Hyer that the recommendation of the committee be accepted and approved, and the committee discharged. Motion seconded by Alderman Naylor and carried. ORDINANCE NO. 1314 AN ORDINANCE LEVYING, ASSESSING, AND FIXING THE RATE OF TAXATION IN THE CITY 01, WiCHITA FAILS, TEXAS, FOR THE YEAR A. D. 1940, AND LEVYING AN OCCUPATION TAX ON ALL OCCUPATIONS TAXABLE UNDER THE LAWS OF THE STATE OF TEXAS AND THE CHARTER AND ORDINANCES OF SAID CITY. Moved by Alderman 'Wolf that Ordinance No. 1314 be passed on its second :reading. Motion seconded by Alderman Fitzpatrick and carried with the following vote: Yeas: Mayor W. E. Fitzgerald, Aldermen Fitzpatrick, Hyer, Naylor, Stampfli, Williams and Wolf. Nays: None. * * * * * * * * * * * Moved by Alderman Stampfli that the Board of Aldermen hereby approve and order the acquisition and payment of all right-of-way necessary incident to the construction and improvement of the Waterworks Plant and System, and further authorize the condemnation of any portion of such right-of-way which has not heretofore xmk been agreed upon; payment to be made upon the approval of title by the City Attorney.
