Min 09/30/1940 452 Wichita Falls, Texas September 30, 1940 Memorial Auditorium Building, On this the 30th day of September 1940, the Board of Aldermen of the City of Wichita Falls, Texas, convened in regular session in the Council Room in the Memorial Auditorium, the following members thereof, to-wit: W. E. Fitzgerald, Mayor J. W. Fitzpatrick, j W. Ralph Hyer, H. J. Naylor, Aldermen Jas. M. Williams, Frank Wolf, J. A. Giddings, Acting City Manager J. H. Crouch, City Clerk T. A. Hicks, City Attorney The minutes of the meeting of September 23rd were read. Moved by Alderman Fitzpatrick that the minutes of September 23rd be approved as read. Motion seconded by Alderman Williams and carried. ORDINANCE NO. 1309 AN ORDINANCE PROVIDING FOR THE REGISTRATION AND LICENSING OF BICYCLES; PROVIDING A FEE THEREFOR; PROVIDING FOR THE TAGGING AND IDENTIFICATION OF BICYCLES AND REGULATIONS THEREFOR; REGULATING ALL PERSONS ENGAGED IN THE BUSINESS OF DEALING IN SECOND-HAND BICYCLES; REQUIRING ALL BICYCLES RIDLEN BETI= THE HOURS OF SEVEN P. M. AND FIVE A. M. TO BE EQUIPPED WITH A REFLECTOR OR ELECTRIC HEADLIGHT ON THE FRONT AND A REFLECTOR ON THE REAR; PROVIDING A PENALTY FOR THE VIOLATION HEREOF; PROVIDING THAT THE INVALIDITY OF ANY PART HEREOF SHALL NOT AFFECT THE VALIDITY OF THE REMAINDER, AND DECLARING AN EMERGENCY. Moved by Alderman Hyer that Ordinance No. 1309 be passed on its second reading. Motion seconded by Alderman Fitzpatrick and carried with the following vote: Yeas: Fitzpatrick, Hyer, Naylor, and Wolfe Nays: Williams. * * * * * * * * * * Moved by Alderman Hyer that the Board of Aldermen accept and approve the bid of the Otis Elevator Company for dumb vaiter to be installed in the Wichita General Hospital, and further authorize the execution of service contract on same at the bid price of $144.00 per year, conditioned upon the acceptance and approval of the Otis Elevator Co., bid by the Wichita County for payment of 50% of the purchase price of the dumb waiter, and the service contract. Motion seconded by Alderman Naylor and carried. 4 t) Moved by Alderman Naylor that the Board of Aldermen authorize and approve the paving of Woodrow Street between Hamilton Boulevard and Cherokee Street on the following conditions: 1st. - The construction of a curb and gutter in ac^ordance with th9 City's general specifications. 2nd. - Use of such part of the present gravel base that is practical, and meets the City Engineer's specifications. 3rd. - 1/2" thick asphalt wearing surface similar to surface used on Dayton Street between Brook and Duval Streets. 4th. - The City to do necessary and ordinary grading, and the property owners to pay the cost of materials under WPA paving project. 5th. - Property owners agreeing to maintain paving at their own expense. Motion seconded by Alderman Hyer and carried. Property owners of Block 4 of the Tackson & Roberts Addition to the City of Wichita Falls, filed a petition with the Board of Aldermen requesting the closing of the alley lying between Britain Street on the Vest Harrison Street, on the East Ave I, on the North and the Lebus property on the South. This petition wps accepted and ordered filed and referred to the City Attorney for preparation of an Ordinance for the closing of said alley. i T. E. Hill and others requested the Board of Aldermen to modify a building permit for the construction of a frame building on the northeast corner of llth and Broad Street to allow the completion of a building at that location. The Board of Aldermen took the request under advisement and instructed that property owners objecting to the construct- ion of said building be notified that a hearing would be held on this reouest at the regular Council meeting October 7th. * * * * * * * * * * * Moved by Alderman Vhlf that the Board of Aldermen grant the reouest of property owners and residents of the Fairview Addition for the installation of 17 street lights as set out and located on plat attached hereto. NOW, THEREFORE, be it resolved that the Board of Aldermen of the City of WZcbita Falls, Texas; That W. E. Fitzgerald, M§ryor, and T. H. Crouch, City Clerk, be and are hereby authorized and instructed to execute and attest AIN Form 30 to the Works Projects Administration, for and on behalf of the City of Wichita l Falls, the sponsor, and are hereby authorized to deliver these presents and any other data and information which may be necessary to fully advise the Work Projects Administration in completion of said 'WPA project District Serial No, 7-1407. In consideration of the premises and in order to induce the expenditure of Federal funds in the operation of the project, the City of Wichita Falls obli— gates and binds itself to the Government of the United States of America as follows: 1. That the land on which the project is to be operated is owned by and is now in the exclusive possession of, the sponsor, and that the sponsor will retain the exclusive ownership and possession thereof during the useful life of the project or any part thereof,, 2. That the sponsor will not at any time during the useful life of the project or any part thereof, convey, lease, surrender possession of, or otherwise divest itself of the exclusive ownership, possession, control and management of the project to any person, association, organization or corporation, and that it will devote the project to the public use, without discrimination. 3. That in the event of any breach by the sponsor of any obliga— tion set forth in paragraphs numbered 1 or 2 above, it will forthwith return and refund to the Treasurer of the United States, upon demand by the 'Wbrk Projects Administration, or other proper agency of the Government of the United St~tes of America, an amount of lawful money of the United States of America equal to the total amount of the Federal funds expended on the project. 4. That the Work Projects Administration is under no obligation to commence the project, nor to complete it if it is commenced, but should the Work Projects Administration commence the project, it will do so in reliance upon the representations and obligations herein set forth, and its commencement of the project will be ipso facto its acceptance of said representations and obligations. Moved by Alderman Wolf that the City of Wichita Falls enter into a contract` with Joe X. Ward, employing him as supervisor for the construction of proposed water plant improvement at a fee of 3% of the final construction cost, based upon a construction period of 18 months, and authorize the Mayor to sign and execute such a contract with Joe 3. h`trd, Engineer . Motion seconded by Alderman Fitzpatrick and carried. Moved by Alderman Fitzpatrick that the Board of Aldermen approve payment �of $50.00 t'o A. P.- Rollins, Engineer of "Dallas, Texas, for services rendered in connection with plans for the construction of proposed water plant improvements. Motion seconded by Alderman Naylor and carried. Moved by Alderman Hyer that the Board of Aldermen authorize and approve the reconditioning of 39 Singer Sewing Machines at a bid price of $104.00 for use in the IPA Sewing Room Project. Motion seconded by Alderman Naylor and carried. Moved by Alderman Hyer that the Board of Aldermen accept and approve the findings of Appraisal Commissioners in the condemnation suit of the City of Wichita Falls vs Squire, for right-of-may for drainage 1 ditch, and order the payment of $175.00 to satisfy the judgment in said ca se. Motion seconded by Alderman Fitzpatrick and carried* R E S O L U T I O N NIEREAS, The City National Bank in Wichita :Falls, Texas, depositary of the City of Wichita Falls funds, has deposited in trust U3 th the First National Bank of Dallas, Texas, on Receipt No. 13370, $150,000.00 United States Treasury 1j% notes as security for the account of the City of Wichita Falls, Texas, and; WHEREAS, The City National Bank desires to withdraw the above described Treasury Notes and (qeposit in lieu thereof $l50j000.O0 United States Treasury 2% bonds due in 1953-1955, receipt for same to be issued by the First National Bank of Dallas, Texas. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, That the City Treasurer and the City Clerk be, and are hereby, authorized to accept as security of City of Wichita Falls funds 4 S !_; $150,000.00 United States Treasury Bonds maturing 1953-1955 on receipt of the First National Fi nk of Dallas, Texas, and surrender $1509000.00 United States Treasury 114 notes now on deposit, receipt No. 13370 of the First National Bank of Dallas, Texas. Fitzgerald to furnish any and all information necessary and required to the IATA officials for the completion of prr ject covering the construction of Community Recreational Building for Boys.
