Min 08/05/1940 420 Wichita Falls, Texas August 5, 1940 Memorial Auditorium The Board of Aldermen of the City of Wichita Falls met in regular session on the above date ht 8:00 o'clock P. M. in the Council Room of the Memorial Auditorium with the following members present: W. E. Fitzgerald, Mayor J. W. Fitzpatrick, W. Ralph Hyer, j H. J. Naylor, ( Adermen V. E. Stampfli, J. M. Williams, Frank Wolf, J. Bryan Miller, City Manager J. H. Crouch, City Clerk I T. A. Hicks, City Attorney i The minutes of the meeting of Tuly 29, 1940 were read. I Moved by Alderman Naylor that the minutes of July 29, be approved as read. Motion seconded by Alderman Stampfli and carried. I i - - - - - - - - - - - - G ORDINANCE N0. 1306 AN ORDINANCE CLOSING AND ABANDONING THAT PART OF MISSISSIPPI STREET FROM ITS INTERSECTION OF CHESTER STREET TO SWARTZ STREET AND THAT PART OF SWARTZ STREET EXTENDING FROM VIRGINIA AVENUE TO THE INTERSECTION OF MISSISSIPPI STREET, BOTH THE SAID STREETS BEING IN THE CITY OF WICHITA FALLS, TEXAS, AND BEING MORE PARTICULARLY DESCRIBED HEREINAFTER. Moved by Alderman Wolf that Ordinance No. 1306 be passed on its third reading, and adopted as read. Motion seconded by Alderman Fitzpatrick and carried with the following vote: Yeas: Aldermen Fitzpatrick, Hyer, Naylor, Stampfli, Williams and Wolf. Nays: None. Moved by Alderman Stampfli that the Board of Aldermen authorize the Morrison Supply Company of Wichita Falls to use Kentucky Avenue between Pecan Street and Barwise Street for the purpose of a warehouse yard until such time as the City, through its duly authorized officials shall by written notice to the Morrison Supply Company request the abandonment of the use of said Street by the Morrison Supply Company, and with the understanding and agreement that no build- ing or structure of any permanent nature be placed thereon, and further that if any building, structure or fence of any nature whatever be placed thereon the City of Wichita Falls shall be held harmless for any damage v&atsoever, and any such building, structure or fences shall be immediately removed by the Morrison Supply Co., upon written notice and request of the City. Motion seconded by Alderman Williams and carried. 421 Moved by Alderman Naylor that the Board of Aldermen grant the request of Dan B. McDowell for the issuance of a building permit for the construction of a temporary frame building at 1318 - llth Street, said building to be 8J feet from the property line on llth Street, and permit to issue only upon the written consent of property owners adjacent thereto. Motion seconded by Alderman Williams and carried. Architects submitted plans for new addition to the Kemp Public Library building, and discussed them with the Board. Moved by Alderman Williams that the Board of Aldermen authorize the advertising for bids on plans and specifications submitted by architects for new addition to Kemp Public Library building, bids returnable to the City Manager and the Kemp Public Library Board for tabulation and report to the Council. i Motion seconded by Alderman Naylor and carried. Moved by Alderman Wolf that the Board of Aldermen authorize the advertising for bids on plans and specifications submitted for improvement of the negro swimming pool, bids returnable to the City Manager for tabulation and report to the Council. Motion seconded by Alderman Hyer and carried. - - - -- - - - - - - - - Moved by Alderman Williams that the Board of Aldermen authorize the execution of the supplemental Works Progress Administration application for the operation of Sewing Room during the months of August and September 1940. Motion seconded by Alderman Fitzpatrick and carried. Moved by Alderman Wolf that the Board of Aldermen authorize the Junior Chamber of Commerce to use the Scotland Park Soft Ball Field for the purpose of a girl's soft ball tournament August 25th to September lst; the use of the field to include all cone-sions of any nature upon the following general conditions: First: That all ligitimate expenses for the operation and maintenance of the field, including all accounts incurred by the City of Wichita Falls shall be paid out of the first receipts accruing from the operation of the tournament, and any and all concessions. Second: After all legitimate expenses above referred to have been paid any profit or residue accrued from the tournament , and concessions, shall be divided on the basis of 60% to the Junior Chamber of Commerce and 40% to the City of Wichita Falls. Motion seconded by Alderman Naylor and carried. Motion seconded by Alderman Williams and carried. Mayor Fitzgerald appointed a committee composed of Aldermen Frank Wolf, W. Ralph Hyer, V. E. Stempfli as a right-of-way committee to survey and secure right of way necessary for the completion of the water plant project, reporting .to the City Council for final action and approval. City Attorney, T. A. Hicks, a v+ritten opinion with the .Board of Aldermen as follows: "You are advised that it is my opinion that the City Charter does not provide a method whereby you can execute a contract with Mr. W. E. Huff, which he has requested of the Council for the laying of a six inch water main extension on Wilson Street, from Van Buren to Brook, as I understand he desires to execute a simllar con- tract to the ones heretofore made for the laying of water lines." Moved by Alderman Wolf that the Board of Aldermen adjourn. Motion seconded by Alderman Fitzpatrick and carried. The Board of Alderman then adjourned.
