Min 07/15/1940 i Wichita Falls, Texas July 159 1940 Memorial Auditorium. The Board ofAldermen of the City of WichitaFalls met in regular session on the above date at 8:00 o'clock P. M. in the Council Room of the Memorial Auditorium with the following members present: W. Z. Fitzgerald, Mayor W. Ralph Hyer, U H. J. Naylor, Q Aldermen V. E. Stampfli, Q T. A. Hicks, City Attorney, Jas.A. Giddings , Representing City Manager J. H. Crouch, City Clerk The minutes of the meeting of July gth were read. Moved by Alderman Hyer that the minutes of July 8th be approved as read. Motion seconded by Alderman Stampfli and carried. Alderman Wolf came into the Council Room and took his regular seat at the Council Table. A written report was made by the Committee appointed to bring recommendations to the Board ofAldermen of the City of Wichita Falls relative to collection and disposal of trash and garbage in the City Limits , and was read by Alderman Hyer, Chairman of the Committee. Moved by Alderman Stampfli that the Board of Aldermen receive and approve the report on collection and disposal of trash and garbage within the City Limits of Wichita Falls . ldotion seconded by Alderman Hyer and carried. Mayor Fitzgerald requested the City Attorney to prepare an ordinance incorporating recommendations of the Committee' s report on the collection and disposal of trash and garbage. Bids for the printing of codified ordinances of the City of Wichita Falls were read to tbecouncil. Moved by Alderman Wolf that the Board ofAldermen accept and approve the lowest and best bid of the printing of the codified ordi- nances of the City of WichitaFalls, - the bid of Terry Brothers in the amount of $64.5,00 for 300 loose leaf books. Motion seconded by Alderman Naylor and carried. Alderman Fitzpatrick came into the Council Room and took his seat at the Council Table. i i Moved by Alderman Naylor that the Board of Aldermen approve a written contract dated the 15th day of July 1940, by and between the City of Wichita Falls and the Wichita Falls Soft Ball Association, setting out the terms and conditions under which a soft ball league in Scotland Park shall be operated, and authorize Mayor Fitzgerald to execute same on behalf of the City. ` Motion seconded by Alderman Wolf and carried. ORDINANCE N0. 130t� AN ORDINANCE AMENDING SECTION 9 AND SECTION 11 OF ORDINANCE NO. 538 PASSED AND APPROVED ON THE 15th DAY OF SEPTEMBER, A. D. , 1924, AN AMENDED ORDINANCE NO. 1144, PASSED AND APPROVED THE 25TH DAY OF MARCH 19352 ENTITLED "AN ORDINANCE CREATING AN OFFICE OF ELECTRICAL INSPECTOR REGULATING THE WAY AND MANNER IN WHICH ELECTRICAL WIRES AND APPARATUS SHALL BE INSTALLED IN THE CITY OF WICHITA BALLS, TEXAS, AND PROVIDING FOR THE GENERAL INSPECTION OF SUCH WORK, PROVIDING FOR THE ISSUANCE OF LICENSES AND PERMITS,PROVIDING FOR FEES TO BE CHARGED FOR DOING OF SUCH WORK, REPEALING ALL ORDINANCE AND PARTS OF ORDINANCE IN CONFLICT HEREWITH, PROVIDING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE. Moved by Alderman Stampfli that the Board ofAldermen postpone consideration of the proposed Ordinance No. 130JP. ,.Motion seconded by Alderman Hyer and carried. Moved by Alderman Hyer that the Board of A14e3 exn of the City of Wichita Falls authorize the approval -I� d on behalf of the City of Wichita Falls by Mayor W. E. Fitzgerald of all plans and specifications which may be necessary or re- quired by the Texas Highway Department, or Federal Government of the United States of America, for the completion of project to construct an Underpass known as the Lincoln Street Underpass. Motion seconded by Alderman Stampfli and carried. Moved by Alderman Wolf that the Board of Aldermen authorize the construction of a bath house , water pump, etc. , necessary for the operation of a swimming pool for negros located on City property adjacent to Lincoln Park. Said installation to be at a cost not to exceed $500,00, and further authorize Mayor W. E. Fitzgerald to execute a contract on behalf of the City of Wichita Falls to the management of said negros swimming pool, sett- ing out terms and conditions under which the pool is to be operated, and the handling and distribution of revenue accrued. Motion seconded by Alderman Naylor and carried. Moved by Alderman Hyer that Jas. A. Giddings be appointed Acting City Manager during the absence ofCity Manager Miller in Washington, D. C. Motion seconded by Alderman Stampfli and carried. Mayor W. E. Fitzgerald instructed the City Attorney to investigate and bring a report to the Board of Aldermen on the claim of Claude Fincher, Jr. Moved by Alderman Naylor that the Board of Aldermen refuse the request of the Wichita Tent & Awning Co. , to install stationary canopy on the front of the Scott Street Cafe at 715 ScottStreet , and extending to one foot of the curb line. Motion seconded by Alderman Wolf and carried. The Texas Electric Service Company filed a written petition with the Board of Aldermen praying for the abandonment of a part of certain streets adjacent to their plant property. This request was referred by the Mayor to the City Attorney, with instructions to prepare an ordinance closing parts of streets set out in petition by the Texas Electric Service Company. Mayor W. E. Fitzgerald referred to the City Attorney for investigation and a report of claim filed by Leonard Aldridge in the sum of $22.00 for alleged damages to his automobile. RESOLUTION OF MUNICIPALITY REGARDING TRAFFIC REGULATION ON FEDERAL HIGHWAY WHEREAS , the State Highway Department of the State of Texas is desirous of constructing U.S. Highway No. 82 & 277 through the City of Wichita Falls over 5th Street from Van Buren Street to the West City Limits ; and, WHEREAS, the State Highway Department is desirous of receiving Federal Aid for the improvement of said highway; and, WHEREAS, the Public Roads Administration of the Federal Works Agency of the United States of America will not participate in the con- struction of said highway until and unless the City of Wichita Falls will agree to refrain from permitting encroachments upon the right- of-way of said above mentioned streets, and until and unless the City of Wichita Falls will a:-ree to refrain from passing ordinances or laws fixing a speed limit of under twenty miles per hour on said above mentioned streets, and until and unless the City of WichitaFalls will agree to refrain from erecting signs, semaphores, azd signals that will give preference to local routes or that will hinder or delay traffic on said above mentioned streets. THEREFORE, be it resolved by the City Council of the City ofWichita Falls that, for and in consideration of the State Highway Department of theState of Texas and the Public Roads Administration of the Federal Works Agency of the United States of America constructing said Highway No•8? & 277 through the City of Wichita Falls over 5th street from Van Buren to West City limits , it hereby agrees with the State Highway Department of the State of Texas and the Public Roads Administration of the Federal Works Agency of the United States of America that it will not, in the future, permit encroachment on the right-of-way of said above men- tioned streets ; nor will it pass an ordinance or laws fixing a speed lim(bt on the above mentioned streets of under twenty miles per hour, nor will it allow the erection of signs, semaphores, and signals that will give preference to local routes which intersect with said mentioned streets nor that will slow up, hinder, or delay traffic on said above mentioned streets; nor will it repeal or amend any of the provisions of this reso- lution without the consent of the State Highway Commission. Moved by Alderman Hyer that the foregoing resolution be adopted. Motion seconded by Alderman Naylor and carried with the following votes: Yeas: Aldermen Hyer, Naylor, Stampfli, Wolf and Fitzpatrick. Nays : None AGREEMENT BY MUNICIPALITY OR POLITICAL SUBDIVISION TO MAINTAIN HIGHWAYS IMPROVED UNDER PROVISIONS OF FEDERAL HIGH,'iAY ACT AS AMENDED AND SUPPLEMENTED. The City of Wichita Falls , State of Texas, herein- J after referred to as City of Wichita Falls, and the Texas Highway Department, hereinafter referred to as the Highway Department, hereby agree as follows: 1. That the Highway Department will submit a project for the improvement of miles of the Municipal highway from Van Buren Street to West City Limit, known as 5th Street, and to be designated as U. S. Hwy. 82 & 277 project No. FAP 432-D ( 2) , and will recommend its approval by the Administi=ator of the Federal Works Agency for construction with funds apportioned to the State under the Federal Highway Act as amended and supplemented; subject, however, to the condition that the City of Wichita Falls, shall pro- vide for its proper maintenance after completion of its improve- ment. 2. That the said City of Wichita Falls hereby requests the Highway Department to submit the aforementioned project with recommendation that it be approved by the Administrator of the Federal Works Agency, and agrees that if such project is approved and constructed by the Highway Department and the Administrator of the Federal Works Agency it thereafter, at its own cost and ex- pense, will maintain the project in a manner satisfactory to them, of their authorized representatives, and will make ample provision each year for such maintenance. Moved by Alderman Hyer that the Board of Aldermen approve and authorize the execution of the foregoing agreement. Motion seconded by Alderman Naylor and carried. Moved by Alderman Wolf that the Board of Aldermen adjourn. Motion seconded by Alderman Fitzpatrick and carried. The Board of Aldermen then adjourned. PASSED AND APPROVLD this the 22nd day of July, A.
