The Board of Aldermen of the City of Wichita Falls, met in regular session
on the above date at 8:00 o'clock P. M. in the Council Room of the Memorial Audi-
torium with the following members present:

The minutes of the meeting of May 13, 1940 were read.
Moved by Alderman Williams that the minutes of the meeting of May 13th,
be approved as read.
Motion seconded by Alderman Wolf and carried.
Moved by Alderman Williams that the Board of Aldermen authorize the execu-
tion of contract between the City of Wichita Falls and J. T. Harrell covering
the installation of sanitary sewer outfall line from the present septic tank or
disposal plant tr the Wichita River, through the Park area west of the City Limits,
at an estimated cost to the City of $815.40.
Motion seconded by Alderman Naylor and carried.
Moved by Alderman Nayler that the Board of Aldermen reject the offer of
W. B. Chauncey to compromise and settle an outstanding contract between the City
of Wichita Falls and W. B. Chauncey for Teter mains outside of the City Limits on
Hiawatha Street.
Motion seconded by Alderman Stamnfli and carried.
Moved by Alderman Wolf that the Board of Aldermen of the City of Wichita
Falls hereby approve the A. C. Estes resubdivision of Lots 1 to 12 of the Mytinger
& Walker's subdivision of Lots 14 to 23 inc. of Block D of Wyatt's Southside
Addition to the City of Wichita Falls, Texas. Map and plat of which is attached
hereto and made a part of these records.
Motion seconded by Alderman Naylor and carried.
I'JoVed by Alderman Wolf that the Board of Aldermen and the
Council set and call for a public hearing at the regular session May 27th, I
flar proposals for the removal and disposal of trash and garbage by L. B. Greene
and others.
Motion seconded by Alderman Naylor and carried.
A committee representing the Parent-Teachers Association of
Carrigan School filed a petition requesting the installation of stop and go
electric signals at the corner of Holliday and Blonde Streets. The petition
was received and ordered filed, and the Mayor requested that an investigation
and written report by the City Manager be made at the next regular meeting.
E. L. Wahl and others filed a petition with the Board of Alder-
men requesting the passage of an ordinance regulating cats, similar to the
ordinance controlling and regulating dogs. This petition was received and
ordered filed by the Mayor.
Moved by Alderman Thblf that the Board of Aldermen authorize
and order adjustment of personal and property taxes and settlement of same
as set out in the following schedule:

R E S O L U T I O N
WHEREAS, the City of Wichita Falls, hereinafter referred to as the
sponsor, has applied to the Government of the United States of America, through
the Works Project Administration, for a WA project, District Serial Number
7-1298, for the purpose of Construct facilities for the social and recreational
activities of the women of the City of Wichita Falls, in Wichita Falls, Wichita
County, Texas, hereinafter referred to as the project, which, if such application
is granted and said project is operated, will require the expenditure of a large
amount in Federal funds; and,
WHEREAS, Federal funds may not be expended through the ibrk Projects
Administration in the operation of such projects, which, when completed, will not
be used in the general public interest and retained exclusively under the owner-
ship, management, possession, and control of a public authority or political sub-
division.
NOW, THEREFORE, be it resolved that the Board of Aldermen of the City
of Wichita Falls, Texas:
That W. E. Fitzgerald, Mayor, and J. H. Crouch, City Clerk, be and are
hereby authorized and instructed to execute and attest Affi° Form 30 to the Works
Project Administration, for and on behalf of the City of Wichita Falls, the sponsor,
in consideration of the premises and in order to induce the expenditure of Federal
funds in the operation of the project, obligates and binds itself to the Government
of the United States of America, as follows:
1. That the land on which the project is to be operated is owned by
and is now in the exclusive possession of, the sponsor, and that the sponsor will
retain the exclusive ownershipand possession thereof during the useful life of the
project or any part thereof.
2. That the sponsor will not at any time during the useful life of
the project or any part thereof, convey, lease, surrender possession of, or other-
wise divest itself of the exclusive ownership, possession, control and management of
the project to any person, association, organization or corporation, and that it
will devote the project to the publis use, without discimination.
3. That in the event of any breach by the sponsor of any obligation
set forth in paragraphs numbered 1 or 2 above, it will forthwith return and refund
to the Treasurer of the United States, upon demand by the Work Projects Administra-
tion, or other proper agency of the Government of the United States of America, an
amount of lawful money of the United States of America equal to the total amount of
the Federal funds expended on the project.
4. That the Works Project Administration is under no obligation to
commence the project, nor to complete it if it is commenced, but should the Works
Project Administration commence the xmoject, it will do so in reliance upon the
representations and obligations herein set forth, and its commencement of the
project will be ipso facto its acceptance of said representations and obligations.

NOW, TfUREFORE, be it resolved that the Board of Aldermen of the
City of Wichita Falls, Texas:
That Mayor W. E. Fitzgerald, be, and is, hereby authorized to answer
by letter, furnishing information and explanation requested in the above mentioned
correspondence to the IPA officials. A copy of correspondence hereunder author-
ized hereto, and made a part hereof.

WHEREAS, The Texas State Highway Department will submit a project
for the improvement of the Feeder Highway from Scott Street to Arkansas Street,
known as Lincoln Street, to be designated F.A.G.M. project No. 88 A, and will
recommend its approval by the Secretary of Agriculture for construction with funds
apportioned to the State under the Emergency Relief Appropriation Act of 1935;
subject, however, to the condition that the City of Wichita Falls shall provide
for its proper maintenance after completion of its improvement; and,
WHEREAS, it would be for the best interest of the City of Wichita
Falls to provide for the maintenance of the above mentioned Feeder Highway after
its completion.
NOW, THEREFCRE, be it resolved that the Board of Aldermen of the
City of Wichita Falls, Tex-,_s:
That W. E. Fitzgerald, Mayor, be and is hereby authorized to execute
an Erpreement by and `etween the City of Wichita Falls and the St7-te of Texas, State
Highv.,ay ?)epartment, whereby the City of Wichita Fells a-trees to maintain the above
mentioned Feeder Highway after its completion, and further authorizes J. t'. Crouch,
Cit« Clerk, to attest said agreement, and deliver same to the Texas State Highway
Department.

WFIEREAS, The State Highway Department of the State of Texas is desirous
of constructing Feeder Highway through the City of Wichita Falls over Lincoln
Street; and,
WHEREAS, the State Highway Department is desirous of receiving Federal
Aid for the improvement of said highway; and,
WHEREAS, the Bureau of Public Roads of the Department of Agriculture of
the United States of America will not participate in the construction of said highway
until and unless the City of Wichita Falls will agree to refrain from Permitting
encroachments upon the right-of-way of --aid above mentioned streets, and until and
unless the City of Wichita Falls will agree to refrain from passing; ordinances or laws
fixing a speed limit of under twenty miles per hour on said above mentioned streets,
and until and unless the City of Wichita Falls will agree to refrain from erecting
signs, semaphores, and signals that will give preference to local routes or that will
hinder or delay traffic on said above mentioned streets.
THEREFORE, be it resolved by the Board rf Aldermen of the City of Wichita
Falls that, for and in consideration of the State Highway Department of the State
of Texas and the Pureau of Public Roads of the Department of Agriculture of the
United States of America constructing said Hiphv?ay No. Feeder through the City of
Wichita Falls over Lincoln Street, it hereby agrees with the State Highway Department
of the State of Texas and the Bureau of Public Roads of the Department of Agriculture
of the Uni ed States of America that it will not, in the future, permit encroachment
on the right-of-way of said above mentioned streets; nor will it pass an ordinance
or laws fixing a speed limit on the above mentioned streets of under twenty miles per
hour, nor will it allow the erection of signs, semaphores, and signals that will give
preference to local routes which intersect with paid above mentioned streets nor that
will slow up, hin-ler, or delay traffic on said above mentioned streets; nor will it
repeal or amend any of the provisions of this resolution without the consent of the
State Highway Commission.
Loved by Alderman Williams that the foregoing resolution be adopted.
Motion seconded by Alderman Stampfli and carried by the following vote:
Yeas: Aldermen Hyer, Naylor, Stampfli, Williams and Wolf.
Nays: None.
Moved by Alderman Naylor that the Board of Aldermen authorize the
execution of contract by and between the City of Wichita Falls and William E. Huff
for the construction of sewer extension to properties now under construction on
Shaw Street between Harrison and Van Buren at an estimated cost of $517.80 to be
advanced by Mr. Huff and repaid to him by the City over a period of five years at
the rate of 20% ner year without interest.
Motion seconded by Alderman Williams and carried.

installation of a retail gasoline pump JA parkway at 1105 Indiana Avenue, with
the understanding that this Pump will be removed at any time at the request of
the City.
