The Board of Aldermen of the City of Wichita Falls, met in regular session
on the above date at 8:00 o'clock P. M. in the Council Room of the Memorial Auditorium
with the following members present:

The minutes of the meeting of April 29, 1940 were read.
Moved by Alderman Wolf that the minutes of the meeting of April 29th, be

Motion seconded by Alderman Hyer and carried.
ORDINANCE N0. 1302
CLOSING AND ABANDONING THAT PORTION OF WASHINGTON STREET ADJACENT TO AND
SEPARATING BLOCKS THIRTY-FOUR AND FORTY-NINE OF THE ORIGINAL MMSITE OF WICHITA
FALLS, TEXAS, FROM THE EAST BOUNDARY LINE OF SCOTT STREET TO THE WEST BOUNIlARY LINE
OF THE FORT 4WRTH AND DENVER CITY RAILWAY COMPANY RIGHT-OF-WAY; SAID PORTION (F
WASHINGTON STREET BEING MORE PARTICULARLY HEREINAFTER DESCRIBED, AND THE CLOSING
AND ABANDONING OF INDIANA AVENUE FROM THE NORTH BOUNDARY LINE OF LINCOLN STRE_+T TO
THE INTERSECTION OF INDIANA AVENUE WITH THE WEST AND NORTH BOUNDARY LINES OF THE
FORT WORTH AND DENVER CITY RAILWAY COMPANY RIGHT-OF-WAY; SAID PORTION OF INDIANA
STREET BEING MORE PARTICULARLY HEREINAFTER DESCRIBED, AND THE CLOSING AND ABANDONING
THAT PART OF THE ALLEY RUNNING THROUGH BLOCK THIRTY-FOUR OF THE ORIGINAL TOVXSITE OF
WICHITA FALLS, TEXAS, AND LYING NORTH OF THE NORTH BOUNDARY OF WASHINGTON STREET
THROUGH BLOCK THIRTY-FOUR AS HEREINAFTER DESCRIBED, AND DECLARING AN EMERGENCY.
Moved by Alderman Williams that Ordinance No. 1302 be passed on its second
reading.
Motion seconded by Alderman Naylor and carried by the following vote:
YEAS: Aldermen: Hyer, Naylor, Stampfli, Williams and Wolf.
NAYS: None.
Moved by Alderman Naylor that the rule requiring ordinances to be read on
three separate days be suspended and an emergency declared and Ordinance No. 1302
be passed on its third and final reading, and be adopted as read.
Motion seconded by Alderman Naylor and carried by the following vote:
YEAS: Aldermen: Hyer, Naylor, Stampfli, Williams and Wolf.
NAYS: None.

The Board heard W. B. Chauncey in a proposal to settle and dis-
charRe the City's obligation under a water main contract dated October 24,
1923 for an adjusted sum of $1250.00. The Mayor deferred consideration
of this offer.
Moved by Alderman Wolf that the Board of Aldermen authorize and
order adjustment of personal and property delinquent taxes and settlement
of same as outlined in the following schedule:

Moved by Alderman Naylor that the Board authorize the Mayor to
sign a contract with Shem Cunningham, bearing date of April 30, 1940, allowing
the use of a portion of Lakeview Cemetery for grazing purposes, and in connection
with this contract ordered the Clerk to notify Cunningham that the contract for
grazing will be terminated by the City ninety (90) days from the date of the
contract.
Motion seconded by Alderman Williams and carried.
Moved by Alderman Naylor that the Board of Aldermen refuse the
offer to purchase the triangle between sixth street and Highway 30 and Block
234 the Original Townsite.
Motion seconded by Alderman Stampfli and carried.
Moved by Alderman Naylor that the Board hereby approve the proposed
resubdivision by the A. C. Realty Co., Lot 14 to 23 inclusive of the Mytinger
& Walker subdivision in Block D of the Wyatt Southside Subdivision.
Motion seconded by Alderman Hyer with the following result:
YEAS: Aldermen Naylor and Hyer
NAYS: Aldermen Williams, Stampfli and Wolf.
Moved by Alderman Williams that the Board approve the payment of
the final estimate in the sum of $473,08 on the City's portion of the contract
for the construction of an addition to the Wichita General Hospital, except and
less the sum of $100.00 to be withheld until final inspection and approval by
the Architect and City Building inspector.
Motion seconded by Alderman Naylor and carried.
Moved by Alderman Wolf that the Board authorize payment in the sum
of $659.04 to the Wichita General Hospital for the City's portion of the deficit
for the month of April, upon the payment of like sum by Wichita County.
Motion seconded by Alderman Stampfli and carried.
Moved by Alderman Naylor that the Board authorize W. E. Fitzgerald
to execute for and on behalf of the City of Wichita Falls, a certain easement to
the State of Texas for the purpose of building and maintaining a temporary tracks
to be used during the construction of the Lincoln Street Underpass, and a certain
easement to the Fort Worth & Denver City Railway Co., to lay and construct the
necessary track, or tracks, on and across a strip of land 25 feet wide out of
Lts 1 to 9 inclusive of Block 76 Original Townsite. Said easement to remain in
full force and effect so long as the Railway Company desires to, and does, use the
same in connection with the operation of a switchback track.
Motion seconded by Alderman Stampfli and carried.
Moved by Alderman Naylor that the Board approve the payment of $185
contract price recommended by the City Manager for the removal of surplus trash
and debris from the City to the dump grounds.
Motion seconded by Alderman Stampfli and carried.

Moved by Alderman Wolf that the Board approve and allow
the use of the Municipal Auditorium by Federal Agencies on May 20th,
without charge, for the purpose of public showing and display of the
work and products of the several agencies.
Motion seconded by Alderman Naylor and carried.
Moved by Alderman Williams that this regular meeting be
adjourned until 8:00 P. M. Monday May 20, 1940.
Motion seconded by Alderman Naylor and carried.
The Board of Aldermen then adjourned.
