Min 04/22/1940 351 1 Wichita Falls, Texas Memorial Auditorium Building April 22, 1940 The Board of Aldermen of the City of Wichita Falls met in regular session on the above date at 8:00 o'clock P. M.-in the Council. Room of the Memorial Auditorium with the following members present: W. E. Fitzgerald, Mayor W. Ralph Hyer ) H. T. Naylor ) Aldermen V. E. Stampfli ) Jas. M. Williams) - J. Bryan Miller, ,City Manager J. H. Crouch, City Clerk T. A. Hicks, City Attorney The minutes of the meeting of April 15th were read. Moved by Alderman Williams that the minutes of April 15th be approved as read., Motion seconded by Alderman Stampfli and carried. Moved by Alderman Stampfli that the contract proposed by L. B. Green for the removal and collection of trash and garbage in the City be rejected. There being no second the Mayor ruled the motion lost. ORDINANCE NO. 1301 AN ORDINANCE GRANTING THE RIGHT, PRIVILEGE AND FRANCHISE TO THE FORT WORTH & DENVER CITY RAILWAY COMPANY, ITS SUCCESSORS, LESSEES AND ASSIGNS TO CONSTRUCT, MAINTAIN AND OPERATE A SWITCHBACK TRACK CROSSING INDIANA STREET, WICHITA STREET AND ALLEY WAY RUNNING EAST AND WEST THROUGH BLOCK SEVENTY-SIX, ORIGINAL TOWNSITE OF WICHITA FALLS, AND BEING MORE PARTICUI ARLY SHOWN ON BLUE PRINT ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A" SHORING SAID RIGHT-OF-WAY TRACK, FOR A PERIOD OF TWENTY-FIVE YEARS. Moved by Alderman Hyer that Ordinance No. 1301 be passed on its third reading and adopted as read. Motion seconded by Alderman Stampfli and carried with the following vote: Yeas: Aldermen Hyer, Naylor, Stampfli and Williams. Naps: None. Moved by Alderman Williams that the Board`of Aldermen accept and approve the bid of Dotson-Morgan Motor Company for five gspecially equiped police cars and the bid of Fox-Randel Motor Company for automotive units for the Engineering I 1 i E i Department, Park Department, Fire Department and Street Department as the lowest and j best bids. Motion seconded by Alderman Hyer and carried. e Moved by Alderman Williams that the Board of Aldermen authorize the Mayor to execute and sign and the City Clerk to attest for and on behalf of The City a contract dated the 18th day of April, A. D. 19409 by and between The City of Wichita Falls, Texas, and Crummer & Company, Inc., of Dallas, Texas, Fenner & Beane of New York, and Campbell, Phelps & Company, Inc., of New York, and associates, for the refunding of all of the outstanding bonds of the City described as The City of Wichita Falls Consolidated Refunding Bonds, dated June 1, 1936, maturing June 1, 1969, the amount of said bonds being $3,185,000, on the terms and conditions set out in said contract. Motion seconded by Alderman Hyer and carried. RESOLUTION RESOLUTION PROVIDING FOR THE REDkZP `ION OF $3,185,000 CONSOLIDATED REFUNDING BONDS OF THE CITY OF WICHITA FALLS, TEXAS, DATED JUNE 1, 1936. BE IT RESOLVED by the Board of Aldermen of the City of Wichita Falls, Texas, as� follows: declare that: Section 1. The Board has ascertained and determined and does hereby (a) Under the authority of Ordinance No. 1251, passed and approved on the 3rd day of May, 1937, $3,389,500 Consolidated Refunding Bonds were duly issued by the City of W-_chita Falls, consisting of 105 bonds of $500 each and 3,337 bonds of $1,000 each, dated June 1, 1936, maturing on June 1, 1969, bearing interest at the rate of 3-1/2% per annum from the date to June 1, 1938, et the rate of 4% per annum from said last named date to June 1, 1941, at the rate of 4-1/4o per annum from said last named date to June 1, 1946, and at the rate of 4=1/2% per annum from said last named date until paid, such interest being payable semi-annually on the first days of June and December of each year. (b) $204,500 of said Consolidated Refunding Bonds have heretofore been paid and discharged, leaving $3,185,000 of said bonds now outstanding and unpaid. (e) All of said outstanding $3,185,000 Consolidated Refunding Bonds may be redeemed in whole or in part on any interest payment date by the payment of the face amount of the bond or bonds so redeemed together with accrued interest upon notice as provided in said Ordinance No. 1251. (d) Inasmuch as the sinking fund for said Consolidated Refunding Bonds has moneys available sufficient to redeem $35,000 of said bonds and it is the intention of the Board of Aldermen to authorize and issue Refunding Bonds for the ,^ purpose of refunding the remaining $3,150,000 Consolidated Refunding Bonds and as said Refunding Bonds are to be issued bearing a lower rate or rates than the'rates or average rates of said Consolidated Refunding Bonds, it is deemed for the best interests of the City to call for redemption on June 1, 1940, all. of the outstanding $3,185,000 Consolidated Refunding Bonds dated June 1, 1936. Section 2. Therefore, all of said outstanding $3,185,000 Consolidate Refunding Bonds, dated June 1, 1936, are hereby called for redemption on June 1, 1940, and the City Clerk is hereby directed to publish notice of the redemption of said bonds once in The New York Times, a newspaper of general circulation published in the City of New York and once in The Daily Bond Buyer, a financial journal published and circulated in the State of New York and carrying as a part of its regular service 1\ 3 notices of sales of municipal bonds and which has a circulation among financial institutions inat least fifteen states including the State of New York, such publication to be made no later than April 30, 1940, which said notice of redemp- tion shall be in substantially the following form: REDEMPTION NOTICE $3,185,000 CITY OF WICHITA. No interest accruing on said bonds after June 1, 1940, will be paid. Coupons maturing June 1, 1940, and prior thereto will be paid upon the presentation and surrender of such coupons. Moved by Alderman Stampfli that the Board approve and authorize the payment of legal fee in the sum of $500 to A« H. Brittain, attorney, for investigating and preparing an opinion on permanent water rights, so-called, to be affected by the purposed by-pass canal for irrigation water at Lake Wichita. Motion seconded by Alderman Williams and carried. Moved by Alderman Stampfli that the Board of Aldermen adjourn. Motion seconded by Alderman Naylor and carried. The Board of Aldermen then adjourned.
