Memorial Auditorium Building
April 8, 1940
The Board of Aldermen of the City of Wichita Falls met in regular
session on the above date at 8:00 o'clock P. M. in the Council Room of the Memorial
Auditorium with the following members present:
W. E. Fitzgerald, Mayor
E. A. Bebb, )
H. J. Naylor,
J. W. Fitzpatrick, Aldermen
Jas. 11. Williams )
7. Bryan Miler, City Manager
J. H. Crouch, City Clerk
Thelbert Martin, Assistant City Attorney
The minutes of the meeting of March 25th were read.
Moved by Alderman Fitzpatrick that the minutes of the meeting of
March 25th be approved as re.2d.
Motion seconded by Alderman Bebb and carried.
RESOLUTION
WEREAS, at a regular meeting of the board of Aldermen of the
City of Wichita Falls held at the regular meeting place in the Council Room of the
Memorial Auditorium Building in said City on the 8th of April, 1940, at which a
quorum was present, came on to be considered the returns of the city election held
on April 2, 1940, for the purpose of electing a Mayor and three aldermen for said
City, and
WHEREAS, after canvassing the returns of said election it was found
to be duly and legally held in all respects, and there were cast at said election
2,982 votes for the election of the Mayor and three aldermen and that,
For Mayor
W. E. Fitzgerald received 1,840 votes
Otto Stehlick received 1,124 votes
John Sewell received 1 vote
For Alderman Place No. 4
W. Ralph Hyer received 2,877 votes
For Alderman Place No. 5
H. J. Naylor received 29874 votes
For Alderman Place No. 6
Frank Wolf received 2,876 votes
J. L. Elam received 1 vote
Phil Carrigan received 1 vote
Joh. Workman received 2 votes
And it appearing that W. E. Fitzgerald received the greatest number
of votes cast at said election for Mayor, that W. Ralph Hyer received the greatest
number of votes cast at said election fdr Alderman Place Number Four, that H. J.
Naylor received the greatest number of votes cast at said election for Alderman
Place Number Five and that Frank Wolf received the greatest number of votes cast
at said election for Alderman Place Number Six;

NOW, THEREFORE, BE IT RESOLVED BY THE' BOARD OF ALDERMEN OF THE CITY
OF WICHITA FALLS, TEXAS:
That W. E. Fitzgerald was duly and legally elected Mayor of the City
of Wichita Falls, Texas, and that W. Ralph Hyer, H. J. Naylor and Frank Wolf were
duly and legally elected Aldermen of the City of Wichita Falls, Texas, at said
election and that said election was in all respects legally held in accordance with
the laws of the State of Texas and the Charter and Ordinances of said City.
Moved by Alderman Bebb that the foregoing resolution be adopted.
Motion seconded by Alderman Williams and carried with the following
vote:
Yeas: Aldermen Bebb, Fitzpatrick, Naylor and Williams .
Nays: None.
Moved by Alderman Williams that the Board of Aldermen of the City
of Wichita Falls, Texas, hereby accept and approve the dedication by Hamilton-
Martin Investment Company of lands within the plat or subdivision of the third
supplemental addition to the first section of the Country Club Estates Addition
to the Gity of Wichita Falls, Texas, being all those parts of A. Criswell Survey,
Abstract 346, and the John A. Scott Survey Number Nine,Abstract 30b, included
within the boundary lines of said supplemental plat of said first section of said
Country Club Estates Addition as shown by map or plat of said supplemental hereto
attached and made a part of these minutes.

Moved by Alderman Bebb that the Board grant licenses and fees to the
Geo Loos Shows sponsored by the American Legion, to show on the site of the old
baseball park or adjacent thereto from May lath to 18th, inclusive, waiving license
fees, etc.
Motion seconded by Alderman Naylor and carried.
Moved by Alderman l'itzpatrick that the Board grant use of the Memorial
Auditorium to the Knights of Phythias on the night tf April 19th for the purpose of
a program by the Orphan_Children's Home of Weatherford, Texas.
Motion seconded by Alderman.Naylor and carried.
Moved by Alderman Williams treat the Board authorize and order adjust-
ment of personal and property delinquent taxes and settlement of same as outlined
in the following schedule:

over the matter with them that their assessment
was in line with their inventory and recommend
this settlement accordingly.

Moved by Alderman Williams that the application or Billie Davis
Hester for public dance license at 117 Henrietta Street be denied.
Motion seconded by Alderman Fitzpatrick and carried.
Moved by Alderman Bebb that the Board refuse and deny the claim of
Mrs. Mayme Simmons,represented by her attorney Phillip Kouri, for alleged personal
damages.
Motion seconded by Alderman Williams and carried.
Moved by Alderman Bebb that the Board approve a building permit for
the construction of a frame store building at 2607 Holliday Street, said building
to extend to within seven feet of the front street property line.
Motion seconded by Alderman Naylor and carried.
Moved by Alderman Williams that the Board approve the payment of
$68.83 reimbursement on assigned water contract of W. S. Curlee, Indian Heights
Addition, to Frank Kell, for the period, April 1, 1939, to March 1, 1940, and
refer the claim of 1. C. Mytinger for reimbursement on water Ehain contract to the
legal department for investigation and report to the Council.

Moved by Alderman Williams that the City Manager be instructed to
install a street light at the intersection of Owens and Barwise Streets.
Motion seconded by Alderman Fitzpatrick and carried.

Moved by Alderman Fitzpatrick that Ordinance- No . 1301 be 'p4wed on
its first reading.
Motion seconded by Alderman Williams and carried with the following
vote:
Yeas: Aldermen Bebb, Fitzpatrick, Naylor and Williams.
Nays: None.
Moved by Alderman Naylor that the -board authorize the expenditure
and payment of the operation and hospital costs to be incurred by reason of the
medical attention to be given Bill Arthur, injured in line of duty, it being
understood that the operation expenses will not exceed $50.00.
Motion seconded by Alderman Bebb and carried.

Moved by Alderman Williams that the Board of Aldermen express to
Alderman E. A. Bebb appreciation for his services as a member of this Board for
the past four years.
Motion seconded by Alderman Naylor and carried.
Moved by Alderman Naylor that the Board of Aldermen adjourn.
Motion seconded by Alderman Williams and carried.
The Board of Aldermen then adjourned.
