Min 05/29/1939 Wichita Falls, Texas Memorial Auditorium May 29, 1939 The Board of Aldermen of the pity of Wichita Falls met in regular session at 8:00 p. m. on the above date in the Council Room in the Memorial Auditorium with the following members present: W. E. Fitzgerald, Ivayor E. A. Bebb, ) H. J. Naylor, ) V. E. Stampfli, ) Aldermen Jas. M. Williams,) Frank Wolf, ) J. Bryan Miller, City Manager Geo. T. Henderson, Acting City Clerk T. A. Hicks, City Attorney. The Minutes of the regular meeting of May 15th were read. Moved by Alderman Bebb that the minutes of the last regular meet- ing of May 15th be approved as read. Motion seconded by Alderman Wolf and carried. ORDINANCE NO. 1285 AN ORDINANCE PROHIBITING THE SALE OF BEER WITHIN THE ZONE IN THE CITY OF ATCHITA FALLS, TEXAS, PRESCRIBED IN THIS ORDINANCE, AND FURTHER PROVIDING THAT NO LICENSE--OR PERMIT BE ISSUED FOR THE SALE OF SA&E, EITILER BY THE ST'LTE, COUNTY ; OR CITY, AND PROVIDING A PENALTY. Moved by Alderman Williams that Ordinance No. 1285 be not passed and approved on its third and final reading. Motion was not seconded and the Mayor declared the motion lost for want of a second. After some discussion, Alderman Bebb r4oved that Ordinance No. 1285 be passed on its third and final reading. Motion seconded by Alderman Wolf and lost by the following vote: Yeas: Aldermen Bebb and Wolf. Nays: Aldermen Naylor, Stampfli and Williams. Motion seconded by Alderman Williams and carried. Moved by Alderman Wolf that the application of J. E. Miller to , solicit advertising for the Southwestern Railway Journal be denied. Motion seconded by Alderman Williams and carried. RESOLUTION Moved by Alderman Williams that the Board of Aldermen of the City of Wichita Falls authorize the execution for and on behalf of the City of .Wichita Falls for that certain Works progress Administration Project Proposal, Sponsor's Proposal No. 3-39, and being a project to sup-)ly water for emergency use by the City of Wichita Falls by enlarging 10087 ft of Wichita County Water Improvement. District No. 1, C-L Lateral, including structures and constructing 3855 ft of new lateral with appurtenant structures connecting A. L. lateral to City Aqueduct, and further that W. E. Fitzgerald, Mayor of the City of Wichita Falls be authorized to execute such Project as the Sponsor's Agent, and that J. Bryan Miller, City Manager, be authorized to executes such project proposal as fiscal officer of said City. Motion seconded by Alderman Bebb and carried. Moved by Alderman Williams that the Board of Aldermen of the City of Wichita Falls do hereby allocate and set aside to that certain project described in Works Progress Administrati ,on Project Porposal Sponsor's Proposal No. 3-39, and entitled "Project to supply water for emergency use by the City of Wichita Falls," all those certain funds, materials and equipment as set out in such project proposal as the Sponsor's contribution, and being a total amount of $99426.55, and that such funds be allocated from and constitute a charge against the Water Fund of said City. Motion seconded by Alderman Bebb and carried. Moved by Alderman Williams that chauffeurs licenses be granted to Glenn E. Linskey, Jack Mitchell, Glenn Lambert, W. E. Entriken, Tom Hall, Walter Myers and A. A. Nichols. Motion seconded by Alderman Stampfli and carried. Moved by Alderman Wolf tha the Board approve a eertr-..in contract signed b,y W. E. Fitzgerald, Mayor for the ity of Wichita Falls, and Homer L. Morris effecting a settlement with the said Homer L. Morris for certain damage claims against the City ,of Wichita Falls whereinthe said Homer L. Morris is to be employed by the Uity of Wichita Falls for a certain period as outlined in said contract and further consideration that the City of Wichita Falls pay the sum of Four Hundred ($400.00) Dollars to Bert King, Attorney, for attorney fees for Homer L. Morris, said contract being filed of record iii the files of the City of Wichita Falls. Motion seconded by Alderman Bebb and carried. Moved by Alderman Bebb that the Board approve and authorize payment of the sum of $1,818.82 to the ichita General Hospital for charity for the month of April upon payment of alike sum from Wichita County. Motion seconded by Alderman Stampfli and carried. Mrs. Dora Smith appeared before the Council with a petition requesting the Council to prevent the erection of a church building at 800 Burkburnett Road. Mayor Fitzgerald ruled that the Board had no jurisdiction in this matter. Moved by Alderman Naylor that the claim of Waiter W. Brown against the City of Wichita Falls be paid. Motion seconded by alderman Stampfli and lost by the following vote: Yeas: Aldermen Naylor and Stampfli. Nays: Aldermen Bebb, Williams and Wolf. Moved by Alderman Bebb that the Board of Aldermen adjourn. Motion seconded by Alderman Williams and carried. The board of Aldermen then adjourned. PASSED AND APPROVED this the 5th day of June, A.
