Min 05/01/1939 Wichita Falls, Texas Memorial Auditorium May 1, 1939 The Board of Aldermen of the City of Wichita Falls, Texas met in regular session at 8:00 P. M. on the above date in the Council Room in the Memorial auditorium with the following members present: W. E. Fitzgerald, Mayor E. A. Babb ) V. E. Stampfli ) Aldermen Frank Wolf ) J. Bryan Miller, City Manager 1. H. Crouch, City Clerk T. A. Hicks, City Attorney The minutes of the last regular meeting held April 249 19399 were read. Moved by Alderman Babb that the minutes of the last regular meeting of April 24th, 1939, be approved as read. Motion seconded by Alderman Wolf and carried. Moved by Alderman Stampfli that the Board authorize the purchase from W. E. Wilson of a certain two acres of land located Northeast of Lincoln Park for the consideration of Five Hundred Dollars ($500.00) and further authorize the Mayer to execute a deed or contract deed transfering this two acres to the Colored Club, its duly credited officers or trustees, for park and recreational purposes only, the pure'-lase of said two acres conditioned specifically upon the dedication and opening of an extention of Homes Street to provide public ingress and esress. Motion seconded by Alderman Babb and carried. Moved by Alderman Bebb that the following Resolution be adopted: RESOLUTION AGREEMENT BY MUNICIPALITY OR POLITICAL SUBDIVISION TO MAINTAIN HIGHVAYS IMPROVED UNDER STATE C014STRUCTION PROGRAM The City of Wichita Falls, State of Texas, hereinafter referred to as Wichita Falls, and the Texas Highway Department, hereinafter referred to as the Highway Department, hereby agree as fellows: s S 8 1. That the Highway Department will submit a project for the improvement of two(2) miles of the municipal highway from Scott Avenue to west city limit, known as 5th and 6th Street State Highway No. 30, and to be designated as State project No. 156-4-5, and has been approved by the Texas State Highway Commission for construction, subject, however, to the condition that the City of Wichita Falls, Texas, shall provide for its proper maintenance after com- pletion of its improvement. 2. That the said City of Wichita Falls hereby requests the Highway Department to construct the aforementioned project, and agrees that if such project is constructed by the Highway Department, it thereafter, at its own cost and expense, will maintain the *reject in a manner satisfactory to them, or their authorized representatives, and will make ample provision each year for such maintenance. IN IITNESS THEREOF, the parties have hereunto affixed their signatures, the City of Wichita Falls, Texas, on the 1st day of May, 1939, and the Highway Department on the day of 0 1939. Nays: None. adopted: Moved by Alderman Wolf that the following Resolution be RESOLUTION AREAS, The State Highway Department of the State of Texas is desirous of constructing State Highway No. 30 in the City of Wichita Falls, Texas, from Scott Avenue West ever 6th and 5th Streets to the West city limit, and WMEAS, the State Highway Department of Texas will not parti- cipate in the construction of said highway until and unless the City of Wichita Falls, Texas, will agree to the following on routing of Highway 30 over 6th and 5th Streets, to refrain from permitting excroachments upon the right-of-way of said and above mentioned Street and Highway and unless the City of Wichita Falls, Texas, will agree to refrain from permitting parking of vehicles on the pavement on 6th Street from Austin Street to Broad Street, and unless the City of Wichita Falls, Texas, will agree to refrain from passing ordinances or laws fixing a speed limit of under twenty miles per hour- on said street and highway, and until and unless the City of Wichita Falls will agree to refrain from erecting signs, semaphores and signals that will give preference to local routes or that will hinder or delay traffic on said above mentioned highway. TFif+.'REFORE, be it resolved by the Board of Aldermen of the City of Wichita Falls, Texas, that, for and in consideration of the State Highway Depart- ment of Texas, constructing Hi emay No. 30 in the City of Wichita Falls, Texas, it hereby agrees withthe State Highway Department of Texas, to the following on 6th and 5th Street route extending from Scott Avenue to the Vest city limit, that it will net in the future permit enchroachment on the right-of-way-Of said streets or highway;, nor will it permit parking on 6th Street between Austin Street and Broad Street, nor will it permit parking of vehicles, except parallel parking, on the remainder of pavement, nor will it pass ordinances or laws fixing a speed limit on the above mentioned streets or highway of under twenty miles per hour; nor will it allow the erection of signs, semaphores and signals that will give preference to local routes which intersect with said streets; nor will slow, hinder, or delay traffic on said streets; nor will it repeal Or amend any of the provisions of this resolution without the consent of the State Highway Commission. This is to certify that the above resolution was adopted and passed at a regular meeting of the Board of Aldermen on May 1st, 1939. Representatives of the Wichita Falls Paving Cormittee and the Chamber of Commerce anneared before the Council urging the consideration of the paving and improvement of " leave outs " in paving, with particular reference to improvement at the intersection of Monroe Street and Avenue I and further offering their cooperation in any program of City assistance in accomplishing such improve- ment. J. W. Nicholson, representing a delegation of citizens from Virginia Street and adjacent area, again requested the Board of Aldermen to pass a zoning ordinance prohibiting the sale of beer within the area set out in a petition filed with the Board. Moved by Alderman Wolf that Ordinance No. 1285 be Passed and approved on its first reading. Motion seconded by Alderman Stampfli and carried with the following result: Yeas: Aldermen Bebb, Stampfli and Wolf. Nays: None. Motion seconded by Alderman Stampfli and carried. Moved by Alderman Stampfli that the Board authorize the payment of court costs of cause No. 29008, City vs. City National Bank, in the sum of $40.75. Motion seconded by Alderman Bebb and carried. Moved by Alderman Wolf that the Board of Aldermen adjourn. Motion seconded by Alderman Bebb and carried. The Board of Aldermen then adjourned.
