Min 04/18/1938 Wichita Falls , Texas Memorial Auditorium Building April 18, 1938 The Board of Aldermen of the City of ZJichita Falls met in regular session at 8:00 P. M. on the above date in the Council Room in the Memorial Auditorium with the following members present: W. E. Fitzgerald, Mayor Edwin A. Bebb, J. W. Fitzpatrick, X Pat Hardage, X Aldermen H. J. Naylor, Z J. Bryan Miller, City Manager J. H. Crouch, City Clerk T. A. Hicks, City Attorney. The Minutes of the regular meeting of May llth were read. Moved by Alderman Hardage that the Minutes 'of the regular meeting of May llth be approved as read. Motion seconded by Alderman Bebb and carried. ORDINANCE NO. 1267 AN ORDINANCE AMENDING PARAGRAPH VII OF SECTION VI OF ORDINANCE NO. 1248, ENTITLED "AN ORDINANCE FOR THE LICENSING AND REGULATING OF AUTOMOBILES FOR HIRE, PROVIDING FOR A PERMIT OR CERTIFICATE OF PUBLIC NECESSITY AND CONVENIENCE, PRE- SCRIBING RATES TO BE CHARGED, REQUIRING CHAUFFEUR'S LICENSES FOR DRIVERS OF SUCH AUTCMOBILES, REQUIRING THE FURNISHING OF INSURANCE OR BONDS BY THE OPERATORS CP SUCH CARS, REQUIRING THE FILING OF AN AFFIDAVIT SHCWING THE NAMES AND ADDRESSES OF ALL OWNERS AND PERSONS INTERESTED IN SUCH BUSINESS, REQUIRING SUCH OPERATORS TO HAVE RESIDED IN THE CITY OF WICHITA FALLS FOR AT LEAST SIX MONTHS BEFORE EN- GAGING IN SUCH BUSINESS, PROHIBITING THE TRANSPORTING OF PERSONS FOR THE PURPOSE OF LEWDNESS, ETC. , PROVIDING FOR THE REVOCATION OF LICENSE UNDER CERTAIN C ONDITI ONS, PROVIDING THAT IF ANY PART OF THIS ORDINANCE IS HELD TO BE NULL AND VOID THEM SUCH HOLDING SHALL NOT AFFECT THE OTHER SECTIONS OF THIS ORDINANCE, PROVIDING THAT IF ANY SECTION OF THE ORDINANCE IS IN C017LICT WITH THE STATE LAW, THEN THE SAID STATE LAW ffIALL GOVERN, PRESCRIBING THE PENALTY AND DECLARING AN EMIERGENCY. Moved by Alderman Naylor that Ordinance No. 1267 be passed on its second reading. Motion seconded by Alderman Hardage and carried by the following vote: Yeas: Aldermen Naylor, Hardage, Bebb and Fitzpatrick. Nays: None. ORDINANCE N0, 1269 AN ORDINANCE AMENDING SECTION 1 OF CRDINANCE NO. 1167 PROVIDING FCP THIE EX- EMPTION FROM ALL TAXATION FOR CITY PURPOSES $3,000.00 OF THE ASSESSED TAXABLE VALUE OF ALL RESIDENCE HOMESTEADS AS NOW DEFINED BY LAW, WHICH ARE LOCATED AND SITUATED WITHIN THE CORPORATE LIMITS OF THE CITY CF WICHITA FALLS, TEXAS, AND PROVIDING THAT SUCH HOMESTEAD EXEMPTION SHALL NOT BE ALLMTED UNLESS THE OEIM THERECF SHALL, AS PRO- VIDED BY STATUTE, RENDER SAID PRCIPERTY, PROVIDED FURTHER THAT THE COLLECTCR SHALL NOT ISSUE A CERTIFICATE GRANTING HOMESTEAD EXEMPTION UNTIL ALL PERSONAL PROPERTY TAXES HAVE BEEN PAID BY THE PARTY CLAI24ING THE EXEMPTION, SAID ORDINANCE NO. 1167 BEING ENTITLED "AN CRDINANCE EXEMPTING FROM ALL TAXATION FOR CITY PURPOSES $3,000.00 OF THE ASSESSED TAXABLE VALUE OF ALL HOMESTEADS AS NO 1 DEFINED BY LAW, IkEICH ARE LOCATED AND SITUATED WITHIN THE CORPORATE LIMITS CP THE CITY OF WICHITA FALLS, TEXAS, FROM AND AFTER THE 1ST DAY OF JANUARY, A. D. 1934". Moved by Alderman Hardage that Ordinance No. 1269 be passed on its second reading. Motion seconded by Alderman Bebb and carried by the following vote: Yeas: Aldermen Hardage, Bebb, Fitzpatrick and Naylor. Nays : None. Moved by Alderman Babb that the Board authorize purchase of a certain strip of land approximatelyA50 x 265 feet and more fully described in a deed from J. B, Marlow and Sophie Marlow to the City of Wichita Falls for the consideration of $2,200; $700 to be paid in cash to J. B, and Sophie Marlow, $1,000 to be applied on any taxes due and owing by J. Be Marlow and $500 to be credited to J. B. Marlow on account by the Water Department of the City, and further authorize W. E, Fizgerald, Mayor,, to execute for and on behalf of the City contract with J. B. and Sophie Marlow covering the terms of this purchase. Motion seconded by Alderman Hardage and carried. Moved by Alderman Hardage that Chauffeur's licenses be granted to H. B. Jones and Buster Crabb. Motion seconded by Alderman Naylor and carried. Moved by Alderman Bebb that the Council authorize adjustments of personal and property taxes and settlement of same as outlined in the following schedule: Motion seconded by Alderman Hardage and carried. Motion seconded by Alderman Fitzpatrick and carried by the following vote: Yeas: Aldermen Hardage, Fitzpatrick, Nayor and Bebb. Nays: None. RESOLUTION INTEREAS, the Board of Aldermen in regular session did on March 28, 1938, duly pass a resolution authorizing W. E. Fitzgerald, Mayor of the City of Wichita Falls, Texas, to act for and on behalf of said city in purchasing the site and building known as the Old Post Office in said city at the purchase price of $9,000.00, said sum being not less than 50% of the appraised value fixed by the Treasury Department of the United States; and, WHEREAS, it is necessary to consummate the purchase of said property, that a formal contract of sale be executed in duplicate fcr and on behalf of said City, NOVI, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDER10EN OF THE CITY OF WICHITA FALLS, TEXAS, THAT W. E. Fitzgerald, Mayor said said City, be and is hereby authorized to execute in duplicate for and on behalf of the City of L1ichita Falls, Texas, a contract of sale with the Treasury Department of the United States of America for the purchase of the Wichita Falls, Texas. old Post Office site and building for the sum of $9,000.00 to be paid to the Treasury Department in accordance with the terms of bid heretofore made and the terms of Treasury Department contract No. T5 PB-274. PASSED AND APPROVED this 18th day of April 1938. Moved by Aldenaan Hardage that the Board of Aldermen authorize purchase of 50 new standard, metal reflector type, street stop signs. Motion seconded by Alderman Naylor and carried. Moved by Alderman Hardage that the Board of Aldermen hold no meeting on April 25th. Motion seconded by Alderran Fitzpatrick and carried. Moved by Alderman Hardage that the meeting be adjourned. Motion seconded by Alderman Fitzpatrick and carried. The Board of Aldermen then adjourned.
