Nays: None. Moved by Alderman Babb that the Board, on application of Mildred Hampton and N. R. Byrd, grant Certificate of Public Convenience and Necessity to N. R. Byrd to operate a taxicab services and cars heretofore operated by Mildred Hampton, doing business as Hamp's Taxicab Service, and on agreement acknowledged and sworn to by Mildred Hampton for Hamp's Taxicab Service, order a transfer of all taxicab deposit funds to the credit of Hamp's Taxi Service to N. R. Byrd hereafter doing business as Hamp's Taxi Service; said N. R. Byrd assuming all liabilities for which the Taxicab Deposit Fund is created. Motion seconded by Alderman Naylor and carried. Moved by Alderrm n Wolf that the Board authorize filing of 11,1.P.A. Project covering installation of sanitary sewers in the alley of Block 2, R. E. Montgomery Subdivision, provided property ovaiers in said block will pay in cash the sum of50.00 per each 50 ft. lot adjacent to the proposed sewer line. Motion seconded by Alderman Fitzpatrick and carried. The City Attorney filed written report dated April llth advising the Board that title to the cafe building at the municipal airport was vested in J. C. Mytinger. Maylor Fitzgerald appointed Aldermen Volf and Williams to confer with ovmers of the cafe building located at the municipal airport relative purchase of this building by the City. Moved by Alderman Babb that the Board grant issuance of a building permit to T. L. McGee for the construction of two residences on 50 x 150 ft. lot, listed as Lot 1, Block 83A, Highland Addition. Motion seconded by Alderman '""olf and carried. Moved by Alderman Wolf that the Council authorize adjustments of personal and property taxes and settlement of same as outlined in the following schedule. Motion seconded by Alderman Hardage and carried. The City Attorney filed a written report dated April llth relative to a claim of Oliver Fudge for alleged damages, advising the claim had been thoroughly in- vestigated and the City has no legal liability. Moved by Alderman Naylor that the following resolution be adopted. Motion seconded by Alderman Hardage and carried by the following vote: Yeas: Aldermen Naylor, Hardage, ?`illiams, Babb, Fitzpatrick, and V!olf. Nays: None. RESOLUTION ThTEREAS, at a regular meeting of the Board of Aldermen of the City of Wichita Falls held at the regular meeting place in the Council Room of the I'lemorial Auditorium Building in said City on the llth day of April 1938, at which a quorum was present, came on to be considered the returns of the city election held on April 5, 1938, for the purpose of electing a mayor and three aldermen for said City, %7-EREA3, after canvassing the returns of said election it was found to be duly and legally held in all respects, and there were cast at said election 468 votes far the election of a mayor and three aldermen, and that For Mayor W. E. Fitzgerald received 464 votes Otto Stehlik received l " For Aldermen Place Number Four (4) Edwin A. Bebb received 458 votes L. R. Abbott received 8 " For Alderman Place Number Five (5) 11. J. Naylor received 466 votes For Alderman Place Number Six (6) Frank Wolf received 458 votes B. lard received 8 " And it appearing that Y. E. Fitzgerald received the greatest number of votes at said election for Mayor, that Edwin A. Bebb received the greatest number of votes cast at said election for Alderman Place Number Four (4) , that H. J. Naylor received the greatest number of votes cast at said election for alderman Place Nunber Five(5) , and that Frank 1 olf received the greatest number of votes cast at said election for Ald enran Place Nunb er Six (6) ; THEREFORE BE IT RESOLVED BY TEE BOARD CF ALDER TN OF THE CITY OF ?`I ICHITA FALLS, TEXAS: THAT W. E. Fitzgerald, Edwin A. Bebb, H. J. Naylor, and Frank Volf were duly and legally elected Mayor and Ald.ermn of the City of t5lichita Falls at said election and that said election was in all respects legally held in accordance with the laws of the State of Texas and the Charter and Ordinances of said City. RESOLUTICU 'a'HEREAS, Walter Caldwell has voluntarily given service and time without ex- pense in perfecting claims for pension on behalf of F?rs. F. Y. Dowdy, widow of F. 14. Dowdy, deceased, and former Chief of the Police Department of the City of t"ichita Falls; Novi, THEREFORE, BE IT RESOLVED BY THE BO4,RD OF ALDEMUN OF ME CITY OF WICHITA FALLS , TEXAS: THAT the services of Walter Caldwell on behalf of 11rs. F. 11. Dowdy in the matter above mentioned be recognized by this Board and the gratitude of this Board be hereby expressed. Yoved by Alderman Bebb that the Board of Aldermen of the City of Wichita Falls hereby go on record approving a proposed dam across V:ichita River to be located below Ohio Street Reiver Bridge with the distinct understanding that the City will not be held liable for any damage or claim of any nature which may arise by reason of the proposed damming of 'Glichita River, and further provided that final plans and specifi- cations for installation of said dam and improvement of property adjacent to the giver are approved by the City Engineer, State Board cf k ater Engineers and the Board of Ald ermen. otion seconded by Alderman Williams and carried. 2:1oved by Alderman L"olf that the meeting be adjourned. 1"oti.on seconded by Alderman 2itzpatrick and carried.
