The Board of Aldermen of the City of Wichita Fells met in regular session
at 8:00 P. M. on the above date in the Council Room in the Memorial Auditorium with
the following members present:

The Minutes of the regular meeting of July 12th were read.
Moved by Alderman Herdage that the Minutes of the regular meeting of July
12th be approved as read.

ORDINANCE h 1257
AN ORDINANCE CLOSING TEE ALLEY RUNNING FROM MISSISSIPPI STREET TO SCOTT
STREET AND BETWEEN LOTS TWlELOE (12) AND THIRTEEN (13) IN BLACK THIRTY ONE (31) OF
THE BARWISE A ND JALOVIC ADDITIOPi TO THE' CITY OF WICHITA FA M, TEXAS.
Moved by Alderman 'Rolf that Ordinance No. 1257 be pessed on its third end
final reading end be adopted as read.
Motion seconded by r lderman Fitzpatrick end carried by the following
vote:
Yeas: Aldermen golf, Fitzpatrick, Herdage, Naylor, end Wlilliams.
Nays: None.
Moved by Alderman Herdage that the Board approve issuence of dance hall
license to E. Leverick located at 113-115 North Burnett Street.
Motion seconded by Alderman Williams end carried.
Moved by Aldermen Wolf that the following resolution be edopted.

RESOLUTION
'.NHERF,AS, the construction of a grade separation on the Burkburnett Road, Lin-
coln Street, Highway No. 30, extending from Scott Avenue to Arkansas Street end con-
sisting of underpass and approaches is deemed necessary and advisable for the public
safety and general welfare of the citizens of Wichita Falls, Texas, and;
WHEREAS, the construction of the aforementioned grade separation will mater-
ially improve traffic conditions and greatly improve the system of highway conne ct ions
in and through the city;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERAEN OF THE CITY OF WICHITA
FALLS, TEXAS,
THAT, W. E. Fitzgerald, Mayor of the City of Wichita Falls, Texas, be and is
hereby authorized and instructed to sign a certain APPLICATION FOR SUBMISSION OF GRADE
SEPARATION PROJECT UNDER THE FEDERAL HIGHWAY ACT, said grade separation being on the
Burkburnett Road, Lincoln Street, Highway No. 30 extending from Scott Avenue to Arkan-
sas Street and consisting of underpass and approaches, it being understood that said
application binds the City of Wichita Falls , Texas, to furnish all right-of-way neces-
sary or required by the State Highway Department and furnish indemnity to the State
Highway Department and the Railroad Company against any and all liability for damage to
properties growing out of such construction and after completion to maintain said pro-
ject in a manner satisfactory to the State Highway Department and Bureau of Public
Roads and to make ample provision for such maintenance from year to year.
Moved by Aldermen Herdege that the Board of Aldermen disallow the claim of
Geo. W. Pitman in the sum of $19500.00.

ORDINANCE NO. 1258
AN ORDINANCE GRANTING THE RIGHT, PRIVIIEGE AND FRtN`CHISE TO THE WICHITA VAL-
LEY RAIL"1AY COMPANY TO CONSTRUCT, MPINTAIN AND OPERATE A SPUR TRACK FROM THE MIN LINE
OF THE WICHITA VALLEY RAILWAY COMPANY, IEAVING SAID WIN LINE AT OR ABOUT A POINT
MARKED 34 PLUS 24.7 OOP. SOUTH AND EXTENDING NORTH ALONG AND ON MILL STREET AND IN
FRONT OF LOTS ONE (1), TWO (2), AND THREE (3) IN BLACK THIRTY ONE (31), LOTS TEN (10)
AND ONE (1) IN BLOCK TWENTY THREE, AND LOT TEN (10) IN BLOCK SIXTEEN (16) OF THE BA.R-
WISE AND TALONICK ADDITION TO THE CITY OF WICHITA. FALLS, TEV.S, CROSSING SCOTT AVENUE,
WAINUT STREET AND ELM STREET, AND EXTENDING TO A POINT IRKED 10 PLUS 00 NORTH OF ELM
STREET IN SAID CITY, OR IN THE NEIGHBORHOOD OF SAID POINT, AS SHOWN IN THE SKETCH AT- 5
TACHED HERETO IND MADE A PART HEREOF, FOR A PERIOD OF TWENTY FIVE YEARS.

Moved by Alderman Naylor that the Board of Aldermen hereby order and set public
hearing to be held on August 16, 1937, on Ordinance 1258; said ordinPnce providing
for franchise to the Ifichits Valley Reilwey Company to operate a certain spur track
on the streets of Wichita Falls end further order publication of Ordinance 1258 in
compliance with provisions of the Charter.

Moved by Aldermen Williams thet the Board hereby set July 26th f or public
hearing on epplicPtion of Clifton E. Bernett doing business as the City Cab Company
on his epplicetion for issuance of a Certificate of Public Convenience end Necessity.

Moved by Aldermen Williams that the Board allows end order issuance of
necessary permits for the erection of a frame building on Lot 7, Block 93A, High-
lend Addition to the City of 17ichite Fells, s-id building; to he eonstriict�r in
line with the general property line.
Motion seconded by Alderman Naylor end carried.
Moved by Alderman Williams that the Council authorize end order adjustment
of property and personal taxes and settlement of same as outlined in the following
schedule :

meat of interest coupons on City of Wichita Falls bonds held by C. W. Snider es agent
in the approximate amount of $475.00; said interest to be paid to June 1, 1936; it being
understood that no certificate of deposit has been issued covering the original bond
from which slid coupons are detached.
