Min 05/03/1937 W ichita Falls, Texas Memorial Auditorium Building May 3, 193 7 The Board of Aldermen of the City of Wichita Falls met in regular session at 8:30 P. M. on the above date in the Council Room in the Memorial Auditorium with the following members present: W. E. Fitzgerald, Mayor Edwin A. Bebb, J. W. Fitzpatrick, Pat Hardage., H. J. Naylor, Aldermen J. M. Williams, Frank Wolf, J. Bryan Miller, City Manager J. H. Crouch, City Clerk T. A. Hicks, City Attorney The Minutes of the regular meeting of April 26 were read. Loved by Alderman Bebb that the Minutes of the regular meeting of April 26th be approved-as read. Motion seconded by Alderman Wolf and carried. ORDINANCE NO. 1251 AN ORDINANCE PROVIDING FOR THE REFUNDING OF THE OUTSTANDING BONDED DEBT OF THE CITY OF WICHITA FALLS, TEXAS, INTO A SINGLE SERIES OF REFUNDING BONDS AND MAKING PROVISION FOR THE LEVY AND COLLECTION OF TAXES FOR THE PAYMENT OF THE SANE. Moved b Alderman Naylor that Ordinance No. 1251 be passed on its first Y reading. Motion seconded by Alderman Wolf and carried, by the following vote: Yeas: Aldermen Naylor, Wolf Bebb Fitzpatrick, Hardage, and Williams. Nays: None. - - - - - - - - - Moved by Alderman Wolf that the rules requiring ordinances to be passed on three different reading be suspended and an emergency declared, and Ordinance No. 1251 be passed on its second reading. Motion seconded by Alderman Bebb and carried.by the following vote: Yeas: Aldermen Wolf, Bebb, Fitzpatrick, Hardage, Williams, and Naylor. Nays: None. Moved by Alderman Bebb that Ordinance No. 1251 be passed on its third and final reading and be adopted as read. Notion seconded by Alderman Fitippatrick and carried by the following vote: Yeas: Aldermen Bebb, Fitzpatrick, Hardage, Williams, Naylor, and Wolf. Nays: None. b ovsd by Alderman Williams that the Board of Aldermen hereby appoint as active members of the Traffic Commission for Wichita Falls the following citizens: Norris Ewing Butler Westerfield Jack Jeffus Lester Jones Jim Lyle Dr. L. Mackechney and as ex-officio members of said Commission the following officials and a representa- tive, to be selected, of each of the service clubs in the City: Governor's appointees; District Attorney; Captain Highway Patrol; Sheriff; Supt. of Schools; Chief of Police; Judge of the Corporation Court; Division Engineer Highway Dept; City Attorney; City Engineer; County Attorney; Constable; representative from each of the newspapers; representative of every organization in the City, several members appointed at large. Motion seconded by Alderman Hardage and carried. Moved by Alderman Bebb that the Board hereby appoint Ralph Morgan to represent the Rotary Club as a member of the Traffic Commission. Motion seconded by Alderman Fitzpatrick and carried. Ordinance No. 1252 was called for public hearing by the Mayor. Representative of the Ministerial Alliance, city schools, and the Retail Merchants Association discussed this measure and spoke in behalf of its passage. ORDINANCE NO. 1252 AN ORDINANCE PROVIDING TEAT IF ANY PERSON SHALL BET OR WAGER UPON ANY DOG RACE OR UPON THE RESULT OF ANY RACE, SPEED, SKILL OR ENDURANCE CONTEST OF, BY OR BETWEEN DOGS, WITHIN THE CORPORATE LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, THE SAME SHALL CONSTITUTE A MISDEMEANOR, PUNISHABLE BY FINE OF NOT EXCEEDING FIFTY DOLLARS FOR EACH OFFENSE: FURTHER PROVIDING THAT IF ANY PERSON SHALL KEEP OR BE IN ANY MANNER INTERESTED IN KEEPING ANY PREMISES, BUILDING, ROOM, PLACE, TRACK, PARK, LAND, FIELD, LOT, OR ANY OTHER PLACE LIKE OR UNLIKE THE FOREGOING ENUMERATION FOR TBE PURPOSE OF BEING USED AS A PLACE TO BET OR WAGER UPON ANY RACE, OR SPEED, SKILL OR ENDURANCE CONTEST OF, BY OR BE- TWEEN DOGS, WITHIN THE CORPORATE LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, THE SAME SHALL CONSTITUTE A MISDEMEANOR PUNISHABLE BY FINE NOT EXCEEDING TWO HUNDRED DOLLARS, AND FURTHER PROVIDING THAT EACH RACE OR CONTEST SHALL CONSTITUE A SEPARATE OFFENSE; FURTHER PROVIDING FOR THE REQUISITES OF AN INDICTMENT AND PROOF IN KEEPING PREMISES AND USING THE SAME FOR THE PURPOSE OF BETTING OR WAGERING ON ANY RACE OR ENDURANCE CONTEST BETWEEN DOGS, OR RECEIVING BETS FOR SUCH PURPOSE; REPEALING ALL LWAS OR PARTS OF LAWS IN CONFLICT THEREWITH, AND IRCLARING AN EMERGENCY. Moved by Alderman Wolf that Ordinance No. 1252 be passed on its first reading. Motion seconded by Aldermen Naylor and carried by the following vote: Yeas: Aldermen Wolf, Naylor, Bebb, Hardage, Williams, and Fitzpatrick. Allison and Houston Bolin freight in the sum of $62.00 on surplus commodities for the City of Wichita Falls. Motion seconded by Alderman Fitzpatrick and carried. Moved by Aldermen Williams that the Board grant the request of the local De Molay Chapter to serve in the several official capacities in the operation of the City on May 7th. Motion seconded by Alderman Fitzpatrick and carried. i Moved by Alderman Bebb that the Board of Aldermen authorize the Mayor to re- present the City at the Chamber of Commerce Convention for 1937 to be held in Brownwood , with expenses paid, and in case the Mayor is unable to attend this Convention to ap- point some representative to act in his place.
