Min 04/05/1937 Wichita Falls, Texas Yemorial Auditorium Building April 5, 1937 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session at 8:30 P.N. on the above date in the Council Room in the Memorial Auditor- ium with the following members present: W. E. Fitzgerald, Mayor Edwin A. Bebb' H. J. Naylor, J. R.F. Williams, Aldermen Frank Wolf, J. Bryan Miller, City Manager J. H. Crouch, City Clerk T. A. Hicks, City Attorney The Yinutes of the meeting of March 29 were read. Yoved by Alderman Bebb that the �i,inutes of the meeting of Burch 29 be approved as read. A'otion seconded by Alderman Wolf and carried. The City Manager reported to the Board the progress made on the refunding procedure for city bonds. Moved by Alderman Naylor that the Board instruct the City Attorney to file suit to clear title to the old street railway bridge over Wichita River on North Austin Street. Motion seconded by Alderman Williams and carried. Yoved by Alderman Wolf that the Board of Aldermen accept the report of the City Attorney and disallow the claim for damages filed by A. L. Harrell. Motion seconded by Alderman Naylor and carried. Moved by Alderman Naylor that the Board of Aldermen authorize the Mayor to execute a deed to Solon R. Featherston for and to certain tracts, being a strip of land ' 50' in width extending across the southwest quarter of the northeast quarter of the J. A. Scott survey No 9 Abstract 305 located in Wichita County, Texas, and through Block 8, J. A. Scott Survey No. 91, Abstract 305, located in Wichita County, Texas, this being original right-of-way through the Country Club for Holliday Creek channel, and this deed being in lieu of a deed by Solon R. Featherston to the City of Wichita Falls for a new right-of-way through the Country Club for Holliday Creek channel. Motion seconded by Alderman Williams and carried. Moved by Alderman Bebb that the Board of Aldermen of the City of Wichita Falls authorize the execution for and on behalf of the City of Wichita Falls of that certain Works Progress Administration Project Proposal, Sponsor's Proposal No. 1-37, and being a project to transcribe, catalogue, cross index, and prepare a new file of records in the offices of the City of Wichita Falls, Texas, and, further, that W. E. Fitzgerald, Mayor of the City of Wichita Falls, be authorized to execute such project proposal as the Sponsor's agent, and that J. Bryan Miller, City Manager, be authorized to execute such project proposal as the fiscal officer of said City. Motion seconded by Alderman Williams and carried. Loved by Alderman Bebb that the Board of Aldermen of the City of Wichita Falls do hereby allocate and set aside to that certain project described in Works Pro- gress Administration Project Proposal, Sponsor's Proposal No. 1-37, and entitled "Pro- ject to transcribe, catalogue, cross index, and prepare a new file of recor(b in the office of the City of Wichita Falls, Texas," all those certain funds, material and equipment as set out in such project proposal, as the Sponsor's contribution, and being , in the total amount of $00.00, and that such funds be allocated from and constitute a charge against the General Fond of said City. E. Fitzgerald, Mayor of the City of Wichita Falls, be authorized to execute such project proposal as the Sponsor's agent, and that J. Bryan Yiller, City Manager, be authorized to execute such project proposal as the fiscal officer of said City. Motion seconded by Alderman Williams and carried. Motion seconded by Alderman Williams and carried. Moved by Alderman Williams that the Board of Alderman authorize the Mayor to execute a deed for a certain tract of land in Scotland Park to A. L. Huey, said deed to be executed to A. Huey on condition that said A. L. Huey deeds to the Wichita Falls Independent School District No. 1 said property described above and on the condition that a road or street be provided for from east to west through said property and on the condition that the Wichita Falls Independent School Dis- trict bear all the expense incident to the transferring of this property. Motion seconded by Alderman Bebb and carried. Moved by Alderman Williams that the Board defer consideration of the re- quest of J. B. Marlow relative certain right-of-way or easements for ingress or egress over J. B. Marlow's property adjacent to the Water Department storage tank located on the west end of the City. Motion seconded by Aldermen Bebb and carried. Moved by Alderman Wolf that the Board of Alderman approve and order installation of water line extension approximately 2200 feet outside the city limits; said line to be laid on route of the old Henrietta Road on the cindition that the property owners to be serviced contract and pay to the City the sum sufficient for the entire cost of material and labor upon said water line. Nays: None. { r g u 9 RESOLUTION BE IT RESOLVED BY THE BOARD OF ALDEFUEN OF THE CITY OF WIICHITA FAIZS, TEXAS, AS FOLLOWS, THAT: WHEREAS, a refunding plan for the outstanding bonds of this City was adopted under date of October 15, 1936, and, AREAS, the charter amendments provided for in said plan have been adopted and the plan has been consented to by the holders of more than seventy- five per cent (75%) of the outstanding bonds of the City, THEREFORE, the aforesaid refunding plan is hereby declared effective. It is hereby further resolved that interest accrued up to June 1, 19361 shall now be paid at the rate borne by the respective outstanding bonds to the holders thereof who have eonsented to the plan upon surrender of the appropriate interest coupons or by endorsement of the partial payment of interest upon the appropriate coupons or by endorsement upon the respective matured bonds of the payment of interest due after maturity so paid, as the case may be. Said payments shall be made to the holders of bonds now on deposit with the depositaries under the plan and to the Bondholders Protective Committee, con- sisting of W. A. Simonton, Freg Hageman, Jr. , and John A. Nordman, on account of the bonds they hold in the total amount of $633,000. A like payment shall be made to the holders of bonds hereafter consenting to the plan upon deposit of their respective bonds for exchange under the plan. PASSED AND APPROVED this 9th day of April 1937. Moved by Alderman Williams that the Board of Aldermen of the City of ��'�O Wichita Falls, Texas, hereby approve the plat of the ;Wichita Gardens homestead of Wichita County, Texas, as set out and mapped by tontgomery-Ward, Consulting Engineers, I'ay 1934, and revised August 1936, and order said map be filed in the records of the (;ity of :Wichita Falls, Texas.
