Min 01/25/1937 516 Wichita Falls, Texas Memorial Auditorium Building January 25, 1937 The Board of Aldermen of the City of Wichita Falls met in regular session on the above date at 7:30 P. M in the Council Room in the Memorial Auditorium with the following members present: T Y. E. Fitzgerald, kayor Edwin A. Bebb, Claude Yiller, H. J. Naylor, Aldermen Frank Wolf, J. Bryan Yiller, City Kanager J. H. Crouch, City Clerk T. A, Hicks, City Attorney The Minutes of the meeting of January 18 were read. Loved by Alderman Bebb that the 1inutes of the meeting of January 18 be approved as read. Yotion seconded by Alderman Wolf and carried. ORDINANCE NO. 1248 AN ORDINANCE FOR THE LICENSING AND REGULATING OF AUTOVOBIIES FOR HIRE, PROVIDING FOR A Pv,%= OR CERTIFICATE OF PUBLIC NECESSITY AND CONMIEV"CE, PRE- SCRIBING RATES TO BE CHARGED, REQUIRING CHAUFFEURtS LICENSES FOR DRIVERS OF SUCH AUTOYOBILES, REQUIRING THE FURNISHING OF INSURANCE OR BONDS BY THE OPERATORS OF SUCH CARS, REWJIRING THE FILING OF AN AFFIDAVIT SHOWING TIM NAMES AND ADDRESSES OF ALL O'ZTERS AND PERSONS I17ERESTED IN SUCH BUSINESS, REQUIRING SUCH OPERATORS TO HAVE RESIDED IN THE CITY OF WICHITA FALLS FOR AT LEAST SIX MONTHS BEFORE ENGAGING IN SUCH BUSINESS, PROHIBITING THE TRANSPORTING OF PERSONS FOR TRE PURPOSE OF LEWD- NESS, ETC. , PROVIDING FOR THE REVOCATION CF LICENSE UNDER CERTAIN CONDITIONS, PRO- VIDING THAT IF ANY PART OF THIS ORDINANCE IS HELD TO BE NULL AND VOID THEN SUCH HOLDINGS SHALL NOT AFFECT THE OTHER SECTIONS OF THIS ORDINANCE, PROVIDING TRAT IF ANY SECTION OF THE ORDINANCE IS IN CONFLICT "ITITH THE STATE LAW, THEN THE SAID STATE LAW SHALL GOVERN, PRESCRIBING THE PENALTY AND DECLARING AN &ERGENCY. R, Bryan to fill vacancy now existing on the Board of Plumbing Examiners. Motion seconded by Alderman 'golf and carried. 517 Moved by Alde=,an Naylor that the Board approve issuance of domino license to Hal Mayer opering at Ohio and Seventh Street, and the renewal of domino licenses to t)xe Palace Smoke House by Z. Black; S. H. Hodges, 812 Scott) Mecca Cafe by Floyd Horn; and the Smoke House by Del Mills. Motion seconded by Alderman Babb and carried. ORDINANCE NO. 1249 AN ORDINANCE A20NDING SECTION TWO (2) OF ORDINANCE NO* 1243, PA,9SED AND AP- PROVED ON NOVEMBER 2, A. D. 1936, ENTITLED AN ORDINANCE, CREATING AND DEFINING PARKING METER ZONES IN THE CITY OF WICHITA FALLS, TEXAS; PROVIDING FOR THE INSTALLATION, 0PEFt_ ATION AND MAINTENANCE OF kECHANICAL DEVICES TO REGULATE PARKING IN SAID PARKING METER ZONES; PROVIDING FOR THE COLLECTION OF REGULATORY AND INSPECTION MS FOR THE USE OF SUCH DEVICES; PROVIDING FOR THE DEPOSIT OF SUCH FEES BY THE CITY TREASURER IN A SPECIAL� FUND; PROVIDING FOR THS METHOD AND PURPOSES OF DISBURSMtENT OF SAID FUND; MING IT ,pr UNLAINFUL TO USE THE STREETSOR PORTIONS OF THE STREETS SO DESIGNATED FOR PARKING EXCF THROUGH USE OF PARKING IMTERS; DZFINING WHAT ACT SHALL BE UNIAVIFUL, AND FIXING PENALTIE� FOR THE VIOLATION or THE PROVISIONS OF THIS ORDINANCE, AND REPEALING AIL ORDINANCES ANDI PARTS OF ORDINANCES IN CONFLICT HERLE7ITH AND EECLARING AN W. Nays: None, Moved by Alderman Babb that the Board request the City Manager to investigate complaints of the Old Age Organization of the City and render such assistance as may be given them. Motion seconded by Alderman Miller and carried, Moved by Alderman Miller that the Board of Aldermen authorize execution of a lease on a certain strip of land adjacent to the Disposal Plant to George Garner for the period of one year on terms and conditions to be approved by the City Manager. Motion seconded by Alderman Wolf and carried. A. Kemp Addition, lying outside the present Right-of-Way of State Highway No. 5, comprising all or a portion of Lots 11 to 14, inclusive. All that portion of the North one-half of Block 13, T. A. Kemp Addition, lying outside of the present Right-of-Way of State Highway No. 5. comprising all of Lots 1 to 6, inclusive, and a portion of Lot 7." purchase price not to exceed $119477.00; $9,000.00 to be paid by the State Highway Department and $2,477.00 to be paid by the City of Wichita Falls. Motion seconded by Alderman Bebb and carried. Alderman Roy Bryan tendered his written resignation as a member of the Board i of Aldermen, effective on acceptance by the Board. Moved by Alderman Wolf that the Board of Aldermen accept the resignation of Alderman Roy Bryan with many regrets and request the Mayor to express to Mr. Bryan the high esteem he was held while serving as a member of this Board. Motion'seconded by Alderman Miller and carried by the following vote: Yeas: Aldermen Wolf, Miller, Naylor, and Bebb. Nays: None. Moved by Alderman Wolf that the Board of Aldermen of the City of Wichita Falls hereby duly appoint and elect James M, Willians to fill vacancy on the Board of Aldermen , Position No. 3. caused by the resignation of Roy Bryan. M-otion,seconded by Alderman Miller and carried by the following vote: Yeas: Aldermen Wolf, Miller, Bebb, and Naylor Nays: None. Moved by Aldermen Bebb that the Board of Aldermen of the City of Wichita Falls authorize the execution for and on behalf of the City of Wichita Falls for that certain Works Progress Administration Project Proposal, Sponsor's Proposal No. 1-36, and! being a project to increase the capacity of the trunk mains ofthe water distribution system in the residential district, and, furtherl that W. E. Fitzgerald, Mayor of the City ofWichita Falls, be authorized to execute such project proposal as the Sponsorts Agent, and that J. Bryan Miller, City Manager, be authorized to execute such project proposal as the fiscal officer of said City. Motion seconded by Alderman Miller and carried. Moved by Alderman Bebb that the Board of Aldermen of the City of Wichita Falls do bereby allocate and set aside to that certain project described in Works Progress Administration Project Proposal, Sponsor's Proposal No. 1-36, and entitled project to increase the capacity of the trunk mains of the water distribution system in the resi- dential district, all those certain funds, materials and equipment as set in such pro- ject proposal, as the Sponsor's contribution, and being in the total amount of $61,624.62, and such funds allocated from and constitute a charge against the Water Fund of said City. IVotion seconded by Alderman Miller and carried. 520 Moved by Alderman Bebb that the Board of Aldermen of the City of Wichita Falls authorize the execution for and on behalf of the City of Wichita Falls for that certain Works Progress Administration Project Proposal, Sponsor's Proposal No. 2-36, and being a project to increase the water supply mains to the buisiness dis- trict and industrial sections and, further, that If. E. Fitzgerald, h."ayor of the City of Wichita Falls, be authorized to execute such project proposal as the Sponsor's Agent, and that T. Bryan Miller, City Y-anager,be authorized to execute such project proposal as the fiscal officer of said City. Motion seconded by Alderman Miller and carried. Moved by Alderman Bebb that the Board of Aldermen of the City of Wichita Falls do hereby allocate and set aside to that certain project described in Works Progress Administration Project Proposal, Sponsor's Proposal No. 2-36, and entitled project to increase the water supply mains to the business district and industiral sections', all those certain funds, materials and equipment as set in such project proposal, as the Sponsor's contribution, and being in the total amount of $40,434.56, and that such fund allocated from and constitute a charge against the Water Fund of said City. Motion seconded by Alderman Miller and carried. Moved by Alderman Bebb that the Board of Aldermen of the City of Wichita Falls authorize the execution for and on behalf of the City of Wichita Falls for that certain Works Progress Administration Project Proposal, Sponsor's Proposal No. 3-36, and being a project to clean certain water mains in the distribution system, and, further, that '411. E. Fitzgerald, E'layor of the City of Wichita Falls, be auth- orized to execute such project proposal as the Sponsor's Agent, and that 1. Bryan Iv-iller,, City 1--anager, be authorized to execute such project proposal as the fiscal officer of said City. Yotion seconded by Alderman Miller and carried. Yoved by Alderman Bebb that the Board of Aldermen of the City of Wichita Falls do hereby allocate and set aside to that certain project described in Works Progress Administration Project Proposal, Sponsor's Proposal No. 3-36, and entitled project to clean certain water mains in the distribution system, all those certain funds, materials and equipment as set in such project proposal, as the Sponsor's contribution and being in the total amount of �7,688.00, and that such funds allocated from and constitute a charge against the Water Fund of said City. Motion seconded by Alderman Miller and carried. Moved by Aldermen Bebb that the Board of Aldermen of the City of Wichita Falls authorize the execution for and on behalf of the City of Wichita Falls of that certain Works Progress Administration Project Proposal, Sponsor's Proposal No. .5-36, and being a project to improve certain streets, alleys and sidewalks by sur- facing with gravel, and, further, that W. E. Fitzgerald, Mayor of the City of Wichita Falls, be authorized to execute such project proposal as the Sponsor's agent, and that J. Bryan Miller, City Manager, be authorized to execute such pro- ject proposal as the fiscal officer of said City. Yotion seconded by Alderman Miller and carried. 521 Moved by Alderman Bebb that the Board of Aldermen of the City of Wichita Falls do hereby allocate and set aside to that certain project described and entitled to improve certain streets, alleys and sidewalks by surfacing with gravel, all those certain funds, materials and equipment as set in such project proposal, as the Sponsor's contribution, and being in the total amount of $121,758.20, and that such fund allocated from and constitute a charge against the Street Fund of said City. Notion seconded by Alderman Miller and carried, Yoved by Alderman -Killer that the meeting be adjourned. Motion seconded by Alderman `,Volf and carried. The Board of Aldermen then adjourned.
