George, City Attorney The Minutes of the meeting of March 16, 1936, were read and approved. k Moved by Alderman Walker that Chauffeur's License be granted Marvin Jones. Motion seconded by Alderman Miller and carried. Moved by Alderman 1,11alker that the Board of Aldermen designate Virginia Street as rightful route for Highway No. 66, subject to the State Highway Depart- ment making an appropriation of the sum of $8,000.00 to complete the highway proposed. 6 Motion seconded by Alderman Stampfli and carried. Moved by Alderman ?balker that tax refund in the amount of $42.00 be ordered and allowed to Mrs. Rena Ziegler on Lot 1, Block 205, Original. i Motion seconded by Alderman Stampfli and carried. I k RESOLUTION EEREAS, the City National Bank, City Depository, has requested the Board of Aldermen to release as security $150,000.00 Federal Farm Mortgage Corporation Bonds held by the First National Bank in Dallas for the City of lichita Falls as pledged by the City National Bank, Wichita Falls, and evidenced by Receipt No. 11037; and f I i, i I i I! 1 t 344 i i i 'jjEREAS, the City National Bank of Wichita Falls desired to replace said Federal Farm kortgage Corporation Bonds by the deposit of $150,000.00 United States Treasury Notes at 1-12% due December 15, 1940; THEREFORE, BE IT RESOLVED BY "-HE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: THAT the City of lichita Falls release the City National Bank of Wichita Falls $150,000.00 Federal Farm Mortgage Corporation Bonds as set out in Receipt No. 11037 of the First National Bank in Dallas and accept in lieu thereof $150,000.00 United States Treasury Notes at 1 due December 15, 1940. D. 1925, ENTITLED "AN ORDINANCE GRANTING TO THE WICHITA FAILS TRACTION COMPANY AND ITS ASSIGNS THE RIGHT TO L-:AINTAIN AND OPERATE MOTOR TRUCKS, JITNEYS AND BUSSES OVER AND ALONG THE PUBLIC ROADS, STREETS, SQUARES, ALLEYS AND HIGHTAYS OF THE CITY OF :§1ICHITA FALLS, TEXAS, FOR THE PURPOSE OF CARRYING PASSENGERS FOR HIRE". Nays: None. 34 :a ORDINANCE NO. 1227 AN ORDINANCE MAKING ADDITIONAL APPROPRIATION OUT OF THE UNAPPROPRIATED BALANCE AT THE BEGINNING OF THE FISCAL YEAR FOR THE SUPPORT OF THE CITY GOVERN- VENT FOR THE FISCAL YEAR BEGINNING APRIL 1, 19359 AND ENDING MARCH 31, 1936. Moved by Alderman Stampfli that Ordinance No. 1227 be passed on its second reading. Motion seconded by Alderman Walker and carried by the following vote: Yeas: Aldermen Stampfl, Walker, Taylor, Stokes, and Miller. Nays: None. koved by Alderman Stampfli that consideration of the proposed contract by and between the City and Lou Hatter be deferred until April 20. Motion seconded by Alderman -Talker with the following result: Yeas: Aldermen Stampfli, Walker, and Mayor Young, Naps: Aldermen, Taylor, Stokes, and Miller. A Yoved by Alderman Taylor that the Board of Aldermen approve the proposed contract by and between the City and Lou Hatter. Motion seconded by Alderman Miller with the following result: Yeas: Aldermen Taylor, Miller, and Stokes. Nays: Aldermen Stampfli, Walker, and Mayor Young, Attorney T. A. Hicks requested the Board of Aldermen to set up appropriation and approve payment of the Phillips judgment in the sum of $4,400.00. s This matter was discussed by the Board of Aldermen and no action taken. On the request of a ac mittee from the American Legion for permission to bring a carnival to Wichita Falls, it was moved by Alderman Walker that the Board of Aldermen grant permission to the American Legion to bring a carnival to the City with all licenses and charges waived, it being understood that the proceeds received by the American Legion from the carnival are for civic and charitable purposes. Motion seconded by Aldermen Miller and carried. A. Simonton, et a1 vs. City of a,ichita Falls, Texas, et al, in the United States District Court, Wichita Falls Divi- sion, being Case No, 332 In Equity; and ITEREAS, there is also pending in the 89th District Court, Wichita County, Texas, case styled City of Wichita Falls, Texas, vs. Oral Jones, et al, being Case No. 29,008-C; and WHEREAS, it is considered desirable by the City of 'dichita Falls, Texas, to dispose of said litigation: BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF W ICHITA FALLS, TEXAS: THAT W. E. George, City Attorney, be and he is hereby authorized to stipulate that upon dismissal of the said Simonton case by the plaintiffs, the said plaintiffs are to be paid their pro rate. share of the moneys in the interest and sinking funds of the City as of February 6, 1936, based upon past due principal and interest, the amount in each of the separate interest and sinking funds to be applied upon the respective issues to share pro rata as aforesaid. Also included as part of said interest and sinking funds the funds now sought to be transferred by the mandamus suit against Oral Jones, aforesaid. And W. E. George is further authorized to stipulate that upon dis- missal of the Simonton case, the City of Wichita Falls, Texas, is also to dismiss the mandamus suit against Oral ,Jones, with prejudice. BE IT FURTHER RESOLVED: That the Secretary and Treasurer of the City are authorized in making said payment to Simonton, and also to the other bondholders, to make partial payments upon the past due bonds and interest coupons where necessary, and to endorse the amount of such payments upon the bonds and interest coupons and to take the receipt of the bond holder for each such partial payments as his voucher for such payments. Moved by Alderman Taylor that the Board of Aldermen authorize and instruct the payment of $55.00 for easement covering a strip of land 281x601 through Koenig land for the purpose of straightening Holliday Creek channel, on approval of the City Attorney.
