Min 10/21/1935 ichita Falls, Texas Memorial Auditorium Building October 21, 1935 The Board of Aldermen of the City of Wichita Falls met in regular session at 7:30 P. N. on the above date in the Council Room in the Memorial Auditorium with the following members present: John T. Young, bayor Mack Taylor, Claude killer, � Nark D. Walker, g V. E. George, City Attorney The kinutes of the previous meeting were read and approved. boved by Alderman :balker that the kayor be authorized to sign cemetery deed dated October 21, 1935, conveying to Pierce Nichols 10' x 20' west of and ad- jacent to and adjoining Lot No. 90, Block S, Riverside Cemetery; this parcel being a part of the formerly designated street and to be without cost to Pierce Nichols and for the propose of complete adjustment in lieuof deeds formerly executed by the City conveying said lot to both Pierce Nichols and 0. Loved by Alderman Taylor that the Board of Aldermen of the City of Wichita Falls authorize the execution for and on behalf of the City of Wichita Falls of that certain Vcorks Progress Administration Project Proposal No. 13, and being a project to improve certain streets and sidewalks in TJichita Falls, and further, that John T. Young, lkiayor of the City of Wichita Falls, be authorized to execute such project proposal as the Sponsor's agent, and that hack Thomas, City Ttanager, be authorized to execute such project proposal as the fiscal officer of said City. Notion seconded by Alderman hiller and carried. Moved by Alderman Taylor that the Board of Aldemmmen of the City of Wichita Falls do hereby allocate and set aside to that certain project described in Works Progress Administration Project Proposal, Sponsor's Proposal No. 13, and en- titled "Project to improve certain streets and sidewalks in Wichita Falls" all those certain funds, material and equipment as set out in such project proposal, as the Sponsor's contribution, and being in the total amount of $5,930.65, and that such funds be allocated from and constitute a charge against the Street Fund of said City. Motion seconded by Alderman Rodgers and carried. ORDINANCE NO. 1213 AN ORDINANCE AUTHORIZING THE ISSUANCE AND SALE OF BONDS. FOR THE PURPOSE OF CONSTRUCTING AND BUILDING A NATURAL GAS SYSTEM: FOR TRANSPORTATION OF NATURAL GAS TO, AND THE DISTRIBUTION AND SALE OF NATURAL GAS !ITHIN THE CITY OF `,i'ICHITA FAILS, TIE_rAS, AND PROVIDING THAT SAID BONDS SHALL BE SECURED BY A iuORTGAGE UPON SAID NATURAL GAS SYSTEM, AND SO WITCH OF THE ANNUAL I:\'COii:E THEREFROL AS IS NECESSARY TO PAY THE INTEREST UPON SAID BONDS AND RETIRE THEM AS THEY MATURE, AND PROVIDING THAT AS ADDITIONAL SECURITY THERE- FOR BY THE TERNZ OF SUCH -kORTGAGE THAT ANY PURCHASER OF SAID NATURAL GAS SYSTEM;, UNDER SALE' OR UNDER FORECLOSURE OF SAID MORTGAGE, SHALL ILAVE A FRANCHISE TO OPERPTE THE SYSTEM AND PROPERTIES SO PURCHASED FOR A TERM OF NOT OVER T"'TENTY YEARS AFTER PURCHASE, SUBJECT TO ALL LA.'IS REGULATING SALE THEN IN FORCE, AND PROVIDING FURTHER THAT SAID BONUS CON- STITUTING TIE OBLIGATION FOR SUCH NATURAL GAS SYSTEX` SHALL NEVER BE A DEBT OF THE CITY OF dICHITA FALLS, TEXAS, BUT SOLELY ii CHARGE UPON THE PROPERTIES OF SAID NATURAL GAS SYST1 SO MORTGAGED. 9 Moved by Alderman Rodgers that Ordinance No. 1213 be passed on its first reading. Motion seconded by Alderman Stokes and carried by the following vote: Yea*: Aldermen Miller, Taylor, Stampfli, Stokes, Rodgers, and Mayor Young. Nays: Aldermen Walker. 1 f' 7 0 Loved by Aldermen Miller that the American Legion be granted use of the Memorial Auditorium Sunday November 10 without charge. Motion seconded by Alderman Stampfli and carried. Moved by Alderman Miller that the former action of the Board of Alder- ment remitting penalties and interest on all delinquent taxes be changed to read as follows: j That the Board of Aldermen remit all penalties and interest on all delinquent taxes from September 1, 1935, to December 1, 1935, with the exception of those taxes on which suit has been brought for collection of taxes, interest and penalty, and order refunds on any and all penalty and interest paid on all tax accounts from September 1, 1935, to December 1, 1935. F Notion seconded by Alderman Rodgers and carried by the following vote: Yeas: Aldermen Miller, Taylor, Stampfli, Stokes, and Rodgers. Nays: Alderman Walker. Moved by Alderman Miller that the Board of Aldermen appoint Alderman Yack Taylor to represent the City on a tax revaluation committee to be composed of representatives from all the taxing bodies. Motion seconded by Alderman Walker and carried. Moved by Alderman Stokes that the Board of Aldermen appoint the City Manager and Alderman Rodgers to cooperate with the County on the Wichita General Hospital management and report to the Council. Notion seconded by Alderman Miller and carried. I Moved by Alderman Rodgers that the Board of Aldermen appoint J. L. McClure fire marshal for the City of Wichita Falls with a salary of $50.00 per month. Motion seconded by Alderman Stampfli End carried. Moved by Alderman Miller that the Board of A ldermen authorize City Attorney W. E. George, Special Attorney B. D. Sartin, and City Engineer F. M. Rugeley to prosecute the gas company case in the Travis County District Court with all expenses incident thereto paid by the City. Notion seconded by Alderman Rodgers and carried.
