Min 08/05/1935 lichita Falls, Texas ILemorial Auditorium Building August 5, 1935 The Board of Aldermen of the City of Wichita Falls met in regular session at 7:30 P.T.F. on the above date in the Council Room in the 1emorial Auditorium with the following members present: John T. Young, layor Lark D. Walker, IV-ack Taylor, Claude L'�iller, 1. B. Stokes. , Aldermen L. C. Rodgers$ V. E. Stampfli, Lack Thomas, City Y.anager 1. H. Crouch, City Clerk B. D. Sartin, Acting City Attorney The linutes of the previous meeting viere read and approved. Judge Leslie Humphrey, Attorney for the Texas Electric Service Company, was heard by the Council in the discussion of the passage of Ordinance No. 1189, passed on its final reading July 29, 1935, and requested on behalf of the Texas Electric Service Company that the Board of Aldermen delay publication and hold in abeyance Ordinance No. 1189 for a period of from ninety days to six months. Judge Humphrey reviewed the several votes on this ordinance and urged additional hearings before the Board of Aldermen attempted to enforce Ordinance No. 1189. l'oved by Alderman Taylor that the request of Judge Leslie Humphrey on behalf of the Texas Electric 'Service Company be denied. Y-otion seconded by Alderman Rodgers, The Council recessed fifteen minutes to allow Alderman Taylor to bring in records of electric rates of other cities. Further discussion was had by the Council and attorney but no vote was taken on Alderman Taylor's motion. Loved by Alderman Taylor that, the Board of Aldermen order and allow thirty days from the final passage of Ordinance No. 1189 on July 29, 1935, before publication and enforcement of said ordinance. Yotion seconded by Alderman Stokes and carried by the following vote: Yeas: Aldermen Taylor, Stokes, Rodgers, Yiller, valker, and Stampfli. Nays: None. Yoved by Alderman Walker that the Reid Construction Company be allowed to erect a cover over the sidewalk at 721-723 Indiana Avenue as per sketch and speci- fications in their letter of August 2. Motion seconded by Alderman Rodgers and carried, 3 Lloved by Alderman Taylor that I.,. B. Whatley Oil Company be granted a permit to erect two above ground storage gasoline tanks on the vacant lot between Mississippi Street and Valley Railroad, facing Oak Street, subject to approval of the City Engineero' Yotion seconded by Alderman Liller and carried. Yoved by Alderman Taylor that Mrs. Lary Rousey be allowed $25.00 as full and complete settlement for all damages alleged due her by the City of Uichita Falls. I'lotion seconded by Alderman hiller with the following result: Yeas: Aldermen Taylor and 1-iller. Nays: Aldermen Stokes, Stampfli, Rodgers, Walker, and Vayor Young. Lloved by Alderman Rodgers that 1,ayor JTohn T. Young and the City Engineer be sent to Fort ','dorth, Texas, August 6 to secure information from P.1il.A. engineers rela- tive to the new P.,7.A. grants, Iotion seconded by Alderman Stampfli and carried. Yoved by Alderman Rodgers that, based on the investigation of the Council Comittee and their report thus far made to the Board of Aldermen and because said petitions are believed to be illegal and because of the cost which such election would be to the taxpayers, the Board of Aldermen of the City of 'Nichita Falls refuse to call elections on and set aside the recall petitions of Layor John T. Young and eLlderman Lack Taylor* Motion seconded by klderman Stokes, I-ayor Young and Alderman Taylor retired from the Council Chember during con- sideration of and vote on this action, and Alderman V. E. Stampfli as Iv-ayor Protem called the ouestion to the vote with the following result: Yeas: Aldermen Rodgers, Stokes, and Liller. Nays: Alderman Walker and blayor Protem Stanpfli. I�oved by Alderman Stampfli that the meeting be adjourned. Yotion seconded by Alderman Rodgers and carried. The Board of Aldermen then adjourned.
