Mr. Martin made a motion to approve the consent agenda as amended. Ms. Metty seconded
the motion. The motion passed unanimously (6-0).

Request to replat a residential parcel by adding an unplatted tract.

Mr. Guess presented the replat. The replat would combine a residential platted lot with an
9-djacent unplatted undeveloped parcel.

The requested carport dimensions were 20ft x 20ft; distance to front property line: 11ft 3in;
distance to interior side property line: 9ft 2in. There were 2 properties within 200 feet that had
carport within the front setback area.
Mr. Wingo asked if the applicant was in attendance and there was no one present to represent
the case. Mr. Wingo asked if there was anyone in the audience who wished to speak and there
were none.
Ms. Metty made a motion to approve case C 15-38. Mr. Leslie seconded the motion. The motion
,uassed unanimously (6-0).
4. Case C 15-39
Request for a conditional use to allow a non-conforming use expansion (an existing
dental office for signage) in a Single-Family I (SF-1) zoning district.

Planning recommended the ground sign conform to the Brook Avenue zoning district standards
which limit the size (maximum
♦ sq. ft. and 3 ft. in height), impact, and maintain the character of
nearby homes (to the east and south). Additionally, staff recommended low level ground cover.
There were 13 notification letters sent, 2 responded in favor, 0 in opposition, and 0 with no
opinion/undecided.
Staff recommended approval of the request to expand a non-conforming use with the followin*
conditions:
Mr. Wingo asked if the applicant was in attendance and the property owner/applicant Dr. Don
Heven stated he was available for questions from the commission.

Mr. Martin made a motion to approve case C 15-39. Ms. Metty seconded the motion. Mr. Wingo
,.--sked if the commission had any questions for staff.
Mr. Graham asked when the city was zoned, as the dentist office had been in place since 1970.
ON NO Mr. Shapiro said zoning was created in 1985 and the property was designated Single Family (SF-
1). Mr. Shapiro stated a conditional use provides the ability to allow a non-conforming use to
expand.
Mr. Wingo weighed the traffic safety on Call Field with the height of the sign. Mr. Shapiro added
that the Brook Avenue sign regulations allows the lower profile sign to be on the property line,
rather than setback, as is typical for monument signs. Mr. Martin said he was okay with the 3 foot
height adding the sign may be horizontally longer, allowing 60 square feet. Ms. Metty said she
agreed.

1. Text Amendment — Discussion Only — non-voting item
Staff briefing considering amendments to the Code of Ordinances establishing
outdoor display in the downtown core (Central Business District) and minor
amendments to outdoor storage regulations.
Ms. Metty was concerned about the 5-foot clearance being too wide. Mr. Martin responded that
5-feet is typical per code. The minimum clearance for a wheelchair is 3-feet. Mr. Martin believed
the 5-f•ot clearance was needed. Ms. Metty asked if there was a 5-foot clearance for outdoor
dining. Mr. Shapiro responded outdoor display follows the same clearance requirement for
outdoor dining.
Mr. Wingo believed in guidelines and promoting business downtown. Mr. Wingo asked about
how code enforcement becomes involved if it are j age, and not merchandise that can

be sold. Mr. Shapiro stated there are city codes already in place regulating and prohibiting
junk/ru••ish that are enforced.

Mr. Shapiro updated the commission on new appointments and reappointments. Planning
extended the city's appreciation to James Wingo and Karla Metty who served multiple terms and
chaired the commission. Mr. Shapiro also welcomed commissioners Rodney Martin, Barney
Brock, Rick Graham, and Dan Leslie, who were reappointed to new terms. There were also four
new appointments to the commission. Mr. Wingo and Ms. Metty expressed it was an honor to
have served on the commission.
