Min 05/13/1935 Wichita Falls, Texas Memorial Auditorium Building May 13, 1935 The Board of Alderman of the City of Wichita Falls met in regular session at 7:30 P.M. on the above date in the Council Chamber in the Memorial Auditorium with the following members present: Tohn T. Young, Mayor Claude Miller, ;. B. Stokes, L. C. Rodgers, Mack Taylor,, Alderman Mark D. Walker, V. E. Stampfli, Mack Thomas, City Manager J. H. Crouch, City Clerk Ws E. George, City Attorney The k-inutes of the previous meetinW.were read and approved, Mr, Farrington, Superintendent of the Fort Worth & Denver City Railway Com- pany, was presented to the Board of Aldermen by J. H. Allison. Ur, Farrington dis- cussed his company's attitude toward the construation of an underpass on Seventh Street, Moved by Alderman Taylor that the Board of Aldermen of the City of Wichita Falls go on record approving the construction of a proposed railway underpass on Seventh-Street, and instruct the City Attorney to work with a committee to be appointed by the Mayor to consider this project and secure necessary releases fbr right-of-way. Motion seconded by Alderman Walker and carried* Mayor Young appointed a committee composed of City Manager Mack Thomas, Aldermen Taylor and Rodgers to consider this proposed project. ORDINANCE NO 1200 AN ORDINANCE CLOSING THAT PORTION OF KENTUCKY STREET IN THE CITY OF WICHITA FALLS, TEXAS, WHICH LIES BETWEEN WACO STREET AND FORT WORTH STREET, AND DECLARING AN EMERGENCY, Moved by Alderman '�Valker that Ordinance No, 1200 be passed on its first reading. Motion seconded by Alderman 11iller and carried by the following vote: Yeas: Aldermen Walker, Miller, Stokes, Rodgers, Taylor, and Stampfli. Nays.- None* Moved by Alderman ',',Talker that the rules requiring ordinance to be read on three separate days be suspended and an emergency declared, end Ordinance No. 1200 be read on its second reading. Motion seconded by Aldermen Miller and carried by the following vote: Yeas: Aldermen Walker, Miller, Rodgers, Taylor, Stampfli, and Stokes, Nays: None, Moved by Alderman Walker that Ordinance No. 1200 be passed on its third and final reading and be adopted as road, Motion seconded by Alderman Miller and carried by the following vote: Yeas: Aldermen Walker, killer, Taylorg Stampfli, Stokes, and Rodgers, Nays: None. Moved by Alderman Taylor that the following resolution be adopted. Motion seconded by Alderman Walker and carried by the following vote: Yeas: Aldermen Taylorg Walker, Stampfli, Stokes, Rodgers, and killer, Nays: None, - - - - - - - RESOLUTION it has come to our attention that the League of Texas Municipalities is using the dues paid to said league by the members thereof from revenue received from taxation for the purpose of maintaining a lobby at Austin in the person of E. E, McAdams, Executive Secretary of said League, and WHEREJAS, it has been-brought to our attention that the said E. E. YCAdams has actively lobbied against all measures for tax relief presented to the 44th Legislature, and WHEREAS, we do not approve of the policy of using the money of taxpayers to maintain a lobby for the purpose of opposing measures for the relief of property taxpayers* NOW$ THMMFORZ, BE IT RESCLVED that the City Council of the City of Wichita Falls hereby withdraws from membership in said Texas League of Municipalities and strongly condemns the practice of using the duwpaid into said League from the receipts of tax collections in the various cities of Texas for the purpose,,among other,thingsof maintaining a lobby in Austin for the purpose of opposing legislation for the relief of overburdened property taxpayers* BE IT FUR RESOLVED that a copy of this resolution be forwarded Immediately to the President and Executive Secretary of said League and that the resignation of the City of Wichita Falls from said League become effective immediately. ORDINANCE NO 1201 AN ORDINANCE TO FIX THE MINIMUM AND MAMIMM CHARGE MR THE CONSUMPTION OF WATER FOR CHURCHES, SUNDAY SCHOOLS AND HOUSES OF WORSHIP, AND TEIZIR IMMEDIATE AND CON- TIGUOUS GROUNDS MERET09 WITHIN THE CITY LIMITS OF WICHITA FALLS, TEXAS; AND TO IECLARZ AN EMERGENCY9 1, t Moved by Alderman Taylor that Ordinance No. 1201 be adopted* Motion seconded by Alderman Miller with the following result: Yeas: Aldermen Taylor, YAller and Stokes Nays: Aldermen Rodgers, Stampfli, Walker: and Vayor Young* Ordinance No* 1201 failed to carry, Moved by Alderman Walker that the following resolution be adopted. RESOLUTION WHEREAS, at the time of the erection of the Memorial Auditorium of the City of Wichita Falls, a certain room or hall was designated and set apart for the use of Veterans' organizations; this designation being made at the special request of the Spanish American War Veterans and the American Legion, which organizations together with their Auxiliaries, have continued to use and occupy and have charge of said quarters since said time, and spent some Fifteen Hundred ($1,500.00) Dollars in buy ing furnituret chairs, rostrums and other fixtures and equipment for said quarters and have at all times exercised the control and management over same with the consent of the Mayor, City Manager, and Council to the satisfaction of all concerned, AND WHEREAS, some question has arisen as to the rights of said organizations to use said hall and as to their rights to say who may use their furniture and equip- ment located in said hall,, and conflicts in meeting dates having arisen between different organizations by reason of their being more organizations wishing to use said hall than there are nights to accommodate them, AND WHEREAS, the said Spanish American War Veterans and American Legion are desirous of avoiding misunderstandings as to the use of said hall and wish to accommo- date all parties and organizations to the best of their ability in regard to the use of said hall and their furniture therein and at the same time protect their furniture and equipment which cost something over Fifteen Hundred ($1,500.00) Dollars and be allowed to exercise some control over the sams. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDZM%N OF THE CITY OF WICHITA FAILS THAT the American Legion and the Spanish American War Veterans be and are hereby given permission to appoint a joint committee from their organizations to work with the City Manager in the formulating of rules and regulations to cover the use of said hall, together with its furniture, and work out a schedule of meeting dates for all organizations that will be as near satisfactory as possible to all organizations desiring to use said hall and furnitureq with authority to exercise control over said hall and pass upon the kind and character of organizations, which shall be allowed to use said hall. Discussion of the removal of J. L. McClure as Fire Chief was had by Judge Leslie Humphrey, J. Co blytinger, and others and requests were filed with the Board of Alderman that Chief McClure be retained. Moved by Alderman Walker-that the Board of Aldermen recommend that T. L. MCCLURE be retained as Chief of the Fire Department for, at least, one yearo, Motion seconded by Alderman Stampfli end failed to carry by the followirg vote:'; Yeas: Alderman Walker, Stampfli, and Mayor Young, Nays: Aldermen Rodgers, Millery Taylor, and Stokes, Moved by Alderman Walker that the Board of Aldermen officially extend an invitation to the West Texas Chamber of Commerce to select Wichita Falls as the place for their annual convention in 1936, and that the City Clerk be instructed to wire such invitation to the West Texas Chamber of Commerce Convention in session at Plainview. Motion seconded by Alderman Miller and carried, Moved by Alderman Walker that the Board of Aldermen approve and order paid the, sum of $947.60 to Underwood-Elliott Fisher Company; being balence due them for contract on equipment* Motion seconded by Alderman Rodgers and carried, Moved by Alderman Walker that the Board of Alderman approve payment of $583.88 to Hufft kytinger and Walker, covering reimbursing contract for water mains in Brook Avenue Addition, Motion seconded by Alderman Stokes and carried, ORDINANCE NO 1199 AN ORDINANCE CREATING ME OFFICE OF INSPECTOR OF WEIGHTS AND MEASURES IN THE CITY OF WICHITA FAILS; PRESCRIBING HIS IUTIES; THE STANDARD OF WEIGHTS AM MEASURES FOR THE CITY OF WICHITA FALLS; REGULATING THE TESTING AM USE OF WEIGHING AND 1ZASUR1NG DEVICES; PROVIDING FOR THE ISSUANCE OF CERTIFICATES OF ACCURACY OF WEIGHING OR MKASURING DEVICES; PROHIBITING THE GIVING OF SHORT WEIGBTS OR IVEASURES; REGULATING THE MANUFACTURE AND SALE OF CERTAIN COMMODITIES WITH RESPECT TO WEIGHTO MEASURE AND NUMERICAL COUNT; containing specifications and tolerance; DEFINING CERTAIN TERVIS AND PROVIDING PENALTIES FOR TRE VIOLATION OF THIS ORDINANCE; PROVIDING FOR 1HE METHOD OF PROSECUTING CORPORATIONS AND OTHERS FOR VIOLATING THIS CIMINANTCE; CONTAINING A SAVING CLAUSE; REPEALING ALL FCMZR ORDINANCES IN CONFLICT HEREWITH; AND ENACTING 1HE NECESSARY PROVISIONS INCIDENT To TEIE.
