May 2nd, 1935.
To the City Council of Wichita Falls, Texas.
Gentlemen:
In order that we may have a more definiteunder-
standing about the services I am to render as your special
counsel on Utility Matters and have a record of same for
your files. I am submitting the following statement, set-
ting out the terms of my agreement with you, and the con-
sideration which I am to receive for such services.
First: I am to represent you on six utility cases
that were filed in 1934. These cases are as follows: Texas
Electric Service Company, a street rental case pending in
the District Court, Wichita County, Texas; Suit against
Northern Texas Utilities Company, pending in the District
Court, Wichita County, Texas; Municipal Gas Company, rental
suit pending before the Court of Appeals, Ft. Worth, Texas;
Municipal Gas Company Rate Case, now pending before the
District Court of Travis County, Texas, on Appeal from
Decision of Railway Commission; Two Suits against S. W. Bell
Telephone Company; these suits settled in Federal Court at
Dallas in compromise between City and the Telephone Company.
On the cases listed above, I was to receive a fee of
$2,000.00, and I have received $1500.00 of that amount.
Second: I have recently filed three suits for the
City of Wichita Falls, Texas, not included in the above matters,
and I agree to prosecute the same to a final conclusion, for
the sum of $1000.00. These cases are as follows: Suit against
the Western Union Telegraph Company, and a suit against the
Postal Telegraph Company; the third suit is a suit for trans-
ferring back to the General Fund and Park Funds, the sum of
$57,910.72 from the Interest and Sinking Fund.
On the Second proposition, I suggest that the City
pay me $500.00 on acceptance of this proposition, and the
balance as the work satisfactorily progresses.
Respectfully submitted,
Accepted for the City of
Wichita Falls, Texas, this
date above written.
